The Public Records Act states that any audio, video or record that a public entity makes of a pubic meeting becomes a disclosable record to the public.

Kan We Help submitted a "Public Records Request" for a copy ($5.71) of the audio of the 11/15/16 Board of Supervisors meeting only to find that it had been altered.  The CD stops at the Supervisors 11:03 AM break.

According to the 11/15/16 Minutes the meeting continued at 11:08 AM.  The Minutes also state this meeting adjourned at 12:46 PM, but the audio for that 98 minutes was deleted.

What happened in that 1 hour and 38 minutes?

Deputy Clerk of the Board, Susan Osgood, is responsible for the Boards Minutes and the Audio recordings.  This was a deliberate act of altering a public document.

This is not the first time this has happened and usually occurs when Supervisor Chapman has had a temper tantrum.

County Clerk Julie Bustamante has made it a common practice to erase Chapman's irrational tirades

Chapman did, in fact, bully the other Supervisors into giving him this Palm Springs vacation

Chapman retires in 32 days. 

The truth: Chapman wanted to make sure his replacement David Teeter was placed on the CSAC Board of Directors and he thought the public owed him one last free vacation (he was entitled)

This Board has never respected the Brown Act, Public Records Act or any other law that requires them to be honest.

Before He Leaves Office on December 31, 2016

Chapman gets to go to the CSAC party ($3,000 in Palm Springs) on November 28 for one last paid vacation. Supervisor Chapman leaves office on December 31, 2016.

Chapman told the public that the $3,000 trip for his successor, David Teeter, was warranted because it was training for "New Supervisors". The six day trip includes only a day and a half of "training".  

On October 25, 2016, Chapman did not consider approving expenses for the second "New Supervisor" from District 1, but always intended to go to the CSAC party himself and bamboozled  the other four Supervisors to appoint him to the CSAC Board again with David Teeter as his Alternate.

Chapman leaves office in 46 days.

Most politicians want their final term to be dignified, at least with a certain level of dignity anyway.

 Chapman will not accomplish this.

He has reduced the Lassen County Board of Supervisors to a "bully" pulpit. The public is more than aware of his rudeness and temper tantrums.

Will the four other Supervisors rein in Chapman's style of rudeness or will they just sit back and be told what to do?  Where's the representation for the other four Districts?

At the March 22, 2016 meeting, Chapman threatened a member of the public when they requested to speak on an agenda item.

Chapman refuses to let the public comment on the Consent Calendar Agenda, claiming that it is "administrative" only

*At the April 12, 2016 meeting, Chapman puts 18 of the 27 Agenda items in the Consent Calendar. 8 of the 18 were pulled for discussion by the other Supervisors. So much for routine. 

*The Consent Calendar issues are supposed to be "routine in nature", but that is the last thing these "untouchables" are. The Consent Calendar is approved with one sweeping vote and Chapman, unlike Supervisor Pyle, will not allow any item to be pulled for a separate vote and discussion by the public.

At the upcoming April 19, 2016 meeting, Supervisor Chapman has placed

8 of the 12 Agenda items in the "Consent Calendar".

The Consent Calendar Rule Section 5 E has been in effect for decades allowing full and direct comments by the public.

On September 8, 2015, former District Attorney and now Lassen County Counsel Bob Burns pushed Supervisors to change the rule to violate the Brown Act. The advantage for the Supervisors was to put the majority of agenda items in the Consent Agenda to eliminate any public comments.

Supervisor Pyle was the Chairperson in 2015 and ignored the new illegal rule 8 times. 

However, the old politician, Supervisor Chapman, knew the advantage of not letting the public *directly comment on the Consent Calendar Agenda and loaded the Consent Calendar with most of the Agenda.

The annual Lassen County Budget meetings (which are public meetings) concluded this week. These meetings are simply held to bully and intimidate County Department Heads.  CAO Richard Egan told Staff (not all attend the Wednesday meetings) that the County had a $318,000  deficit.

The Department Heads have succumbed to this intimidation for decades. It results in huge overtime expenses because of staffing that Supervisors have refused to allocate money for.

CAO Richard Egan had the audacity to ask DA Stacey Montgomery if she would accept a .8 employee instead of a 1.0 employee. Did her Budget Request for an additional attorney and Investigator fell on the Deaf/Dumb ears of Supervisor Chapman and Pyle? NO, SHE GOT IT ALL!!!

The County has more than enough money to accept 

all of the Budget requests of all County Departments

The two Supervisors (Chapman & Pyle) made very inappropriate comments about the Assessor and said that if you are not here you lose. They kidded about not giving the Assessor the Appraiser that is badly needed (Re: Williamson  Act Abuses & Compliance against the ranchers)

Supervisor Chapman was against free food for the poor and wanted to give the One Stop in Herlong more money and said the Bieber and Westwood One Stops should raise their own money. Chapman resented the annual dinner the One Stop provides and said it should be a "POT LUCK". Chapman was concerned that the County doesn't even know "how" the annually allocated budget ($10,000) was spent.

These two men attended the June 16, 2015 HLVRA meeting when the Executive Director Jarod Hancock announced that Susanville did not get the OGALS Grant.  The OGALS Grant, if awarded,  was to be used for Susanville's share ($1.1 million) of the construction costs for the community pool.  Susanville must now find another source for the pool construction costs. 

The County will hold onto the $1.1 million that they borrowed on June 4, 2015 until Susanville can find a source for the pool construction costs.

 CHAPMAN AND HAMMOND FAILED TO REPORT THIS "FACT" DURING AGENDA B-4 (Unagendized Reports by Board Members aka meetings they attended)  AND WERE CLEARLY ANNOYED THAT THE ISSUE WAS BROUGHT UP BY KAN WE HELP.

On March 3, 2015, the Board of Supervisors called a Special Meeting due to errors they made in the Emergency Medical Services RFP. There was only one agenda item and two public comment agenda items.

Barbara Howe addressed the Board on the RCD members that the Board appointed.  She was abruptly interrupted by County Counsel. Burns, who in the past has never shown any knowledge of the Open Meeting law (Brown Act),  told Ms Howe that this was not in the jurisdiction of the Board of Supervisors.

Maybe, just maybe, if Bob Burns had waited just a few minutes longer he wouldn't have lobbed his objection. 

The curious thing that happened next was Supervisor Chapman chimed in that Public Comment could be about anything and it didn't need to be within the jurisdiction of Lassen County.

Burns was out of order by objecting to Barbara Howe's public comment but Chapman was out of order by claiming that public comments didn't have to be germane to the jurisdiction of Lassen County

CHAPMAN'S DAY CONTINUED WITH MIS-STEPS

Chapman is also a member of the HLVRA (pool JPA) and attended their 3:00 meeting.

After several attempts (and no success)  to get the HLVRA Agenda's posted to their website, KWH Secretary presented the HLVRA with a written Brown Act Violation.

At the February 17, 2015 Lassen County Board of Supervisors meeting Supervisor Chapman asks CAo Egan if he could confirm that the Commander of Sierra Army Depot never spoke with anyone from HSP Resources about the Amedee Airfield parcels that the County was selling.

What happened next was unique to say the least:

Supervisor Hammond stated firmly that he had been meeting with the Commander of the Sierra Army Base that included a contract for HSP Resources .

 In fact, Supervisor Hammond stated that he and the "other people" (which he named) had met three times. 

Hal Hays did publicly state on February 10, 2015 that he had a meeting on February 11, 2015 with the Army Base ?

Chapman attacks taxpayers for wanting a Capital Improvement Plan

Chapman tried to slip a Capital Outlay expenditure for a "back up" generator into an inappropriate account [Agenda 5/13/2014, Item G-7]He claimed that it had been there for years. Research found that was not true.

Chapman claimed that this generator had been in the budget for years. It has never appeared until the 2013-2014 budget. Why lie about something that can be so easily checked?

Lassen County Auditor confirmed that the generator  should have been paid for from the Capital Outlay fund and not the Criminal Justice Fund.

Chapman was reminded that the Board approves the annual budget. When Chapman gets caught telling lies he ALWAYS blames it on staff.
