TYPICAL OF THE

DECEPTIVE BUDGET PROCESS,

COUNTY SUPERVISORS TUCKED

HUNDREDS OF THOUSANDS OF DOLLARS INTO THE PARK BUDGET ONLY TO BE REDIRECTED

Johnstonville Park

$25,000 budgeted

DOES NOT EXIST

10.76 Acres on Diane Drive, Susanville

APN 116-180-62

just another Budget Scandal

[Bieber Park, Brian Dahle's District, gets $250,000]

In 2010, Supervisor Keefer wanted to build a new community Park in Johnstonville. The County had access to Prop 40 funds (2002, California Clean Water, Clean Air, Safe Neighborhood Parks and Coastal Protection Act).and Supervisor Keefer wanted to use these funds for a community park in his District.

The County land in Johnstonville soon proved to be unsuitable due to drainage issues. Caltrans yard across the road drained into the proposed park land. Caltrans was asked to mitigate this and agreed to grade their land so the water would be re-directed.

According to public records, the County budgeted $25,000 for the Park in 2010 but never spent anything. The Park was then re-located to Janesville and has now been re-named after Supervisor Keefer who lost his bid for re-election to Larry Wosick (a one term Supervisor)

BUDGET TRICKS /  BUDGET LIES

Brian Dahle was Supervisor of District 4 in 2010. $250,000 was placed in the 2010/2011 Budget for his Bieber Park.

Chapman claims that the Old Historic Court house is not

HISTORIC ANYMORE

Watch Chapman whine about his new Board Room

Is Chapman's memory conveniently failing

The Lassen County Court House was registered with the National Register of Historic Places on January 23, 1998 as the "Courthouse Square"

According to public records, Lassen County has pulled many permits, since 2012, to remodel this Court House after the new $38 million dollar Hall of Justice was built on Riverside Drive. This building falls under the Americans with Disabilities Act (ADA).

NOTE: Lionakis was the Architect that designed the new Hall of Justice. Lassen County Supervisors just signed a $133,000 contract with Lionakis to study the old Court.

Many space needs studies have been done and the County is well aware of each and every inch of this building.  The $133,000 is a gross waste of tax payers money

THERE IS ONLY ONE PERSON, CHAPMAN, WHO HAS PUSHED THIS

....more to come

Lassen County Supervisors

Watch CAO & Supervisors Dummy-Up when drilled on the Longevity pay

Approve a Pay Raise for themselves

that will now be given when the

Lassen County employees get a pay raise

GONE IS THE STUPID 25% OF A SUPERIOR COURT JUDGES SALARY

WHAT was added IS THE SECRET BONUS PAY

The Longevity pay: this is a 15 year bonus salary program for Supervisors.

After 7 years of service the Supervisors get a 2 1/2% bonus. But they are given  5 years seniority automatically the day they are elected so after two years they are quietly given this 2 1/2 % bonus pay. A Supervisor gets another 2 1/2% raise if they are re-elected. After ten years in office (2 1/2 terms) they get an automatic 7% bonus pay.

Kan We Help has objected, for many years, to this secret Bonus because it exceeds the Statutory Pay limit

This "longevity pay" was excluded in the 2013 Salary increase

All salary/pay is regulated through this Ordinance and there is no mention of an additional "longevity pay" and yet all Supervisors received this pay.

Benefits are defined here as health benefits, life insurance, retirement benefits but does not include any "salary/pay" increases.

but was re-instated in the 2015 pay ordinance ?

Watch the Supervisors dummy-up

Supervisor left to right: District 5 Tom Hammond, District 3 Jeff Hemphill, District 1 Bob Pyle, District 4 Aaron Albaugh, District 2 Jim Chapman

&

approved yet another "STUDY" of the County's

space needs for the old Court House

{Past studies have been expensive and never used. This will be no different}

They approved the unbudgeted $133,000 contract for the Old Courthouse without considering the fact that they have no idea what it will cost to fix the Riverside building and move four Departments.

CAO Egan was asked several times how much it will cost and he went from "I don't know to "maybe $200,000 or $300,000.

The public was told $600,000 and that was before they found out all of the repairs that will be needed before anyone moves in.

 December 14, 2015

There is no public outcry for a new

Board of Supervisors Board room

On January 21, 2013 Supervisor Chapman led a tour of the old Court Annex space in the basement of the County Administration Building on Roop Street

http://www.kanwehelp.com/page_o1181.jpg

Without any authority, Chapman instructed NST to proceed with plans to

remodel this Courtroom into a Board Room

http://www.kanwehelp.com/page_o1182.jpg

Jeff Morish, from NST, told the Board on February 11, 2013, a Master Plan should be done first. Chapman really showed no interest in doing this the right way. Chapman wants a new Big Board Room with all of the bells and whistles.

On April 23, 2013 Board of Supervisors meeting, Supervisor Chapman pushed to approve a contract with NST to "study" the use of the Court Annex for space and design. Soopervisor Chapman pushed to get his new Board Room done by June 17, 2013.  Jeff Morish said it could not be done.  At this time, the Supervisors had not budgeted a dime for this folly.

Kan We Help requested a copy of this "study" and was told that it did not exist

On December 10, 2013, CAO Martin Nichols presented a "Reassignment of Courthouse Space" to the Board of Supervisors.

Martin Nichols tells the Board "at such time as the remodeling costs are known, the Board will be advised of that determination and be requested to appropriate those expenditures

At the January 21, 2014 Board of Supervisors meeting, Chapman now wanted a Task Force Committee to be formed. Chapman never mentioned bringing back any previous Task Force.  This new Task Force would be chaired by him and members would be hand picked by him. Chapman claimed that this new Committee would be tasked with moving County Staff efficiently into available spaces in the old Courthouse and Courthouse Annex. Chapman promised that the "COURTHOUSE SQUARE REVITALIZATION TASK FORCE COMMITTEE" would recommend what needs to be done with the vacant spaces.

THIS COMMITTEE NEVER MET AND WAS DISBANDED IN 2015

On March 11, 2014, the Board of Supervisors set aside Chapman's Dreamcicle Board Room.

On April 14, 2014, new CAO Richard Egan claimed that he was going to receive a "NEEDS ASSESSMENT STUDY" in a few weeks and told the Board that rather than spending money to remodel the vacant spaces, it might be possible to buy the BLM building on Riverside Drive. Kan We Help requested a copy of this study and was told that it was not disclosable.

The 2015/2016 Budget (July 1, 2015 to June 30, 2016) did not include any money for remodeling the Courthouse/Annex projects. Previous and present Board members have said many times that a Master Plan must be in place before this EXTENSIVE movement of county offices. NOW, before ONE DOLLAR is spent on the new Riverside building, Chapman now wants to spend $133,000 on a study for his New Board Room, up those stairs,  in the Old Courthouse.

He is obsessed with putting an elevator in ?

The Lassen County Supervisors eventually purchased the BLM building by borrowing $4.1 million. The Supervisors have no idea how much "fixing" this 1996 building will cost, plus moving costs, plus new furniture, fixtures. After transferring $1.1 million to the JPA for the community pool there is less than $1.5 million left of the loan.

Over the years, Chapman has made many attempts to get "new digs".  The Supervisors have placed this issue on the December 15, 2015 Agenda to spend $133,000 just to look at the possibility of building a Board Room in the historical Court.

AFTER THE BLM BUILDING IS REMODELED AND OCCUPIED SOME TIME NEXT YEAR, THEN AND ONLY THEN SHOULD THEY consider

CHAPMANS

DREAMCICLE

..some time in the future, if at all

Eventually, if they can find the money, the most efficient and convenient space to move the Supervisors Board room is the 2600 square foot Auditors office in the County Administration building on Roop Street. The Auditor could relocate directly below in the space vacated by the Public Defender.

Sounds simple, cost effective and efficient......tell Supervisor Chapman

Another slight of hand move by Lassen County Supervisors

The Statutory Salary limit, approved in 2013, for Lassen County Supervisors is *$35,485

*According to surrounding counties Supervisors salaries,  this is a competitive salary

HOWEVER

Lassen County Supervisors receive an additional pay increase they just don't want to talk about which pays them thousands of dollars above the Statutory Salary

Example:

Benefits listed are benefits paid by the County not the employee

The Supervisors total compensation

if this Ordinance is approved on 12/15/15:

Chapman *$59,349

*Chapman is paid $1,437 per board meeting regardless if he attends

Pyle $59,349

Albaugh  $ 55,592

Hammond  $ 56,207

Hemphill  $ 45,196

 December 11, 2015

LASSEN COUNTY'S

POOR MANAGEMENT, POOR PLANNING

Lassen County decided on acquiring a $4.1 million dollar debt this year.

They spent $ 1.4 million on a building (2950 Riverside, Susanville)

September 22, 2015 Video Tour

The Supervisors have no idea how much they will need for the repairs, remodeling and the cost to move four county departments in to it (District Attorney, Public Defender, Child Protective Services, Probation Department)

With less than $1.5 million left [of the$ 4.1million loan], Chapman pushes his new Board room up so he can "hold court" in it before he retires at the end of 2016.

Chapman escalates his new board room on 9/22/15 with an illegal RFP

There is no public outcry for a million dollar Supervisors Board Room,

you just hear Chapman's cries

 December 10, 2015

KAN WE HELP FILES

BROWN ACT COMPLAINT

This was all Chapman

Supervisor Hammond stated that he did not know about this RFP. He was never given a copy. No Supervisor was given a copy except Supervisor Chapman

Chapman, a 40 year career politician, knew his action was illegal

He escalated his new Board Room.

Listen to the discussion "at the end of the meeting" on 9/22/15

Chapman knew better than anyone that there was no plan to remodel the old Courthouse until the next fiscal year

Remodeling the Riverside property may take most of the remaining loan dollars

and

Chapman knew that it was anillegal process to issue a Request For Proposal in this manner.

WATCH THE 12/8/15 DISCUSSION

Supervisor Pyle childishly threw the KWH Complaint over his shoulder. Chapman just pontificated

Supervisor Albaugh was absent but Hammond, Hemphill, Pyle and Chapman approved the Contract to Lionakis for $133,300.

This is not budgeted. Kan We Help will monitor how they pay for this.

CHAPMAN WANTS AN ELEVATOR IN THE OLD COURTHOUSE BECAUSE

PLUMAS COUNTY & MODOC COUNTY HAVE AN ELEVATOR

LEFT PHOTO:  Plumas County Courthouse    RIGHT PHOTO: Modoc County Courthouse, Chapman got stuck in their elevator when he recently visited.........

Chapman wants to demolish the historical courtroom, at the top of these stairs, for his new board room. Chapman also wants an elevator because Chapman just loves elevators.

 December 9, 2015

LASSEN COUNTY SUPERVISORS DECIDE

NOT TO GIVE THEMSELVES

AN OBSCENE PAY RAISE

Kan We Help presented the pay history to the Board of Supervisors and publicly exposed that they have been getting pay increases in the Budget since 2002.

WATCH THE 12/8/15 PAY INCREASE DISCUSSION

(Definition of a pay raise: any increase to pay)

Supervisors Pyle and Chapman attempted to claim again they had not received any pay increases since 2002 but had to take back that statement when the Auditor confirmed they had received a pay increase in 2013

Reluctantly, the Supervisors approved an Ordinance that would give them their pay raises when County employees were scheduled to get contractual pay raises.

The idiot "25% of a judges salary" clause was removed.

The Supervisors can use that $37,260 pay rate set in the 2015/2016 Budget to pay for the first two increases.

Supervisors Pyle, Chapman, Albaugh and Hammond still receive more than the statutory pay now !

 December 8, 2015

LASSEN COUNTY SUPERVISORS HAVE BEEN HIDING THEIR PAY RAISES IN THE BUDGET

TO AVOID ANY  PUBLIC DEBATE

TODAY, THEY WILL TRY AND PASS AN ORDINANCE RAISING THEIR PAY

 an additional$10,000 A YEAR

County Counsel claims he isn't aware of a proposal for an increase to the Supervisors salary to $47,260

All Lassen County Supervisors receive thousands of dollars over the statutory $35,485

According to Lassen County payroll records:

Bob Pyle & Jim Chapman are currently

receiving  a salary of

$40,534.83 and $17,928.61 in public benefits

DO THE MATH:   $58,463

This equates to over $1,500 per meeting whether they attend them or not

(approximately 40 annual meetings)

....and now they want $63,463 annually ?

FACT:

The Supervisors already built in their $37,260 raise into the 2015/2016 Budget

 December 5, 2015

OUR APOLOGIES & Thank you's !

Our opinions@kanwehelp.com mail box crashed due to the volume of responses to our recent postings. We have made adjustments to our mail-box to handle any amount in the future.

It is up and running again. Kan We Help thanks all of you for your words of appreciation.

Remember, these politicians answer to you. Make them do the right thing for the people of Lassen County

 December 4, 2015

Lassen County Supervisors

gave themselves a raise in the Budget

on July 1, 2015

Their salary went from $35,485 to $37,260 without approving the required Ordinance

....So what is this Farce County Counsel is trying to pull off ?

Current Ordinance/Current Budget

County Counsel is relying on the Public NOT NOTICING that he has been instructed by the Supervisors to up the Supervisors salaries again on December 8, 2015 an additional $10,000

Supervisors place a huge salary increase for themselves on the December 8, 2015 Agenda.

It will be the last item on the Agenda and they hope no one is left at the meeting to notice

Supervisors 2015 salary increase attempts

If the Supervisors were paid by the hour this is what their paychecks would be every two weeks

Jeff Hemphill   $ 99.93

Tom Hammond     $314.71

Jim Chapman     $480.00

Aaron Albaugh  $ 210.93

Bob Pyle     $480.00

The Lassen County Supervisors have never been honest about what they receive in compensation

It certainly IS NOT THE $35,485 SALARY STATED IN THE CURRENT ORDINANCE.

PAY ATTENTION

These five unscrupulous elected officials will also try and slip their $1,000,000 Board room with its $500,000 elevator in to this two story building.

The Bid amounts on this illegally issued RFP were omitted on the Bid Sheet. No money was budgeted for this huge unnecessary renovation. No motion was ever made to approve and issue this RFP

And.......now they are going to approve a contract to repeat what they have done three times before.

 December 3, 2015

JIM CHAPMAN'S

MILLION DOLLAR

ROOM

Supervisor Chapman is a government within himself

King Chapman

The Lassen County Supervisors voted not to budget any funds for the Courthouse renovations from the LCPIC slush fund in the 2015-2016 Fiscal Year

THERE WAS NO DISCUSSION ABOUT ANY RFP at the September 22, 2015 Board of Supervisors meeting, NO DISCUSSION, no vote,  ABOUT ANY RFP.

CAO Richard Egan was not given nor ever asked for permission to release a Request for Proposal for the Courthouse Renovations and yet it was released.

Listen to the discussion "at the end of the meeting" on 9/22/15

NOTICE:  The Bid amounts were deliberately omitted

CHAPMAN HAS TRIED THIS BEFORE:

When Chapman wanted his new Board Room in Judge Sokol's old Courtroom (The Annex) "he" arbitrarily instructed NST to go ahead with thousands of dollars of remodel plans. He had  no authority to order this work and now he has done the same thing with the Old Courthouse.

Chapman then tried to form his own Task Force to decide where his new board room would be. This committee never held a single meeting and was disbanded.

Career politicians develop a sense of ENTITLEMENT.

In Chapmans case he crossed the line

LMUD vs. Hayden Hill (Kinross Gold)

Hundreds of thousands of ratepayers money has been spent on a $65,000 land deal

Mr. Poof was very much a part of the Cady Scams that cost LMUD ratepayers millions

William Stewart survived the CADY YEARS but was very much apart of all those scams that were perpetrated on the ratepayers.

LMUD General Manager/Accountant Bill Stewart to Retire

Coincidence?

Stewart will retire on the eve of the Hayden Hill trial where he, as LMUD's bookkeeper, issued a check to purchase the Kinross Gold land that was signed by Fred Nagel and Frank Cady.

The entire LMUD Board has lied about their decision to purchase this land

LMUD then discovered that they could not buy their way out of the obligation to clean-up the site so they sued Kinross Gold stating that Frank Cady did not have authority to sign the Purchase Agreement.

LMUD Claimed that Frank Cady did not have authority to purchase and they want to give the property back

Not to mention the recent  "unwarranted" rate hike approved.  How much will go for legal fees.

LMUD has socked away millions of dollars

.....and will do anything legal or illegal to get it

Chapman wants to spend $500,000 to put an "elevator" in this two story building.

Lobby of Old Lassen Superior Court room

Currently the District Attorney has offices upstairs and will move to the Riverside Building after extensive remodeling ($1,000,000 est.)  is done. The RFP was discovered when Kan We Help was monitoring the LCPIC expenditures.

The Lassen County Board of Supervisors

did not budget a dollar on this Project

for

There is a good reason for this. They don't know how much the Riverside building is going to cost to remodel, repair and move 4 County Departments in to it

The Lassen County Supervisors have been unsuccessfully  trying to hold a Lassen Modoc Flood District meeting without the Modoc Supervisors

Chapman & Hemphill get stuck in Modoc Court elevator & Chapman cites motive ?

On November 17, 2015, the Supervisors failed to agendize this subject and instead illegally slipped the Flood District meeting in the last item of the day, CAO Richard Egan's "Information for the Board of Supervisors"

 Listen to the 11/17/15 discussion

Lassen County Supervisors want control over the Watersheds in the Lassen-Modoc County Flood District.

Lassen County Supervisors want to create watershed "Zones" within this District that Lassen County will have authority over.

There was talk about forming a JPA which would not be controlled by LAFCO.

JPA's are black holes for money and corruption

Lassen County Budget

Lies & Deceptions

After Kan We Help discovered millions of dollars the Lassen County Supervisors tucked away in accounts like postage and transportation a new budget scam has been uncovered

CAPITAL PROJECTS

One Example and the tip of the iceberg:

Westwood Community Center Remodel

ACTUAL DOLLARS REPORTED SPENT ?

2010: $5,000    2011: $45,000  2012: $5,500

Also take a look at the discrepancies for Janesville Park, Spaulding Marina, Lake Leavitt Park, Beiber Park, etc. !

The work was never done, and the budget numbers have been falsified. This method is used consistently year after year.

Compare each line item in Fund 150

NOTE:  Where is Johnstonville Park ?

This goes farther than Lassen County

Public Records show that the Treasurer, Richard Egan may have been falsifying the State Controller Schedules also

....and

The Lassen County Supervisors divert budgeted dollars to other projects as a matter of ordinary business.

Suddenly the "ACTUAL" expenditures change again. Look, in particular to the re-roofing of the Westwood Library. The County claims they spent $58,000 to re-roof a 1,000 square foot Library in 2012, and in  2013 spent $49,000 to re-roof the Westwood Library, and in 2014 spent $33,751 to re-roof the Westwood Library

Look at how the "Actuals" have changed

FACT: The Westwood Library hasn't had a new roof in 30 years

Lassen County CAO Richard Egan

Tells Supervisors, At Board Meeting,

 Yesterday

He Is Putting Together  An Illegal Board Meeting

in Modoc County

Richard Egan stated that he tried to set a Lassen Modoc Flood Control District Meeting for December 10 in Adin, Modoc County. but the Modoc County Supervisors could not attend. Egan claims he is going to try and set the meeting on December 17, 2015. That meeting will be cancelled also.

THE PROBLEM:

Egan said that he plans to hold the Flood District meeting, in Modoc County and then adjourn to reconvene an illegal Lassen County Board meeting in Modoc County.

MAJOR, HUGE, GIGANTIC,

BROWN ACT VIOLATION

Egan finished by telling the Board that he is working with County Counsel Bob Burns to make the arrangements. What better person to get advice from than a man that has no problem ignoring laws.

Expansion of the Beiber Family Resource Center (One Stop)

A 2009 Lassen County capital improvement project that is yet to be built even though the States $788,000 Grant money still sits in the bank to expand this facility.

This project had no fiscal impact on the General Fund. This CIP was funded through the Mental Health Services Act and the Supervisors continued to waste this Grant money .

At the May 12, 2015 meeting, the Employees at the three Family Resource Centers (Beiber, Herlong and Westwood) asked for help. The One Stops currently get $10,000 support from the Supervisors.

Lassen County's Fraud & Abuse

TOM HAMMOND: MR. CONFLICT OF INTEREST

"Bob Burns: The Dark Stinky Stain on the County"

The Lassen County Supervisors decided to hire the sitting District Attorney Bob Burns as their new County Counsel when the current County Counsel Retta Vander Ploeg gave her notice. The Supervisors decided to hire Burns at an out-of-town meeting, out of Susanville. This meeting was held in Bieber. No audible motion was made to hire him and yet the Supervisors signed his contract on May 16, 2014.

On September 24, 2013, Tom Hammond was seated after District 5 Supervisor Jack Hanson was recalled.

Tom Hammond was Lassen County Vendor #611 when he was seated on the Board of Supervisors.  Hammond knew that he was doing business with Lassen County for years and it would be a conflict if it was not disclosed. Over the next two years Supervisor Hammond continued to do business with Lassen County, a lot of business.

Burns said nothing, Egan said nothing. HAMMOND SAID NOTHING, until inquiries were made about the conflict of interest.

DATA BELOW ACQUIRED THROUGH PUBLIC RECORDS

CAo Richard Egan never brought this issue immediately to the Board when he was hired on February 25, 2014. Egan was Lassen County Treasurer, and long time resident, prior to being hired by the Supervisors as County Administrative Officer.

For the past two years Tom Hammond has continued to violate the FPPC rule that requires the Board of Supervisors to "ratify" doing business with Supervisor Hammond

Supervisor Hammond did not disclose to the FPPC that he was doing business with Lassen County. The FPPC fined Supervisor Hammond $2500 for voting on the Pezzullo Herlong Sale and had this been disclosed the FPPC would have fined Hammond over $5,000.

Agenda H-4 was placed on the October 13, 2015 Board of Supervisors Agenda [see 10/17/15 post below] to allegedly give CAo Richard Egan special authority to approve spending over $25,000 for 14 accounts (Totally unnecessary due to budget restrictions already in place).  The real goal was not the 14 accounts, but just Supervisor Tom Hammonds account for his businesses in Herlong. Listen to the Burns & Egan Agenda H-4 Discussion on 10/13/15

Suddenly Cao Richard Egan advises the Supervisors that they should take a separate action on Supervisor Hammond's business. The vote was unanimous to continue doing business with "The Mark"  (Hammond's business in Herlong). This vote should have been made the day Supervisor Hammond took office (9/24/13) two years ago when County Counsel Vander Ploeg was still there. Vander Ploeg is the "attorney" that advised Tom Hammond that he could vote on the Pezzullo/Herlong sale. A vote that cost Supervisor Hammond a FPPC $2500 fine.

NOW........County Counsel Bob Burns advises the Supervisors that under Government Code 1091 (c) 8 a majority vote must be taken for Lassen County to continue doing business with Supervisor Hammond

No such code exists

L: Bob Burns

On October 27, 2015 Kan We Help advised the Supervisors, in writing, that the County Clerk had changed this erroneous code, 1091 (c) 8 in the October 13, 2015 Minutes  to 1091/1091 (b) 8. The Supervisors, after Kan We Help disclosed the error, passed the Minutes without correcting the Minutes.

Listen: BOS 10/27/15 MEETING

NO FPPC LETTER EXISTED

The Supervisors never discussed correcting the Minutes. Burnsfake code was changed to 1091 (b) 8.

CAo Egan claimed that he had suspended Supervisor Hammond's account in July of this year.

Of course that was a bold face lie

Bob Burns Trashes Modoc County

Listen to Bob Burns comments on 10/27/15:

"There is a lot of fraud and abuse in Modoc County"

who would know fraud and abuse better than bob burns?

Bob Burns, Lassen County Counsel

CAO Richard Egan has been trying to hold a Lassen-Modoc County Flood Control & Water Conservation District meeting with or without Modoc County. He and Bob Burns told the Lassen County Supervisors that the five Lassen County Supervisors would qualify as a quorum as determined by their alleged 9 member Board.

Burns, Egan and Chapman are attempting a very deceitful act.

John Benoit of LAFCO, provided Kan We Help with a copy of the "Act" that created this District.

The Supervisors District's, in both Lassen and Modoc County's, must be within the territory of this flood district, to be on the Flood Board.

At the time this was discussed there could have been 10 members on the Flood board. Re-districting in Modoc County  included Supervisor David Allan.

The issue for Lassen County is that the Big Valley watershed is in limbo.

As always, Chapman mis-spoke about the events surrounding Kan We Help contacting Modoc County CAO Chester Robertson. Evidently Chappy was in Modoc County at the time Mr. Robertson spoke with Kan We Help's Secretary Eileen Spencer and revealed that Chapman got stuck in their elevator.

Modoc County is very concerned about the "Bully" behavior of Lassen County.

The issue came up when Richard Egan stated that he was setting up a meeting of Lassen County Supervisors in Modoc County. The Brown Act does not allow them to hold a meeting outside of their jurisdiction with the intent of adjourning their meeting to hold a Lassen-Modoc County Flood District meeting.

However the "two county" board could meet after a proper Public Notice to conduct only the business of the District.  The subject matter that the Lassen Supervisors want to discuss is not within the jurisdiction of the Flood Board.

quagmire ? YES

Modoc County, evidently,  is not going to be bullied and Lassen County does not know what to do except

HLVRA's Unprofessional Speculations

May Prove Too Costly Too Build the Pool

The HLVRA Board of Directors would not listen to those professionals that strongly suggested getting a set of Plans done a year ago.

In fact, that was their original goal

This stumbling Board has  now issued two RFP's. The second RFP included a Gross Maximum Price of $2,249,866 to design and build a community pool.

Unfair to any Contractor, this HLVRA Board voted to amend the GMP to $3,000,000 so they can sign a contract with Modern Building...........

How many ways is this JUST WRONG ?

This pool cannot be built for $2.2 million but the HLVRA Board was told this over and over.

Even though the second RFP clearly stated the GMP,  only two Contractors Bid in an illegal and unethicalsecret bid opening.  Modern Building bid $2.9 million and Tricon bid $3.3 million

The Board voted to sign a contract with Modern Building and try and scale down the pool because they do not have $3,000,000.

GUESS WHAT?

THEY ALSO TALKED ABOUT  JUST HAVING THE DESIGN "PLANS" DONE AND THEN BACK OUT OF THE CONTRACT WITH MODERN !!!!!!!!

Hopefully none of these Board members (Hammond, Chapman, Wilson, McBride) will be in office when they come to the public for more money

....and 3 months later, the

District Attorney has done nothing ?

THEN THERE WAS

 "NO INTENT TO COMMIT PERJURY"

Deputy DA David Evans may have lost the County Assessor's perjury case intentionally. He ran against Stacey Montgomery for District Attorney and lost and may have wanted to just make her look bad like he did with Bob Burns during the 2014 campaign

David Evans: "Now, is the time to take over this office"......

Instead, Evans just looked incompetent

Evans presented a clumsy and contrived case against the Lassen County Assessor and often times during the hearing froze, forgot his line of questioning and repeated himself to the point where you could watch the public gallery shake their heads in disbelief.

Lassen County CAO & County Counsel

Lied to the Board of Supervisors

about

Supervisor Tom Hammond

CAo Richard Egan and County Counsel Bob Burns put on a

Dog & Pony Show

at the October 13, 2015 Supervisors meeting

Listen to the Agenda H-4 Discussion, 10/13/15

Agenda H-4 was placed on the October 13, 2015 Board of Supervisors Agenda to give CAo Richard Egan special authority to approve spending over $25,000 for 14 accounts.  The real goal was not the 14 accounts, but just Supervisor Tom Hammonds account for his businesses in Herlong.

Cao Richard Egan advises the Supervisors that they can take a separate action on Supervisor Hammond's business. The vote was unanimous to continue doing business with "The Mark"  (Hammond's business in Herlong). This vote should have been made the day Supervisor Hammond took office (9/24/13) two years ago.

All County purchases are monitored by the County Auditor and are subject to each Departments Budget. The CAo did not need any special authority on any account since he can approve a single purchase of $25,000. If a Department exceeds their Budget it must be approved by the Board of Supervisors

This Agenda item was only about protecting Supervisor Hammond's business with Lassen County

County Counsel claimed that Tom Hammond's interest with his County Account was remote (Gov't Code 1091 a & c) and the County could continue purchasing from Hammond's businesses in Herlong if they took a vote.

Tom Hammond owns 51%

of "The Mark" in Herlong.

CYA:

Burns also claimed that the FPPC's  Conflict of Interest  Penalty letter allowed Supervisor Hammond to do business with Lassen County. It does not. The Supervisors were told, on October 13 by Burns & Egan, they must take a vote to "ratify"doing business with Supervisor Hammond. This vote was required the day Tom Hammond took office.

THAT IS WHAT AGENDA H-4 WAS ABOUT.

*Five year history of Vendor #611

*Verified by Lassen County Auditor records

KAN WE HELP requested a copy of this FPPC "Advice Letter" Burns referred to on October 13, 2015 and the Memo CAo Richard Egan claims he sent to County Departments in July suspending business with Supervisor Hammond

Running County Business

CAO Egan busy playing politics  and selling himself for bigger role, bigger paycheck and it won't be in Lassen County

[Does anyone remember the Ketelsen/Settlemire debacle? The two attorneys exchanged being CAO]

Why has CAO Richard Egan given the role of approving County spending to Bob Burns, not Deputy CAO Tony Shaw ?

The Westwood Library's new roof is being held up until Bob Burns approves the $10,000 new metal roof that was approved in the  2015/2016 budget.

Why would Burns even be in the "loop"?

District 1 Supervisor Bob Pyle does nothing?

Bob Burns targeted 14 Venders to be monitored but wants Supervisor Hammond's business in Herlong, "The Mark", to be taken off the County's purchasing list.

Bob Burns decides "who" rents public property. KWH wanted to rent the Old Courthouse room for two days and Burns went off on a huge paranoid conspiracy theory.  Burns supported the same rental to attorney Chip Chittock and had no problem with Chittock having direct access to the District Attorney's offices. The DA is currently housed adjoining the old courtroom upstairs.  Chittock has yet to give a date to the County for the "rental".  KWH was turned down for the rental because no date was given.

Supervisor Chapman chimed in and agreed with Bob Burns that it would be  a liability to have the Kan We Help people or the public traipsing up and down those stairs.

The old courthouse has never been ADA compliant. But the other 2 story County buildings have never been ADA compliant either.  Chapman only wants to put a $500,000 elevator in this building so that he can spend $1,000,000 on his new Board of Supervisors Board room in the historic courtroom.

THE LASSEN COUNTY DISTRICT ATTORNEY'S OFFICE IS AT THE TOP OF THESE STAIRS

Chapman went on to rattle off  all of the other places in Susanville that Kan We Help could rent for their two day meeting

Burns has over stepped his authority a bit..............

Judge Mallery Throws Out

District Attorney's Perjury/Voter Fraud Case

Against Lassen County Assessor

The District Attorney's political vendetta against Lassen County Assessor Dan Schlueter ended this afternoon when Schlueter's attorney Stephen King proved that his client did not commit perjury.

Steve Pezzullo lost his appeal to lower his Herlong properties tax bill.  Pezzullo paid his taxes in full on March 11, 2015 and then shortly after, according to Deputy McGarva's testimony, an "anonymous" voter fraud/perjury complaint was filed with District Attorney Stacey Montgomery.

Pezzullo's attempt to acquire Herlong's Amedee Army Airfield was foiled when the Assessor assigned Parcel numbers to the Airfield. Lassen County Supervisors attempted to include the East end of the Amedee Airfield to Pezzullo when they gave him the 3,000 acres of public land.

In an earlier sale to Pezzullo, the Lassen County Supervisors succeeded,  in including the "One Stop" building in Herlong. Pezzullo gave the building back to the County when he found out that he would need to bring the building up to ADA compliance before he could sell it.

PEZZULLO & MONTGOMERY ATTENDED THE COURT HEARING TODAY

DA Montgomery's lead investigator, Undersheriff John Mineau, told the DA that Dan Schlueter did not live in Clear Creek (Lassen County) because Schlueter could not have lived in an "uninhabitable" trailer on his property. DA Montgomery did not present a single witness that could verify this assumption. She relied totally on the statements by Officer McGarva and Undersheriff John Mineau (Mineau did not testify and was not present in the courtroom).  King, on the other hand,  provided five witnesses that rebuked McGarva's testimony.

Dan Schlueter's attorney Stephen King presented a brilliant defense that proved that the Assessor lived in Lassen County prior to filing his candidate papers to run for the seat being vacated by long term Assessor Ken Bunch.

Montgomery leaves the courtroom vowing to contact the Secretary of State  ???????

The Drought Effects Lassen County

PGE Lake in Westwood

According to Paul Moreno, a PGE Media representative, Mt. Meadows Reservoir was drained due to the fact it was not maintaining a level needed for hydro-power. Mr. Moreno stated that no other lakes in the area were effected.

Rumors that it was an accident when a valve was un-clogged by a Fish and Game biologist are not true. PGE has been monitoring the lake levels daily for some time.  Paul Moreno stated that all of the creeks feeding Mt. Meadows Reservoir have dried up and the little water left was not supporting the fish population.

UNLESS THE AREA GETS SIGNIFICANT RAINFALL OR SNOW THIS YEAR, THE LAKE WILL REMAIN DRY

PGE drained the lake on September 12, 2015 ?

It will take years after the drought ends to fill Walker Lake aka Mt. Meadows Reservoir

This was the view from across the dam

Sheriff Growden initially spoke at the June 23, 2015 Board of Supervisors meeting wanting to use the Westwood warehouse at 463-475 Birch Street in Westwood. He then spoke on September 15, 2015 and stated that the Sheriff's Department could pay back the $50,000 RBEG Grant ( Rural Business Enterprise Grant)

Probably, the extra $50,000 the Sheriff found can be used for a better purpose

Lassen County used a $50,000 RBEG Grant (obtained through the USDA) to renovate this building and it can only be used for small and emerging private business enterprises with less than 50 employees and less than a million dollars in gross revenues.

 ???????

On May 19, 2015, Public Works asked the Board of Supervisors for authority to purchase a warehouse that sits on 3.48 acres in Westwood. The Supervisors approved this purchase and paid Ryan Real Estate Appraisers $3500 to appraise this property.  This Warehouse is less than 2 miles from the Birch Street warehouse property.

Currently the Herlong, Westwood and Bieber "One Stop" Resource Centers receive $10,000 a year.  The Supervisors want them to raise their own money because they would feel better.

NOW, THE SUPERVISORS THINK THEY DESERVE AN $11,755 ANNUAL INCREASE IN THEIR SALARIES

They are overpaid now, so maybe we should tell the Supervisors to

EARN WHAT THEY ARE NOW BEING PAID BEFORE THEY CAN ASK FOR MORE MONEY

LASSEN COUNTY

"the county of privilege"

Lassen County Counsel Bob Burns contract states that he will get a

$126,897 salary plus benefits

(70% of a Superior Court Judge salary in perpetuity?)

County Counsel Contract

But, according to public records, for fiscal year July 1, 2014 to June 30, 2015,

 Bob Burns was paid

 $144,522.99 salary + 38,034.87 in benefits

As of July 1, 2015, a Superior Court Judge's salary changed to $189,041

As of July 1, 2015, Bob Burns salary

should have changed

to just $132,328.70

Then why was he paid $144, 522.99 ?

... because he knows nobody will check ...

The 2015/2016 Lassen County Budget does not include the $30,000 increase to the One Stop Resource Centers Budget in Herlong, Bieber and Westwood. The Supervisors needed that money for SOMETHING ELSE..............

WHAT........,

This money will be used for a ridiculous, obscene PAY RAISE FOR THE SUPERVISORS

On September 8, 2015, the Supervisors intend to pass an  payincrease for themselves

of $11,775 each (requires 4/5 approval)

The Supervisors want the public to think that they are getting the $35,485 dollars stated in the Lassen County Code (Title 2, Chapter 2.36.030)

According to Lassen County payroll records:

Bob Pyle & Jim Chapman are currently

receiving  a salary of

$40,534.83 and $17,928.61 in public benefits

DO THE MATH:   $58,463

This equates to $1,386 per meeting whether they attend them or not

(40 annual meetings)

....and now they want $65,238 annually ?

Lassen County 2015/2016 Budget

A

Bust

Kan We Help used Lassen County's 2007 Budget as a baseline to investigate why the Board of Supervisors annually claim they are broke. What we found was not surprising.  The Supervisors tuck millions away, each year,  in their Budget in barely used and basically innocuous accounts. [UN-NOTICED ACCOUNTS]. Kan We Help identified 45 accounts that are used and these phony expenses stay there year after year and are never used. The purpose: To create the illusion of a deficit.[Study used 2007-2014 Budgets]

The Lassen County Supervisors 2014/2015 Budget hid over $3,000,000 in their budget in accounts that were never going to be used.

The Independent Auditor disclosed their secret last year when they announced the County had a $4,000,000 surplus.

Kan We Help is now investigating the dozens of "Trust" accounts

that are never disclosed to the public

&

Kan We Help's LCPIC report will disclose gross lies & mis-handling of public funds

The annual Budget meetings (which are public meetings) concluded this week. These meetings are simply held to bully and intimidate County Department Heads.  CAO Richard Egan told Staff (not all attend the Wednesday meetings) that the County had a $318,000  deficit.

The Department Heads have succumbed to this intimidation for decades. It results in huge overtime expenses because of staffing that Supervisors have refused to allocate money for.

CAO Richard Egan had the audacity to ask DA Stacey Montgomery if she would accept a .8 employee instead of a 1.0 employee. Her Budget Request for an additional attorney and Investigator fell on the Deaf/Dumb ears of Supervisor Chapman and Pyle.

The County has more than enough money to accept

all of the Budget requests of all County Departments

The two Supervisors (Chapman & Pyle) made very inappropriate comments about the Assessor and said that if you are not here you lose. They kidded about not giving the Assessor the Appraiser that is badly needed (Re: Williamson  Act Abuses & Compliance against the ranchers)

Supervisor Chapman was against free food for the poor and wanted to give the One Stop in Herlong more money and said the Bieber and Westwood One Stops should raise their own money. Chapman resented the annual dinner the One Stop provides and said it should be a "POT LUCK". Chapman was concerned that the County doesn't even know "how" the annually allocated budget ($10,000) was spent.

.....and yet the Supervisors tell the Chamber of Commerce....HOW MUCH DO YOU NEED AND WRITE THE CHECKS WITHOUT ANY ACCOUNTABILITY (the donations to  this private political company are absorbed in the General Fund).

Why: The Chamber of Commerce represents VOTES

The poor in Lassen County...............?

AND YES, ITS TRUE

SOMEONE TOLD

After Chapman was allowed to go on and on describing graphically raw sewage that came up in the streets of Susanville, he then proceeded on a table pounding, fist waving tirade against Eileen Spencer for defending the poor. (video available)

EVEN THOUGH THE AUDIENCE GAVE THEM ALL A ROUND OF APPLAUSE, NOT ONE SUPERVISOR ACKNOWLEDGED THESE FOUR WOMEN, NOT ONE EVEN  APPLAUDED.

NOTE:   CHAIRMAN BOB PYLE RUDELY ATTEMPTED TO CURTAIL ANY PRESENTATION FOR THE ANIMAL CONTROL STAFF and after the Animal Control Staff left the room Bob Pyle had only one question: How much does it cost for staff to euthanize?  [NOTE: The County used to pay his brother to kill the animals]

Staff Disrespected- video of Supervisors

Lassen Animal Rescue presented a "Certificate of Appreciation" and bouquets to each of the Animal Control Staff

LCAC Supervisor Pete Heimbeigner never even introduced the shelter staff and took the credit for it's successes. Mr. Heimbeigner told the Supervisors that licensing dogs has made the difference.  The Staff sat behind him at the meeting and was never introduced or called on to tell the real story of the "successes"

Public Works Director Larry Millar, in a letter to the Supervisors, was the only one to acknowledge that the difference was due to the shelter staff and their hard work

Lassen County Animal Control Staff

L to R: Jaime Proia, Lauri Rondi, Donna Hastie, Sue Bonham (absent: Alison Pettus)

They are heroes.

They save animals everyday of the week and do not EVER get the credit for their dedication and commitment for  finding homes for the discarded "pets" in Lassen County that would normally be euthanized.

Five years ago the "County Pound" was killing two dozen adoptable dogs a week, almost every dog that came into the "Pound". No attempt was made to find homes.  Now, the euthanasia rate is less than 10% and these are done because of a court order or due to illness.

In 2014, 690 dogs came through LCAC,  242 dogs were privately transported to No-Kill rescues. 89 were adopted and 269 were returned to their owners.

This success can only be attributed to the four individuals above and we all thank them

If you "smell" something, say something

This sign should be hanging over the entrance to the Lassen County Supervisors Board Room

The Lassen County Board of Supervisors Consent Calendar Agenda is reserved for routine items of business. CAO Richard Egan placed a "Rental Agreement" in the Consent Calendar that would rent the historic upstairs courtroom to a private attorney.  This courtroom is coincidentally next to the District Attorney's office. Richard Egan claimed, at the Board Meeting, yesterday that Mr. Chittock would be using it after hours.  The Treasurer, Assessor, Elections and Recorders offices are also in this building. There is no security in this building.

Eugene Chittock has been convicted of Domestic Violence and filed a Harassment lawsuit against Bob Burns

[Vexatious litigant ?]

Kan We Help suggested that if Mr. Chittock needs additional space that he could rent the empty house next to his office building or rent one of the many many empty buildings in Susanville.  Judge Sokol's ground floor courtroom is vacant and is not connected to any other County offices

Supervisor Albaugh questioned the logic in renting the courtroom to Mr. Chittock.  CAO Egan only then revealed that it was only for one day. Chairperson Bob Pyle asked for a motion and the other four supervisors were silent. After an awkward pause Supervisor Hammond made a motion to approve and then there was no "Second to his Motion". After another awkward moment Supervisor Hemphill seconded Hammond's motion to approve Chittock's Rental Agreement. The Courtroom is now available to the public...........

The vote was unanimous to allow a private attorney access to the County offices after hours.

The Ugly Reality of Lassen County Politics

HSP Resources (aka Hayes, Smith, Pezzullo) were promised the Amedee Airfield and didn't get it. The Amedee Parcels RFP was "rigged" from day one.

The Army holds a 50 year lease for the Airport with Lassen County. If the County sells the leased property (which they attempted to do), the new owners (HSP) would now own the Airfield.

This attempt failed and Pezzullo wants someone to pay ?

BELOW: The Lassen County Supervisors included the East end of the airfield in the RFP hoping no one would notice

KAN WE HELP NOTICED

The Board of Supervisors fully intended to include the Army's Airfield, but the Lassen County Assessor and Surveyor didn't succumb to the bullying and are now paying the price.

The Assessor split up APN 133-080-60-11 so that the east end of the airstrip had its own parcel number, 133-080-64.

Pezzullo DID NOT GET THE AIRFIELD HE WAS PROMISED

CORRUPTION HAS IT'S OWN PRICE

Supervisor Tom Hammond was fined $2500 for voting to give HSP the township of Herlong when he knew he couldn't vote on the issue (conflict of interest with his Deli)  and then turned around and voted to give HSP an additional 3500 acres of public land for $25,000

Hammond is driving a new Lexus.

Julie Bustamante

JUST REALLY BAD AT HER JOB

The County Clerk serves as the Election Officer for Lassen County and determines whether or not a person can run for an elected position. It is her job to qualify a persons eligibility to run whether it is for a Special District or a County wide position.

Ms. Bustamante allowed Supervisor Larry Wosick to live outside his District for the last year of his term.

She has committed perjury herself by not disclosing interest in real property on her FPPC form for over 7 years and allowed others to do the same.

Judge Verderosa was no where to be seen.  Stephen Bradbury appeared at the bench to the surprise of "everyone", including the Bailiff who told visitors that Judge Verderosa would be presiding over the hearing.

No reason was given for the substitution but Bradbury ruled that there was sufficient cause to hold William Romero for the murder of Angel Siler in 2011.

Prosecutor Dan Howe, at no point appeared interested or competent at the hearing.

Howe either has no skills to prosecute a murder trial or he has been distracted by the enormous responsibility of his new appointment as "Hearing Officer". Bob Burns just gave Howe a $5,000 contract to act, when or if, a marijuana dispute arises.  The $ 5,000 appeared to have the perception of a bribe. A bribe to sabotage the Romero trial perhaps. LMUD fired Frank Cady  when it became evident that Cady's activity could no longer be tolerated.  Frank Cady placed "FOR INFORMATION ONLY" after each Lassen Municipal Utility District's Agenda items and told the public that they could not comment on these items.  Kan We Help challenged this change because it was illegal and convinced the LMUD Board to  cancel this policy.

LASSEN COUNTY RULES AND PROCEDURES

Frank Cady's BFF, Bob Burns is moving in that direction when he told the Lassen County Supervisors that this is THEIR MEETING AND NOT THE PUBLIC'S. Burns suggests not letting the public comment on certain Agenda items (illegal).

Burns told the Board of Supervisors that the public should not be allowed to comment on approving the Agenda or past Minutes.

Burns told the Board that the public should not be able to pull "Consent Calendar" Agenda items, even though the Board's procedures allow this.  The Consent Calendar is supposed be used for routine business but this Board every week abuses this and places inappropriate items to be approved without discussion by ONE SWEEPING VOTE.

Burns told the County Clerk not to release LCPIC public records to Kan We Help but later changed his mind when Kan We Help threatened to file a Writ of Mandate. Burns only released a portion of the Lassen County Public Improvement Corporation documents. CAO Richard Egan has been paying this shell corporations annual fees from the Chamber of Commerce's account for years without consent from the Supervisors.

City of Susanville Fails to Get the $1.1 Million Dollar Grant for

Construction of the

Honey Lake Valley Recreation Authority Pool

Lassen County Supervisors and the only incorporated city in the County, Susanville, formed a Joint Powers Authority in 2013 to build a community pool.

The HLVRA moved forward today and  approved a Request For Proposal (RFP) to find a developer or contractor to build the pool even though there are no funds yet.

The two public entities have each been contributing $200,000 a year to the HLVRA  towards the construction costs.

Funds have been used to demolish the old pool

Bribery Comes In Different Flavors

Burns: He can't be a judge. He can't be District Attorney

He thinks he is a Lassen County Supervisor or maybe the future CAO?

In 2011, Bob Burns was the District Attorney when 23 year old Angel Siler was raped and murdered.

BURNS DID NOTHING TO INVESTIGATE THIS CRIME THEN AND NOW HE THINKS HE CAN INFLUENCE THE ATTORNEY THAT HAS BEEN ASSIGNED TO THIS SUSANVILLE CAPITAL MURDER CASE..........DAN HOWE

Burns thought up this scheme to suddenly give his friend, DAN HOWE, a new $5,000 contract and no one would notice.

CAO refused to disclose how he was going

to pay for this

DAN HOWE WORKS

FOR

DISTRICT ATTORNEY STACEY MONTGOMERY.

WILL THIS

$5,000

HELP HOWE FOCUS ON THIS CAPITAL MURDER CASE?

WILL DAN HOW ACCEPT THIS BRIBE?

William Joaquin Romero

Turned Down Plea Deal on June 11

and

Will Face a Murder Charge

for the

2011 Rape and Death of 23 year old

Angel Siler

Romero was offered six years in prison, by Deputy District Attorney Dan Howe,  if he plead guilty to the lesser charge of "Kill without Malice", and Romero turned it down

Judge Verderosa asked Romero if he understood that the penalty for murder could be life in prison. Romero responded that he understood.

KAN  WE HELP BROUGHT THE ARCHANGELS OF JUSTICE TO SUSANVILLE

to investigate this 2011 rape/murder

AND

THEN, AND only THEN  WAS ROMERO ARRESTED

In 2011, Bob Burns was Lassen County's District Attorney when this rape/murder occurred and he made the decision to ignore the evidence and pleas from Angel Siler's family to investigate this rape/murder.

IGNORED AS IN......DISMISSED HER DEATH AS INSIGNIFICANT AND NOT WORTH INVESTIGATNG

Now, Bob Burns (Lassen County Counsel)  wants to distract the prosecutor Dan Howe, from this MURDER TRIAL,  by assigning more "duties" or is this  just a bribe to look the other way ??

Isn't this a call that should be made by the current DISTRICT ATTORNEY?

Burns wants the Board of Supervisors to hire Dan Howe as the "Hearing Officer" for  marijuana cases.

Mr. Burns wants to pay Dan Howe

 a bonus of $5,000.

That's politics in Lassen County

Burns has placed this issue as the last item (Agenda item H-5) on the last page of the Board of Supervisors June 16, 2015 meeting Agenda.

[Typically, this type of work, is contracted out to attorney Andrew Haut]

Integrity is important to Supervisor Albaugh

At the June 9, 2015 Lassen County Board of Supervisors meeting, District 4 Supervisor Albaugh castigated Supervisor Hammond for putting his own integrity at stake when Hammond secretly met with Steve Pezzullo, Larry Smith and Aric Manner (Sierra Army Depot Chief of Staff) during a public bidding process.

BELOW:

WHAT THE LASSEN COUNTY BOARD KNEW

ABOUT THE

LASSEN COUNTY PUBLIC IMPROVEMENT CORPORATION's HISTORY

but

 didn't disclose to the public

They put on a really good show for the public

August 7, 2001 LCPIC Minutes

Richard Egan:  "The corporation can also borrow funds without approval of the voters"

Richard Egan was the Lassen County Treasurer from 1999-2014 & had full knowledge of the 17 year old LCPIC

(the following has been confirmed by public documents)

The original shell corporation Ameri-Civic Improvement Corporation was created in 1989

The Lendors changed three times under the ACCIP

The LCPIC was created because Lassen County's former shell corporation Ameri-Cal Civic Improvement Corporation  was dissolved on November 2, 1992

Lassen County went six years without a shell corporation to handle their $6,030,000 debt

The LCPIC assumed a $6,030,000 debt when it was formed in 1998

The original COP in 1989 was $6,675,000. The County paid only $645,000 in 9 years.

HOW DID THEY PAY FOR THIS IF IT WAS NEVER PUT ON AN AGENDA

The cost of the new $4,080,000 debt will be in excess of $2,000,000

THE LCPIC HAS NOT MET FOR ITS ANNUAL MEETINGS SINCE 2008

The LCPIC is not a NON-PROFIT as stated by Richard Egan

The Lassen County Public Improvement Corporation has never appeared on ANY BOARD OF SUPERVISORS AGENDA prior to May 26, 2015

Richard Egan secretly paid delinquent LCPIC fees and penalties without authorization

Richard Egan failed to file Form 100 with the Franchise Tax Board and in 2011 Lassen County received a NOTICE OF SUSPENSION of the LCPIC

Richard Egan failed to file timely ANNUAL MANAGEMENT REPORTS to the Lendors from 2000-2005

The Lassen County Supervisors and CAO presented this proposal to finance the District Attorney's (BLM building) new offices as a new and innovative idea of financing when........

Bob Pyle and Richard Egan have been involved with this secret debt process since 1998

A SLUSH FUND

1989-2015

Bob Pyle was President of this slush fund in 2001, 2006, 2010, 2015

Larry Wosick was President of this slush fund in 2014 and still is according to the Secretary of State

Jim Chapman was President of this slush fund in 1999, 2003, 2011

Brian Dahle was President of this slush fund in 1998, 2007, 2012

Richard Egan was Treasurer of this slush fund from 1998-2013

Richard Egan was Vice-President of this slush fund from 2014-2015

Julie Bustamante was Secretary of this slush fund from 2007-2015

On May 26, 2015, former Supervisor Everd McCain came to the Board of Supervisors to object to this loan.

Supervisor McCain was kept in the dark about this secret slush fund

Lassen County Supervisors Pyle and Chapman's

DECEPTION FIRST AND THEN MORE LIES

The Lassen County Public Improvement Corporation was created in 1998 because the County's previous "public benefit"  Ameri-Cal Civic ImprovementCorporation was terminated (C1579332).

The newly formed LCPIC then used the States Superior Courthouse & Annex, Roosevelt property and the County Administration Building (Roop Street)

as collateral to refinance the County's $6,030,000 debt.

The constant with these Shellslush Corporations are

Richard Egan,

Bob Pyle and Jim Chapman

Public Records disclosed that the LCPIC was in "non-compliance" with the Lender from 2000-2005. The LCPIC failed to submit audited financial statements.

THE CLAIMS THAT LASSEN COUNTY

HAS BEEN

Pezzullo will not get East end of the Amedee Airfield

Kan We Help objected when the Lassen County Supervisors included the east end of the Amedee Airstrip in Parcel 133-080-60 for sale in the RFP.

The Supervisors had every intention of giving

Pezzullo part of the Army's airstrip

CAO Richard Egan told Kan We Help, at a BOS meeting,  to "ignore the parcel numbers. Assessor parcel numbers are not important"

Kan We Help alerted the Assessor that the Supervisors were pulling another "One Stop".

The Assessor split up APN 133-080-60 so that the east end of the airstrip had its own parcel number, 133-080-64

Kan We Help requested the Agendas, Minutes and annual corporation reports filed with the Franchise Tax Board and/or the IRS.  On May 29, 2015, the County Clerk was advised by County Counsel not to let KWH inspect these documents.

Bob Burns delay was intentional. They could not release these documents until after the $4 million was transferred. It was transferred on June 4, 2015 to an account that does not exist

The County Clerk claimed later, after Kan We Help threatened to file a Writ of Mandate, she had to find all of the documents requested.

Bustamante had the "green" binder at the May 26, 2015 LCPIC meeting and could have complied with Kan We Help's Public Records Request on May 29, 2015

Bustamante turned the "green" binder over for inspection today.

Bustamante also released the annual regular corporation "Franchise Tax Form 100's "  & copies of the letters from the State of California regarding late fees, penalties, etc.

Deliquent $13,147.31 on her BLM Building Property Taxes

Cherie Gullerud, owner of 2950 Riverside Drive, Susanville (vacated BLM Building) has history of delinquent Lassen County property taxes.

Gullerod is currently delinquent $13,174.31 on the property Lassen County CAO Richard Egan has been trying to purchase for Lassen County. The delinquent taxes have never been mentioned at any public meeting. She also paid a penalty on her tax bill in 2014 but has paid the December 10, 2014 taxes.

Will the taxpayers have to eat these back taxes in the "deal" Egan is putting together?

Lassen County Public Improvement Corporation

?BOGUS AND BUSTED?

A Ukiah resident, Tony Shaw, was hired to put this $4 million dollar loan together. The Board of Supervisors hired the Government Financial Strategies Inc. and GFS, Inc. based their vetting of the LCPIC to receive millions on Bond Counsel (Meyers-Nave). .....great checks and balances ?

Lassen County Counsel Bob Burns has blocked any disclosures on the LCPIC that was formed in 1998.  He advised the County Clerk not to release mandatory State annual reports, Agendas and Minutes. All are public documents.

All corporations in California are required to comply with the changing corporate laws. LCPIC is no exception, even though the GFS, Inc. was told by Bond Counsel that the LCPIC does not have to comply.

BOTTOM LINE:

Is the LCPIC  really defunct and is being resurrected?

Will most or all of the 4 million be used on the DA's new building?

Will Chapman's new board room continue to be paid from unfunded budget accounts?

Will the HLVRA go out-of-business because the County spent the promised million dollars?

Will the Supervisors continue

to

coerce and intimidate staff

to hide the truth?

Anyone want to guess why Egan lied?

RESULTS: In two years, no improvements in Herlong. Just t a l k.....

Pezzullo's HSP Resources, Inc. [formed immediately for the purchase of the Township of Herlong] has done NOTHING except complain about paying property taxes.

Thanks to Supervisor Hammond, for $36,900,  they own the 4,000 acres of the public land that surrounds the Sierra Army Depot

...and he gets a "NO COMPETITION" promise?

Supervisors Hammond, Pyle and Hemphill are attempting to include the east-end of Amedee Airfield in the sale to HSP Resources. This parcel intentionally was never given an APN number so that it would be included in the sale.

Notice that parcel 133-080-60-11 wraps around and includes the east-end airfield strip.

THIS WAS NOT AN ACCIDENT, BUT AN INTENTIONAL ACT TO INCLUDE A PORTION OF THE AIRFIELD IN THE SALE TO PEZZULLO AND COMPANY

Lassen County has a 50 year lease with the Army for the entire Amedee Airfield.

HOW TO INTIMIDATE THE ASSESSOR?

If the County (Pezzullo) forces the Assessor not to assign an APN number to the airstrip in the "Legal Description" HSP

will own a portion of the Airfield that the planes take off from. If HSP owns it Lassen County's Lease must then be transferred to HSP Resources.

VIDEO: The 2/17/15 statement followed by the 5/19/15 statement

1. The Amedee Parcels RFP was issued on 9/23/14

2. The public bidding process was from 9/23/14 to 2/17/15

3.On 12/11/14,  HSP Resources stated in their bid that they were in negotiations with the Sierra Army Depot

4. Chief of Staff of the Sierra Army Depot (Aric Manner) stated on 1/6/15 he did not know anyone from HSP Resources

5. On 2/17/15, Supervisor Hammond admits he met secretly three (3) times with HSP Resources & Sierra Army Depot Chief of Staff Aric Manner

6. On May 19, 2015, Supervisor Hammond admits that on 1/14/15 and 2/11/15 he met with HSP Resources and Sierra Army Depot Chief of Staff Aric Manner for "tours" of the Depot. Supervisor Hammond did not disclose the date any third meeting?

On 2/17/15, Supervisor Hammond was the deciding vote to give HSP Resources 3400 acres of public land for $25,000.

On October 8, 2013  Hammond voted to give HSP Resources the township of Herlong (over 400 acres for $31,900)

Supervisor Hammond was fined $2500 by the FPPC for this vote. Hammond owns two businesses in Herlong; a deli/gas station and a market/gas station in Herlong.

Did Tom Hammond's vote insure that he would be the only business to sell food and gasoline in Herlong?

Lassen County Flim Flam Plan

Similar to

Frank Cady's million dollar loan

from Plumas Bank

While Frank Cady was LMUD's GM/Attorney he ran the Susanville golf course and was  allowed to use the City of Susanville's golf course as collateral for a $1 million dollar personal loan. When Cady defaulted the City of Susanville had to pay off Cady's loan. No one asked Cady where the money was?? Plumas Bank didn't ask where the money was. The City of Susanville's City Attorney represented Frank Cady.............

The Lassen County Supervisors are using Frank Cady's Meyers-Nave law firm to put a similar deal together. If it worked once, why not do it again?

This alleged agreement is half ass backward

and suspect as to intent.

Meyers-Nave refer to the "Riverside Building" and "Lassen County Courthouse" as though they are the property of Lassen County.

The deception is quite intentional.

Lassen County BOS May 26, 2015 Agenda Item D-1

If the BLM building [on Riverside Drive] is connected to Steve Pezzullo, will the price be inflated or doubled? If the price is doubled and CAO Richard Egan is authorized to pay $2-2.5 million for the BLM building what money is left of the $4.1 million? They will need $1 million for renovations.

The BLM building is being purchased for the new District Attorney and related departments.   The District Attorney is presently housed upstairs at the old courthouse building vacated by the State of California when they built the Lassen County Courthouse on Riverside Drive in Susanville.

There will be no money left for improvements at the old courthouse on Lassen Avenue in Susanville after the BLM purchase and renovations and the gift of ???? dollars to the HLVRA. There will barely be enough to give to the Honey Lake Valley Recreational Authority for the construction of their community pool project.  The HLVRA was relying on the Tobacco Settlement annual contributions to pay for the $400,000 anticipated maintenance cost.  With this new scheme, all of the Tobacco Settlement money will go to the Lassen County Public Improvement Corporation FOR " RENT?.

    watch the money..............

*Richard Egan authorized a $20,000 contract to Skip Jones to renovate the County Clerk's office because he knew there would be no money left after this deal goes through to renovate county offices. *

Mr. Egan knew there were no dollars budgeted for this expense and approved the work anyway.. County Clerk Julie Bustamante even took the leather chairs that Judge Sokol had in his office....for her office.

Lassen County CAO Richard Egan

Proposes Using a 1998 Shell Corporation

to Borrow $4 million dollars

On June 26, 1998, Lassen County created the shell corporation

LASSEN COUNTY PUBLIC IMPROVEMENT CORPORATION

The concept, in 1998,  was to have this shell corporation borrow money to build the new Jail. This "shell" corporation does not have any assets to borrow a dollar?

In 2000, Lassen County obtained a $2,000,000 State Grant to build the Juvenile Hall at 1415 Chestnut in Susanville, CA and continues to receive State dollars to operate the Juvenile Hall.

Lloyd Keefer is shown here cutting the ribbon opening Juvenile Hall in October of 2007

CAO Richard Egan and Supervisor Bob Pyle intend to use Juvenile Hall as collateral for the shell corporations $4 million dollar loan .

PRETTY SLICK GUYS BUT THERE ARE A FEW PROBLEMS

Lassen County built the Juvenile Hall with restricted funds.

Lassen County owns Juvenile Hall & intends to use this property as collateral for exactly what.....a phony lease agreement?

The shell corporation (LCPIC) has no assets

Where are the financial statements for LCPIC?

How did the current alleged "Directors" suddenly get appointed?

THE SHELL GAME

FOR THE SHELL CORPORATION

LCPIC intends to "lease" the "Riverside building" (?whatever that means?) and the "Lassen County Courthouse (owned by the State)" from Lassen County by giving Lassen County the proceeds from the $4 million dollar loan from TPB Investments, Inc.(formed in 2011)

and then

Lassen County rents these ??properties back from the LCPIC.Lassen County will agree to PREPAY  the rent one year in advance so  the LCPIC can make the annual loan payments (the documents state that the County can pay these "rental" payments"  from "any source", but the Tobacco Settlement fund is specifically mentioned as the source. The County may want to rent only to Departments that are being subsidized by State or Federal money. Legally the County can draw rents from these accounts)

WHAT IS DISTURBING IS THAT THESE AGREEMENTS UNDER NO CIRCUMSTANCE OBLIGATES THE COUNTY OR THE LCPIC

ON HOW THEY MUST SPEND

THE $4 MILLION

Lassen County cannot make this lease/rental agreement for the community pool. The HLVRA owns the pool

Lassen County does not own any building on Riverside

Lassen County does not own the "Lassen County Courthouse"

Ooops............

FPPC PENALTY $2500

Kan We Help filed a Political Reform Act violation, with the FPPC, after Lassen County District 5 Supervisor Tom Hammond refused to recuse himself from the vote on October 8, 2013.This vote gave Steve Pezzullo 400 acres of land (the township of Herlong) and was the first step to assure that Supervisor Hammond would be the only business to sell groceries, food or gas in Herlong.

The FPPC determined that Supervisor Hammond's vote was a "CONFLICT OF INTEREST" because he owned two businesses in Herlong which would financially be effected by his vote

Watch the arrogance of this elected official

...and then read how the County Clerk hides Kan We Help's Public Comment in the Minutes

Kan We Help asked Supervisor Hammond to recuse  himself again on February 17, 2015 from the vote when he admitted meeting secretly with Steve Pezzullo [the same buyer for the October 8, 2013 vote] after Pezzullo submitted a bid for more public property in Herlong. Supervisor Hammond's vote was the deciding vote to give Steve Pezzullo an additional 3400 acres of public land in Herlong, California.

Supervisor Hammond secretly helps Pezzullo during public bid and then voted to give more public land to Pezzullo

PRESS RELEASE

Archangels of Justice

In September 2011, Angel Siler was found near death by Susanville Police Department and Fire personnel. The medics reacted with professionalism and respect, rushing Angel to the hospital. The Susanville Police were another matter, the obvious lack  of professionalism and courtesy is very evident in the responding officers behavior. He did not call for a detective or crime scene technician. Nor did he even consider the possibility that Angel Siler could have been forcibly drugged and raped.

Her nude body with bruises was clearly evident and the Susanville Police Officer took no action. This beautiful young woman alone, nude, incapable of speaking and surrounded by 3 men, the buffoon of a police officer did nothing to investigate.

Angel was buried after a brave unsuccessful fight for her life several days later, with the evidence of what happened to her in that dark shack on 2nd Street, in Susanville, minutes from the Susanville Police Station.

Now 5 years later the Susanville Police Department's knee jerk reaction is to arrest one of the men in hopes of keeping the Archangels of Justice away. We had the medical reports, statements and photos of Angels bruises. All of her bruises are consistent with being forcibly held down. The case was simple 5 years ago, but no one in law enforcement cared and apparently neither did the District Attorney Robert Burns

Now they clamor to arrest, make a media splash and cite how complex a case it is. Once again the propaganda spews forth. The Susanville Police Department in this county today are very well aware of proper protocol, and the possibility of rape during drug use. There is no excuse for their past shoddy police work. There is less of an excuse for the Chief of Police to try to cover it up. If he had any guts or integrity he would push for charges against the Officer for neglect and dereliction of duty.

 about Angel Siler's murder

Kan We Help brought the Archangels of Justice, Ira Robins and Sal Rastrelli to  Lassen County to find out why the

Susanville Police Department and District Attorney Robert Burns

did not investigate the three men that were connected to Angel Siler's death in September of 2011.

After, the Susanville Police Department found out that the Archangels of Justice were coming they arrested one of the men connected to the murder of Angel Siler, on May 8, 2015

Wrong Board Members

 for Pool Project

No interest

No progress

No funding

After a year and half, this Joint Powers Authority is just holding one meeting after another that produces nothing.  They don't care if meeting notices are published. They don't seem to care that no one attends the meetings anymore. They don't seem to care if the Minutes are correct of past meetings.  There is no interest, no progress, no funding.

It will take another year before they even have plans drawn up and find funding to build

This Board has ZERO knowledge, experience or  interest in building the pool.

This is the design that the Board chose:

The footprint of this project basically takes up the entire lot and Supervisor Chapman wants more discussion on where to place the pool? Chapman's lack of knowledge and ego has cost this project a year of progress

Should the public trust

what the Lassen County Supervisors

say

or

what they do?

One Stop Center in Herlong

A County owned building that was maintained with state and federal dollars was intentionally given away.    Today, there is still not a single piece of paper that stated the Supervisors wanted to keep this building and yet the Supervisors continue to tell the public that it was a "mistake".  The Pezzullo group gave the property back after realizing that they would have to spend hundreds of thousands in ADA improvements in order to sell the building.

One Stop Center in Bieber

A 2009 Lassen County capital improvement project that is yet to be built even though the States $788,000 still sits in the bank to expand this facility. This project had no fiscal impact on the General Fund. This CIP was funded through the Mental Health Services Act. THE SUPERVISORS HAVE DONE NOTHING

Amedee Airport Runway

County Supervisors intentionally included, in the sale to Pezzullo, the East End of the Airfield but the County Assessor will assign Parcel Numbers to the Airfield so that it cannot be included in the sale to Pezzullo

The price of doing this may cost the County an Assessor and a Surveyor

With every breath in their bodies, the Lassen County Supervisors stated that they were not going to sell the Amedee Army Airport and then attempted to include the east end of the runway in the sale to the Pezzullo group. The Army has a 50 year lease on the airfield after transferring it to Lassen County in 2003.

Lassen County CAO Richard Egan  hesitant and rambling

about "the use" of the $4,000,000 loan

Supervisors year after year have had the "cash" to finish capital projects but have failed year after year on promises to County Departments

Decaying Jail Building

Decaying Health and Human Services buildings

Decaying Cemeteries

Decaying infrastructures in the County

Decaying Animal Control Shelter

Supervisors have yet to take a VOTE on borrowing $4,000,000

They must first look at the "Surplus" each year in the Budget and start looking at finishing projects

that effect the everyday lives of the citizens of Lassen County.

LASSEN COUNTY SUPERVISORS

DEMONSTRATED PERFORMANCE

Stupid is as stupid does

2014/2015 PROJECTED BUDGET BALANCE

ON JUNE 30, 2015

$19,250,955

Supervisors are spending $90,000 for advice

on borrowing $4,000,000 for 30 years

.....and spend it on the following:

$1.7 million for the BLM building they allegedly want to buy (overpriced by a local CPA's relative)

$1 million for allegedly remodeling the old Courthouse/Annex (Chapman wants new Boardroom)

$1.1 million allegedly for a pool they don't own (COP's require ownership of collateral)

Look at what the Supervisors have budgeted to spend with $1,974,973 they already have in the bank:

FUND 119 Accumulative Capital Outlay     $1,220,217

FUND 126 Criminal Justice Facility    $276,256 ($25,000 to repair exterior of old courthouse)

FUND 127 Courthouse Remodel  $0

FUND 150 Capital Projects  $478,500

The Supervisors reduced the County's accumulative capital outlay (Fund 119) list from 8 pages to 2 pages, claiming that they "prioritized" projects.

This is money they spend to maintain long term assets.

ON THIS LIST:

Adult Detention Facility  $ 500,000

Bieber Veterans Building $100,000

Susanville Veterans Building  $ 400,000

Old Courthouse $1,500,000

County Administration building  $400,000

Mental Health building  $50,000

County Cemeteries $ 325,000

BLM building  $1,800,000

The $1.1 million dollars for the HLVRA pool is not on this list because the County does not own the property. The Supervisors know they cannot take on debt for something they do not own. But, the Supervisors could just write a check for the pool construction

Lassen County Has No Capital Improvement Plan

No Money Budgeted for Remodeling the Old Courthouse, and County Clerk spends $20,000 to remodel her office in the Old Courthouse

Richard Egan, instructed Public Works to sign the contract, for this work, on March 3, 2015......

There is no budget for this work Mr. Egan ?

Kan We Help watches the spending and this Board allows spending from other accounts whenever they feel like it

A $4 million dollar County debt in the hands of this Board will be mis-handled, mis-directed and wasted on "pet projects" of the Supervisors..... just like the free money this County has received from the state and federal grant programs before (Herlong One Stop, Medici Logging CDBG loan, etc, etc, etc.)

Where is the money for the Sheriff's Department's upgrades , Health & Human Services new building, ADA requirements for Herlong's Fort Sage "One Stop" (HSP just dumped the building back to the County because they didn't want to spend the hundreds of thousands on the ADA improvements that were required before they could sell it)

......AND YET THEY ALLOW THE COUNTY CLERK

TO REMODEL HER OFFICE,

IN THE OLD COURTHOUSE,

 BY KNOCKING DOWN WALLS

County Clerk Bustamante's renovation includes Bob Burns old office.

This same County Clerk received approval  from the Board to purchase a $27,000 software package (INSTALLED OVER A YEAR AFTER PURCHASE

and then spent $40,000 without going back to the Board

DIFFERENT RULES FOR THIS COUNTY CLERK MAYBE?

Why do other Departments have to follow the rules ?

and that Lassen County owned the property for the new swimming pool

Is Lassen County Just Dishonest to the Core?

YES

Do They Even "Know How" To Tell The Truth?

ANSWER:  NO

Literally for months, Kan We Help has been demanding that the $350,000 bad loan to Medici Logging be placed on the Boards Agenda.  CAO Richard Egan and County Counsel Bob Burns refused to place the December 8, 2014 Medici Logging Bankruptcy on the BOS Agenda,  claiming there was nothing to tell the public.

CAO Richard Egan places the Medici Logging bankruptcy on the April 21, 2015 Agenda

The Medici Logging loan was approved on March 24, 2014 and Medici closed their doors in November of 2014 after making only 3 payments to Lassen County. This action puts Lassen County in the position of having to  pay back $350,000 to the State of California.

Lassen County Grant Manager, Jenna Aquilerra, told the Board of Supervisors that any time Medici Logging did not maintain the "Public Benefit" requirement, Lassen County would be at risk of returning the $350,000 CDBG money to the State. 3/24/14 video

The $12,657 Superior California Economic Development

 Credit Analysis

included the information that Medici Logging had a $1,000,000 loan outstanding with Bank of Commerce. According to the author of this Credit "analysis" (3/20/15) the Lassen County Supervisors all knew about the Bank of Commerce loan.

On 4/21/2015, Richard Egan announced that he fired Bob Nash from Superior California Economic Development company

SCED's Credit Analysis below:

Kan We Help has exposed the real reason behind just another back room deal

Kan We Help spoke with the Bankruptcy Trustee, John Reger. Mr. Reger confirmed that the Auction the Court ordered of the estimated 75 DMV registered vehicles owned by Medici Logging Incorporated brought only $211,000 back to the Court. Mr. Reger told Kan We Help that all of this money will go directly to the Creditors.

The $19,000 Lassen County back taxes [owed by Medici]  will be paid from the net amount of the auction held on April 2, 2015 by "West Auction".

Bank of Commerce filed their UCC form on May 16, 2012 for 100% of the secured Medici equipment & inventory, according to "Lead Attorney for Bank of Commerce" Andrew Reisinger. This puts the Bank of Commerce in first position to the equipment & inventory.

LASSEN COUNTY HOLDS NO POSITION ON ANY MEDICI INVENTORY OR EQUIPMENT, ACCORDING TO PUBLIC DOCUMENTS ACQUIRED BY KAN WE HELP

Egan somehow confiscated 3 pieces

of Bank of Commerce "secured" property.

Egan claims he can get up to $100,000 for these three pieces at an auction he is setting up this week ?

Lassen County Hires

Government Financial Strategies, Inc.

...but was not exactly honest

 with their intent.....

Lori Raineri, of GFS, Inc., presented a borrowing  "plan"

at the Board of Supervisors meeting on April 21, 2015

Lassen County is a "debt free" County and has had a comfortable $4,000,000 surplus for several years now. Deputy CAO Tony Shaw [a Ukiah resident] brought a contract to the Board of Supervisors to find a revenue source for the construction costs of a community pool, remodel the old Courthouse (a Jim Chapman pet project) and to purchase the recently vacated BLM building in Susanville.

BIG PROBLEMS

1. The Supervisors want to "lease"and remodel the BLM building from a local CPA's relative

2. The County gave away the property the pool is on so it cannot be financed through a COP. CAO Richard Egan has stated many times that the swimming pool is not on the Capital Improvement Plan because it is not owned by the County.

When Kan We Help told Ms. Raineri the County does not own the pool, she suggested putting the Jail up for collateral. She said that the County would not default on this loan because they needed the Jail.

3. THERE IS NO CAPITAL IMPROVEMENT PLAN

There is an 8 page maintenance list maintained by Public Works

CAO Egan

and

Deputy CAO Tony Shaw

may have wasted Ms. Raineri's time

Plumas County Supervisors

Hear

State of Jefferson's

"Seat at the table speech"

The Plumas County Supervisors placed the "State of Jefferson" issue on their April 14, 2015 Agenda for discussion only. The 37, in the audience, were split in the middle as far as the support for and against seceding from the State of California.

The Jefferson presentation was tailored for Plumas County, however Supervisor Lori Simpson had done her homework and she takes copious notes.  Mr. Baird was not prepared to answer Supervisor Simpson's challenges but said he would be happy to meet with her.

Lassen County Supervisor Chapman did his homework and had ripped the SOJ financials during the last presentation in Lassen County.

The financials presented to Plumas County had changed from the Lassen County presentation. SOJ's Mr. Baird now told the Plumas Supervisors that the new state would likely incur a half billion dollars in debt when they broke away from California. He also told Supervisor Simpson that the Counties would basically be on their own in the new state and reduced the new Jefferson State government to an as needed "consultant".  The new state would have no credit rating and would most likely have a Junk Bond status.

L to R: Steve Baird, Supervisor Lori Simpson, Supervisor Terry Swofford, Craig Settlemire, Supervisor Kevin Goss

What didn't sit well was the arrogant statement by Mr. Baird that Plumas County would not have a SEAT AT THE TABLE

if they did not sign their so-called Declaration.

Lassen County Declaration based on ballot approval

Plumas County Supervisor Simpson wanted to know WHERE THIS TABLE WAS

When this movement began 75 years ago, the plan was to take a couple of  the Southern Counties of Oregon and a couple of Northern California Counties and withdraw to the new Jefferson State.

The Lassen County Supervisors were told that 12 Counties were needed to petition California but Plumas County Supervisors were told that it would take 20 Counties and they did not need to be contiguous.  There are 58 Counties in California.

LASSEN COUNTY

"CULTURE OF CORRUPTION"

Corruption/Land Deals

The term "Good Ole Boy" system has been used to describe the male dominated government in Lassen County. However, a more appropriate term would be Lassen County's CULTURE OF CORRUPTION.

Old family names are predominant on ballots in Lassen County. Why not, they have lived in this county for years and have invested heavily in the political make up of Lassen County.

Should they dictate the culture of corruption, absolutely. Are they responsible then for the level of corruption in Lassen County, absolutely

WHEN KAN WE HELP FED THE SUPERVISORS THE TRUTH

A NEW RFP HAD TO BE RE-WRITTEN

April 10, 2015

Selling Amedee Airfield was always

Tom Hammond & Steve Pezzullo's Plan

There was more to recalling Jack Hanson that meets the eye

Tom Hammond took the Oath of Office on 9/24/13 and the Amedee Airfield RFP was placed on the Agenda to be released on 2/1/14

Anticipating the assurances from Supervisor Hammond, Richard Egan and Rheta Vander Ploeg, that the Amedee Airfield parcels would be given to HSP Resources, HSP purchased the land above ($450,000) the parcels so that they would control the Northern access to the Amedee Airfield.

Kan We Help has tracked the activity on this scam since before the first RFP was issued right up to the conclusion of the sixth RFP.

On April 7, 2015, Richard Egan and Bob Burns attested to the complete accuracy of the Bill of Sale to Larry Smith (aka HSP Resources, LLC)

[Steve Pezzullo bid on the township of Herlong and the Bill of Sale and Deed were issued to Pezzullo. HSP Resources bid on the recent Herlong parcels but the Deed was to be recorded in Larry Smiths name?]

VIDEO: click on photo

After Burns and Egan's assurances that all is well, Kan We Help exposed the fact that not only did the County spell "AMEDEE" incorrectly throughout the documents, inconsistent phrases but intended to sell the end of the Amedee airstrip to Hal Hays, Larry Smith and Steve Pezzullo (HSP Resources, LLC)

Lassen County Supervisors Well Planned

and Well Executed Deception

to Give Steve Pezzullo

a Piece of Amedee Army Airfield

VIDEO:    Watch the well rehearsed 4/7/15 BOS meeting

The Lassen County Supervisors, after orchestrated discussions, made a decision to keep three parcels of the surplus land around Honey Lake and the Army's Airstrip.

The first parcel was the LMUD/PSREC electrical substation, North West Corner of the Army's Airfield. APN 133-070-12

The second parcel, the Supervisors retained,  was the Pole Line Road and the most southwestern portion of the Army's Airfield Parcels. The Supervisors decided to maintain this road and the parcel leading into the land they sold to Steve Pezzullo. APN 137-150-08,10

The third parcel the Supervisors claimed they wanted to retain,

but the Supervisors intentionally

DID NOT GIVE IT AN ASSESSORS PARCEL NUMBER SO PEZZULLO COULD GET THE AIRFIELD.

This stinks like former County Counsel/Land Expert Vander Ploeg had a hand in another deceptive land deal

We all know what happened to CAO Marty Nichols and County Counsel Vander Ploeg with the "One Stop" "give away" in Herlong

The third parcel is the Amedee Army Airfield's east end landing strip. Lassen County owns the Airfield but part of the transfer agreement from the Army was that it would be leased back to the Army for 50 years with a 50 year extension if they want it.

If Lassen County sells any portion of this airfield, the new owner (HSP Resources) will be entitled to the Army's Lease being transferred also.

THAT IS EXACTLY WHAT

THE LASSEN COUNTY SUPERVISORS

ARE ATTEMPTING TO PULL OFF

"HERLONG ONE STOP......." DEJAVU

The Lassen County Supervisors voted to retain three parcels. Two were identified with APN numbers (APN 133-070-12 Electrical substation and APN 137-150-08,10- the Pole Line Road entrance) and clearly were excluded from the sale.

The third parcel (east end of the Amedee runway)

intentionally was not given an APN number

so that it could be quietly and deceitfully be included in the sale to Larry Smith.

APN 133-080-60 is one parcel

More............

On February 17, 2015, County Counsel Burns allows Supervisor Hammond to vote to approve awarding HSP Resources the Amedee Parcels after Hammond admitted to an obscene Conflict of Interest with HSP Resources.

Hammond's vote was the deciding vote to give HSP Resources the public land.

TOM HAMMOND WILL HAVE A FINANCIAL GAIN.

HE OWNS TWO BUSINESSES

IN DIRECT PROXIMITY OF THIS DEAL

On February 17, 2015, Hammond admitted publicly that he was secretly helping HSP Resources to obtain a contract with Sierra Army Depot during the public bidding of County land (Amedee Airfield Parcels)

CAN ANYONE, ANYWHERE SEE SUPERVISOR DAHLE

Lassen County Supervisors

Unethical and now Unprofessional

Supervisor Hammond refused to recuse himself on Vote

to spend

$48,000

for an Airport Use Plan for HSP Resources

[the Supervisors previously voted twice not to spend any money on Airport Use Plan]

Supervisor Hammond not only admitted on February 17, 2015, that he secretly met 3 times with HSP Resources in order

to secure a contract with Sierra Army Depot... so that HSP Resources, (Hal Hayes, Larry

Smith, Steve Pezzullo)  would have an  unfair advantage during a PUBLIC BID,

but

then voted to award 3,000 acres of public land to HSP for $25,000.

Today, Kan We Help asked Tom Hammond to recuse himself again from the vote to spend $48,000 of County dollars for an Airport Use Plan for the Amedee Parcels around the Amedee Army Airfield.  Supervisor Pyle is on the Airport Commission  and over years and years never ordered this mandatory plan and the County has owed this property since 2003.

THE URGENCY OF NOW?

Supervisor Hammond owns two businesses in Herlong that are directly effected by the Sierra Army Depot

UNETHICAL, UNPRECEDENTED

Lassen County Counsel Robert Burns told the Supervisors that they did not need to approve Meeting Minutes, and also that if you did not attend a meeting you could still vote to approve the accuracy

Burns:  You didn't even have to be an Elected Official ?????

In 2013, Kan We Help gave the Supervisors a long list of unapproved meeting minutes and suggested that they place them on their Agenda before they did not have a quorum to approve them.

The Lassen County Board of Supervisors, March 24, 2015 Agenda had two 2012 Minutes to be approved. Supervisor Hammond and Supervisor did not take Burns advice and abstained from voting on the June 19, 2012 and June 26, 2012 Minutes. They were not elected officials in 2012.

Supervisor Albaugh voted to approve the accuracy of the minutes from meetings he did not attend.

Albaugh, Hammond or Hemphill were not elected officials on

June 19, 2012 or June 26, 2012

Minutes lack a quorum

Let's talk about a "hypothetical" Court action:

Judge:   Mr. Albaugh did you approve the 6/19/12 BOS Minutes, for accuracy ?

Albaugh: Yes, your Honor, I did.

Judge:  Did you attend this meeting Mr. Albaugh?

Albaugh:  No, your Honor

Judge:  Mr. Albaugh, why do you think you can vote to approve these minutes?

Albaugh: Your Honor, County Counsel Burns told me I could

PAST PRACTICE: Minutes remain "unapproved" when Board lacks a quorum

does not have to be agendized ?

Lassen County CAO Richard Egan told Kan We Help yesterday the County did receive the $350,000 from the State, before the County approved theMedici Logging CDBG loan,  but the County will not have to pay the State back for Medici's default unless the County is audited.

March 24, 2014 Video: Lassen County Taxpayers Lose

Bob Nash, of Superior California Economic Development, told Kan We Help Secretary, Eileen Spencer, that the $12,342 credit analysis did include the disclosure of Medici Logging's existing million dollar loan to Bank of Commerce.

[Lassen County has refused to release the $12,342 report]

Lassen County's "GRANTS AND LOAN" Department (Jenna Aguilera) omitted the Medici CDBG default when she submitted her UPDATE at the February 10, 2015 BOS meeting? Richard Egan placed this update in the CONSENT CALENDAR.....(Agenda G-6)

Nash also stated that he found Medici Bankruptcy odd.  Superior California Economic Development does not serve Lassen County, according to their website. However, Mr. Nash stated that he took this job as a "courtesy".  A $12,342 COURTESY ..............

CAo Richard Egan stated that "I believe Medici will come out of this bankruptcy"

Supervisor Pyle claims the document is exempt due to the privacy of Medici Logging outweighs the publics right to know.

The Federal Bankruptcy Court has fully disclosed all of Medici Loggings debt and assets and this information is already available to the public. There is no "privacy" issue.

March 15, 2015

THE STATE OF DYSTOPIA

drink two beers and go home, please......

First, let's peel away a the veneer and expose the hidden agenda of the Jeffersonians

There is a cornerstone to these folks who are promoting the creation of the State of Jefferson. They talk about "FAIR REPRESENTATION".  They complain that the representation they are receiving is NOT REPRESENTATIVE of their needs or beliefs

WHAT DOES THAT MEAN?

ANSWER: Their usage of wanting "FAIR REPRESENTATION" is code for only wanting their type of thinking and their type of government. Let there be no mistake or misunderstanding of their goals on this subject.

These Jeffersonians love government. They have no problem with government. The issue is that they hate DEMOCRACY. These Jeffersonians only want their conservative expression and point of view to be the cornerstone of their government.

Why else would they want to repeal REYNOLDS VS SIMS. This ruling by the US Supreme Court established EQUAL PARTITIONS OF LEGISLATIVE DISTRICTS.

LET'S TALK ABOUT DEMOCRACY

Democracy is a very messy process. It requires that the REPULSIVE and DISGUSTING right of freedom of speech, expression and thought be instituted into your government.

Democracy is a merging of many peoples thoughts, ideas, goals and agendas being inserted into the intercourse of discussion.

The end result should not SERVE ONE PERSON OR ONE GROUPS ideology.

Democracy is exactly what the Jefferson proponents do not want. Plainly put, they just want another RED STATE.  They want the State of Jefferson to be another TEA-PUBLICAN state added to our country,

The real reason is they would like to add two more Republican/Tea Party representatives to the Senate. Let's put the truth out there for all to see.

The following is a reality that must be taken into account concerning their DECLARATION

This group of Jeffersonians are telling the public that any land, buildings, facilities, infrastructures owned and paid for by 38 million Californians,  WILL BE HANDED OVER TO THE STATE OF JEFFERSON, FREE AND CLEAR WITHOUT COMPENSATION.

38 MILLION CALIFORNIANS INVESTED IN LASSEN COUNTY'S RANCHES, AGRICULTURE, STATE ROADS 36, 44, 89, 139, SOCIAL WELFARE, COURTS, SCHOOLS, HIGHWAY PATROL FACILITIES, PRISONS, CALFIRE,

Remember, 38 million people from the State of California built and maintain these facilities for the betterment of Lassen County.

The entire State of California provides these Lassen County services, not the 24,000 folks that live in Lassen County.  The Jeffersonians continue to claim that California will just roll over and hand (free and clear) the assets owned by the people of California.

WE THINK NOT

The motivation and undercurrent of the Jefferson proponents is the fact that Lassen County, rural and sparsely populated, is an island of conservative Tea-Publicans. The Tea-Publicans have shown only the ability to disrupt and distroy. They have never shown an ability to govern.

Let's bring this same Jeffersonian ideology

closer to home

THE PROPOSAL:

The proposal would be to the three ranchers on the Board; Hemphill, Pyle and Albaugh

GENTLEMEN: "We" have been observing your ranching and farming operation for 73 years and we have assessed that we can better represent the operation f your lands than you have individually and collectively demonstrated.

Therefore, we intend to assume complete possession of your lands to better represent what "WE" believe your lands should be.

"WE" now demand that you relinquish ownership of your real estate, including all buildings/facilities that are located within Lassen County. No compensation will be given to the property owners for the land or improvements.

GENTLEMEN: It is obvious that it would be a cold day in hell before you would consent to such an agreement, yet Jeffersonians think the STATE OF CALIFORNIA, the most powerful state in the USA would.

Is it your intent, now, to devalue not only your land but all property owners and businesses in Lassen County?

THE STATE OF JEFFERSON WOULD HAVE

NO CREDIT HISTORY TO BORROW

State taxes would be high. As much as 38%, would be needed to support basic services for the counties that sign on to this folly.

ARE LASSEN COUNTY RESIDENTS READY TO PAY

HUGE ASSESSMENTS ON THEIR PROPERTY TO PAY FOR SOMETHING THEY HAVE ALREADY PAID FOR?

The Medici Logging CDBG loan  went south in October of 2014 when Medici Logging stopped making payments on their County Funded Loan. In November they closed their doors and defaulted on the $350,000.

The Supervisors spent over $12,000 on a Credit Report. On March 24, 2014 (when the loan was approved) Medici Logging had a $1,000,000 loan outstanding with the Bank of Commerce in Redding. Public Records show that Plumas Bank Executive Joe Egan had the Medici equipment appraised for liquidation in 2010.

What happens when you get slapped in the face with those pesky little FACTS, Mr. Burns?

The audio and video of the February 10, 2015 meeting shows Supervisor Pyle taking an action in "Public Comment", which is prohibited by the Brown Act.

VIDEO

The Minutes for 2/10/15 stated, in fact, that an action was taken in "Public Comment"

Only the February 10, 2015 Meeting Minutes were placed in the "Consent Calendar" (G-6). These items are passed by a single vote unless pulled for discussion. The other three minutes were placed as an individual agenda item H-1.

County Counsel told the Supervisors that they didn't have to attend the meetings to vote on approving the Minutes for their accuracy.  The Supervisors knew better and ignored Burns advice.

NOTE:  Susan Osgood, Deputy Clerk of the Board, also omitted all of the actual

public comments that were heard that day. KWH has stopped counting the volume of mistakes made by Ms. Osgood.

The "Clerk of the Board" and the "Recorder" are stand alone positions

Chapman spars with Burns

over the Brown Act ?

On March 3, 2015, the Board of Supervisors called a Special Meeting due to errors they made in the Emergency Medical Services RFP. There was only one agenda item and two public comment agenda items.

Agenda Item B 3: Public Comment

Barbara Howe addressed the Board (in "public comment") on the RCD members  the Board appointed in 2014.

She was abruptly interrupted by County Counsel. Burns, who in the past has never shown any knowledge and total contempt of the Open Meeting law (Brown Act),  told Ms Howe that this was not in the jurisdiction of the Board of Supervisors.

WATCH WHAT HAPPENED NEXT.....VIDEO

Maybe, just maybe, if Bob Burns had waited just a few minutes longer he wouldn't have lobbed his objection.

The curious thing that happened next was Supervisor Chapman chimed in that Public Comment could be about anything and it didn't need to be within the jurisdiction of Lassen County.

Brown Act, Section 54954.3 (a)

Every Agenda shall provide an opportunity for members of the public to directly address the legislative body on any item of interest to the public, before or during the legislative body's consideration of the item, that is within the subject matter jurisdiction of the legislative body.

Burns was out of order by objecting to Barbara Howe's public comment but Chapman was out of order by claiming that public comments didn't have to be germane to the jurisdiction of Lassen County

CHAPMAN'S DAY CONTINUED WITH MIS-STEPS

Chapman is also a member of the HLVRA (pool JPA) and attended their 3:00 meeting.

After several attempts (and no success)  to get the HLVRA Agenda's posted to their website, KWH Secretary presented the HLVRA with a written Brown Act Violation.

MR. JIM CHAPMAN DECIDED IT WAS TIME

TO YELL AT SOMEONE.

Chapman began his yelling and degradation about people that attend toooooooooooooooo many public meetings.

Brown Act, Section 54954.3 (c)

The legislative body of a local agency shall not prohibit public criticism of the policies, procedures, programs, or services of the agency, or of the acts or omissions of the legislative body. Nothing in this subdivision shall confer any privilege or protection  for expression beyond that otherwise provided by law

On February 15, 2010, Plumas Bank Joe Egan, (brother to Lassen County CAO Richard Egan), ordered an appraisal for the liquidation of the Medici equipment. Coincidentally, this four year old appraisal was used for the approval of the March 24, 2014  Lassen County $350,000 CDBG loanand the December 8, 2014 Bankruptcy Court.

PLUMAS BANK'S APPRAISAL:  $1,452,300

On  May 28, 2010, Plumas Bank recorded a $125,000 loan to Medici Logging  for the 69 Delwood, Westwood property

(APN: 125-010-2911)

On May 16, 2012, the Redding Bank of Commerce approved a $1,000,000 loan for Medici Logging based on the Plumas Bank (Joe Egan) appraisal of $1,452,300.00 for the Medici equipment.

NOTE:  The balance of this defaulted loan is less $134,233

Is the difference for a Plumas Bank payoff,  $125,000 + interest ?

On April 7, 2014, Lassen County recorded a "Short Form Deed of Trust" against Medici's property as collateral for the March 24, 2014 $350,000 CDBG loan.

On March 24, 2014, the Board of Supervisors unanimously approved a $350,000 CDBG loan for Medici Logging when they knew that this company's debt, on March 24, 2014, was greater than their assets.  In other words, there was a ZERO chance of this loan being paid back

WATCH PYLE'S REACTION at the end

Medici Logging had an existing loan for $1,000,000 with the Redding Bank of Commerce at the time Lassen County approved the $350,000 CDBG loan.

The Bank of Commerce loan was issued on May 16, 2012. The Bankruptcy documents also show that the collateral Lassen County used to protect its' loan was already used by the Bank of Commerce.

Was the Medici inventory dispersed, to unknown locations,

to avoid confiscation for liquidation ?

The Lassen County Auditor was told to disperse the loan funds on April 7, 2014 to Medici's trade accounts.

Supervisor Hammond

Video

Lassen County Supervisor Jim Chapman found out about the lies that were being told

and set Supervisor Hammond up for the fall

At the February 17, 2015 Lassen County Board of Supervisors meeting Supervisor Chapman asks CAo Egan if he could confirm that the Commander of Sierra Army Depot never spoke with anyone from HSP Resources about the Amedee Airfield parcels that the County was selling.

Egan very reluctantly & with a confused look on his face

confirmed that the Commander stated that he was not in contact with HSP Resources

What happened next was unique to say the least:

Supervisor Hammond stated firmly that he had been meeting with the Commander of the Sierra Army Base that included  negotiating a contract for HSP Resources .

*watch a very nervous bob burns*

In fact, Supervisor Hammond stated that he and the "other people" had met three times.

Hal Hays did publicly state on February 10, 2015 that he had a meeting on February 11, 2015 with the Army Base ?

SUPERVISOR HAMMOND.....

HSP Resources (Hal Hays, Larry Smith and Steve Pezzullo) stated in their 12/8/14 proposal that they were in negotiations with the Depot. Hal Hays purchased the land above these parcels for $450,000 so that he would have access to the airfield before the Amedee Airfield Parcels RFP was issued. He's offering $25,000 for the parcels.

Herlong could have used an investment of $450,000. Pezzullo bought the town for $31,900.

Hal Hays stated, on February 10, 2015, that he could bring in UPS, FEDEX and other carriers to share the Army's Airfield.  The airspace above Amedee Airfield is Federal airspace. As long as Sierra Army Depot is open that airfield will not be shared with any private entity.

The Supervisors refused to order the Airport Land Use Plan ($40,000) which is mandatory before giving this property away for $35,000.

Who would buy any land when the "use" of the land is undetermined.

Sharp Army Depot had the same problem as Sierra Army Depot.....contaminated land

Sharp Army Depot put up LUC (Land Under Control) signs around the contaminated land and continue to do clean up on water contamination.

Sierra Army Depot got rid of their contaminated land ( by transferring it  to Lassen County) but left $4,000,000 worth of clean up (unexploded ordinances, chemical contaminations).

STATE OF TRIBALISM

Their leader gave a hour long pandering diatribe that was

51% Factless

10% Feckless

39% Fear Mongering

Since 1941 this group has signed up three counties to break away from California.

California is the most powerful  state in the union.

The State of Jefferson would be a State of Poverty

Lassen County's main revenue stream comes from a percentage from the taxes collected from the entire state of California. Lassen County's welfare (health and human services) revenue supports Lassen County jobs.

The current annual revenue for Lassen County

 is approximately

$123,738,049

Lassen County will not have the California dollars to take care of its citizens (health and human services) under the State Of Jefferson........less government mantra

The new "Jefferson" County could not & would not pay a CAO $175,000. If the position would even still exist, it would be more like $65,000- $80,000.

They talk about new Districts not County's

California County governments exist now under the California Government Codes.

Don't be fooled, "County" Supervisors go away with this new tiny state

New elections, new tribal government

NEW GRAND POOH-PA'S

The second source of income and employment  are the two California prisons and the Federal prison within Lassen County boundaries The Jefferson group claims that the State of California would just hand over the prisons, state parks, court house, CHP, welfare dollars.  B u l l  S h i t and a pile of cow pies.

After the social welfare dollars and prison dollars are gone, the only source to tax

would be the ranchers.

THIS IS A $124,021,851 INDUSTRY

[The State of Jefferson says they would only tax them 3%, $13.8 million]

FAKED CLOSED SESSION AGENDAS

The last two "Special Board of Supervisors Meetings"

have not been about labor negotiations.

You really have to wonder why Burns, like his predecessors, feels the need

NOT TO BE HONEST ABOUT CLOSED SESSION ISSUES.

It couldn't be because the Brown Act requires public entities to place the truth on their Agendas, because that has n e v e r stopped them from lying.

Mr. Burns & the Lassen County Board of Supervisors very recently signed a contract with Margaret Long and her brand spanking newly formed law firm. The public was told that this was a "Child Protective Services" contract.

The only thing the Supervisors have used Margaret Long for was to protect the children that sit on the Lassen County Board of Supervisors and their friends.

The last two "Special Meetings" (January 29, 2015 & February 4, 2015)just happened to coincidentally follow the court filings of Federal case 14 cv 01473. The same case that Margaret Long is defending for Lassen County.

Kevin Jones, Burns old bodyguard (?)and recent new Captain (?) at the Sheriffs Department, was served this lawsuit on June 4, 2014.

Bob Burns resigned as District Attorney on June 9, 2014, deliberately leaving this mess

to Stacey Montgomery.

Mr. Burns, shame on you.

Oh, and by the way this is not a child protective services case.

NOTE TO THE BOARD:

yet that He Can Not Make up Employee Positions

 or

County Departments

....and no one has ever expected

 the Supervisors to know anything!

It doesn't help that Lassen County has three silent Supervisors

There is a budget for the Road Department (Fund 122)

There is a Department of Transportation: Ord. 529, Title 2; Chapter 2.13 & 2.36)

There is NO PUBLIC WORKS DEPARTMENT AS STATED IN THE "2015 CONFLICT OF INTEREST CODES"

There is a budget for Clerk of the Board (Fund 100, Acct. 0012)

There is no Budget for the position of "County Clerk/Recorder

There is a budget for the County Administrative Officer (Fund 100, Acct. 0031)

There is a provision in Title 2: Chapter 2.06 for a County Administrative Officer

There is no Budget for Chief Executive Officer

On January 27, 2015, the Supervisors took only minutes to approve their "deficient" 2015 Conflict of Interest Codes

and told KWH to mind their own business

and spent an hour complaining about the LMUD Conflict of Interest Code because it didn't include a "Gift Limit"

Lassen County Clerk

Julie Bustamante

has never been any good at her position

Now, she has hit rock bottom

California Government Codes 25100 and 26801 clearly state the County Clerk shall act as the Clerk of the Board. However Government Code 25100.5 states that the Board of Supervisors can appoint the Clerk of the Board by enacting an Ordinance. By enacting an Ordinance, the Supervisors brought this statutory position under the supervision of the Supervisors but when the former County Clerk did not run for re-election they repealed this.

For seven years 15% of Julie Bustamante's check is paid from the "Clerk of the Board" annual budget. She gets paid 15% as County Clerk, 55% as Election officer (1 maybe 2 elections a year) and 15% for County Recorder.

Susan Osgood, is acting as the Clerk of the Board.

Budget for this statutory position

This Statutory position, Clerk of the Board,  has defined duties which include attending all regular and special meetings (Gov't Code 25101 (a)), keeping the Minutes in all formats (Gov't Code 25101 (b)), deliver to the Auditor all demands for money (Gov't Code 25101 (c)), file and preserve all documents submitted at the meetings (Gov't Code 25101 (d)) , authenticate signatures, placing the "Seal of the Board" on documents.

From 2007 to September 23, 2014, the County Clerk has placed the Minutes of Supervisors on the Agendas.

12 times, in 2014, the County Clerk did not place any Minutes on Agendas and fell incredibly behind. The Minutes that were submitted for approval were chronologically all over the board.

On January 27, 2015, Supervisor Chapman told KWH that it was none of our business.

On the October 14, 2014 Agenda, Julie Bustamante began placing the Minutes

 under "County Clerk/Recorder".

On January 27, 2015, County Counsel omitted the statutory "Clerk of the Board" position all together on the 2015 Conflict of Interest Codes.

KWH challenged the COI as Deficient

Bob Burns does not have the authority to dismiss a position that has been created by Government Code 25100 nor does he have the right to create fictitious departments

The former County Counsel Vander Ploegg also attempted to create a fake title, "Chief Financial Officer", and KWH made them change it back to CAO.

Yesterday, Kan We Help notified Bustamante that the January 13, 2015 Minutes posted had not been approved by the Board of Supervisors.

Bustamante, without checking, quickly answered back that we were "WRONG AGAIN". Kan We Help asked for a date where the 1/13/15 Minutes had been approved. Bustamante did not apologize but did take the Minutes off the website.

BUSTAMANTE HAS NO IDEA HOW TO BE A COUNTY CLERK

Now, Bustamante presented the January 20, 2015 Minutes for approval at the January 27, 2015 meeting.  How long were the January 13, 2015 Minutes sitting around.

There are still delinquent Minutes from 2012 & 2014 ?

[this was done deliberately. the legal positions cannot be faulted if they violate the FPPC conflict of interest laws, but the county can be in violation of a deliberate attempt to deceive]

KAN WE HELP TELLS SUPERVISORS

THEIR CONFLICT OF INTEREST CODES

ARE DEFICIENT

Supervisors have no interest in the mistakes County Counsel made. WATCH

1. The Clerk of the Board is a statutory position and was deliberately omitted by County Counsel. The County Clerk has failed to be competent in this position. Kan We Help suggested moving the "Clerk of the Board" position back directly under the Supervisors authority and supervised by the CAO. Government Code 25100 allows for this change. This position has been budgeted so there would be a negative impact on the budget.

2.  There is no "County Clerk/Recorder" position. The positions that are budgeted are Clerk of the Board, County Clerk, County Recorder and County Elections.

3. There is no Public Works Department. County Counsel simply copied the last COI without reviewing if this position even existed. The Transportation Department has a budget.

4. Both County Counsel (Title 2, Section 2.08.30, m208.040) and District Attorney (Title 2, Section 209.010) are named as "Public Administrator" in Lassen County Codes.

5. The Board of Supervisors voted to add a budget for a new Department Head on June 10, 2014 (Deputy CAO). The CAO hired a Deputy CAO on January 5, 2015 but this position never came before the Board for approval. The CAo has kept him hidden ???????

Just a sample of what County Counsel missed and The Supervisors were not the least bit interested in

Lassen County Counsel

Bob Burns

Finances New Law Firm

WATCH & LISTEN TO HIS LIES

Former District Attorney Bob Burns

brought his bag of tricks with him

when the Lassen County Supervisors hired him as County Counsel.

Note to Bob Burns: Try the truth for a change,

it isn't as painful as being exposed for deception

Burns placed a new legal contract on the January 20, 2015 Board of Supervisors Agenda (H-2).

Burns told the Supervisors that he wanted to cancel the Cota Cole contract immediately and hire a new law firm called Prentice Long and Epperson LLP.  This law firm was recently formed in December of 2014. County Counsel Burns did admit that Margaret Long was a friend of Rhetta Vander Ploegg (former Lassen County Counsel).

Margaret Long suddenly left the Cota Cole law firm to form this new law firm with Jason Epperson and David Prentice.

We don't know if she was fired or left before she was fired.

During the H-2 Agenda discussions, Kan We Help told the Supervisors that this contract appears to be for "child protective services" consultation but had a very "ODD" clause on Exhibit A ( page 10 of this newly formed law firm's contract).

THE FIVE SUPERVISORS WERE CLUELESS, DIDN'T CARE

OR WERE APART OF THIS FRAUD

Oooops: County Counsel did indeed place a legal contract before the Board of Supervisors on June 24, 2014

for ALL CHILD SUPPORT CASES

but it wasn't with Cota Cole.

This contract did not include services to defend "elected officials"

KWH Secretary told the Board that this clause will be abused and it turns out it already has.  Burns is using this new law firm to defend County employee Kevin Jones, Brandon Vinson and newly elected District Attorney Stacey Montgomery.

WHAT BURNS DID NOT DISCLOSE, IN PUBLIC, WAS

A

MOTION IN FEDERAL COURT

TO CORRECT HER MISTAKE

and Judge Claire granted the Plaintiff 30 days to amend her complaint. The Amended complaint was filed on January 16, 2015.

Shhhhh...Rancher Richard Egan hired a Deputy CAOO

Lassen County CAO Richard Egan mentioned that he had hired Tony Shaw as his "Assistant -to-the- CAO as the.... last comment before the December 16, 2014 Board of Supervisors meeting was adjourned. Julie Morgan was the "Assistant-to-the-CAO"?  So what is up?

Well, it turns out that CAO Richard Egan hoped no one would notice his "slight-of-hand".  Tony Shaw was actually hired as Deputy CAO and started January 5th.

Richard Egan did not have the courtesy (to the public or the Board) of placing this new County employee on the December 16, 2014 Agenda as an introduction/approval of his new "relief" CAO.  Egan didn't even place this new County Employee on the January 13, 2014 Agenda. This was not an oversight but a deliberate attempt to hide the fact that he had hired Tony Shaw?????
