Williams allowed the recent 12/20/16 front page article on the Honey Lake Power/LMUD contract to be published.  Honey Lake Power is in trouble and LMUD takes advantage of their crisis. LMUD convinces HLP that a 20 year contract is better than a 30 year contract by offering HLP less money and a promise to dump HLP when LMUD builds a proposed multi-million dollar substation in Wendel for NV Engery.   SOUNDS LIKE A GOOD BUSINESS DEAL...............?

LMUD has been embroiled in deceit and deceptions since LMUD'S 2001 Arrowrock Hydroelectric scandal to cover up the disappearance of $8.7 million dollars. In 2011, Williams knew that LMUD didn't purchase the ATT property (Viewland) and covered it up. This cover-up goes back to 2007 when Invenergy came to town with a promise to give LMUD $40 million dollars worth of new infrastructure.  Invenergy convinced the LMUD Board to spend $40,000 for a "System Impact Study" for a 230kv transmission line. The "System Impact Study" was released at the November 26, 2013 LMUD meeting. Kan We Help requested a copy of this alleged study and was denied a copy.

LMUD signed a MOU with Invenergy on August 28,2012  that expired on February 28, 2014. This MOU was just as bogus as all Invenergy promises and the only entity spending money "on nothing" was LMUD.

At the December 23, 2013 LMUD Board meeting, the lies seem to escalate. The LMUD board revealed that they were considering signing a 15 year contract with Oski Energy (Wendel Energy Operations). This was a shell corporation based at 730 Sandhill Road, #250, Reno Nevada.

The concept of this  230 kv transmission line died a decade ago, like all of the previous years of LMUD phony projects and alleged agreements the LMUD Board has released attempting to present the 230kv transmission line as legitimate.

2004-LMUD's Richmond Road Substation

In 2004, LMUD illegally stored and transported toxic waste at their Richmond substation (420 Richmond Road, Susanville) and then forged Federal documents to move the toxic waste. The EPA fined LMUD $9,000

 

2006-Beterbide Land Scam

LMUD Director Fred Nagel & Frank Cady negotiated to buy property from their friend Jack Beterbide that Beterbide didn't even own. On January 26, 2006, Jack Beterbide purchased the Chestnut property from Robert and Gail Prosise for $120,000 and then he sold it to LMUD for $381,232 the same day.  The ground on the Prosise property and Beterbide's property was heavily contaminated with years of fuel and other contaminates .  LMUD relieved Beterbide and Prosise of a 20 year environmental disaster. The property was worthless and Nagel and Cady knew this.

LMUD Director Jesse Urionaguena  was related to Beterbide and abstained from the vote to lease the property back to Jack  Beterbide and left the cost of the cleanup to the LMUD ratepayers

 

2007-Hayden Hill contaminated land swindle
 In 2007, Fred Nagel and Frank Cady set in motion a scam that would cost LMUD ratepayers hundreds of thousands of dollars in legal fees to get out of. Nagel and Cady signed a $65,000 check for worthless transmission lines that had been taken down at Kinross Gold's Hayden Hill Mine.  
Fred Nagel, Bill Stewart and Frank Cady concocted a swindle on the Willow Creek landowners. They promised these ranchers LMUD power if they deposited $30,000. LMUD had no intention of providing power because this was Surprise Valley Electrics district.

2011-Viewland Substation Scam

Fred Nagel and Bill Stewart lied to the public about purchasing the ATT property/equipment for a "Viewland Substation".

 

LMUD NEVER PURCHASED ANYTHING FROM ATT, BUT PLANNED TO BUILD A USELESS SUBSTATION ON THE LAND LEASED FROM BLM

ANOTHER LMUD SCAM GONE BAD..............

 

The only act that was legitimate was a lease with BLM for the surrounding land (40 acres). The problem: it was contaminated and could not be developed until LMUD cleaned it up. BLM was adamant about the cleanup before issuing any permits. LMUD could not afford to clean up the land without admitting they knew it was contaminated before they leased the BLM land.

LMUD has floated the lies about interest in a 230kv substation for over a decade.  Developers have come and gone with big promises about paying for this 230kv substation, but because there has never been a market the "idea or concept" was just that and never went further than an "idea or concept".

Once BLM would not let LMUD move forward with their "Viewland Substation", LMUD purchased 241 acres of land in Wendel for a substation that has no value to LMUD ratepayers. 

LMUD has been overcharging customers for many years to accumulate "cash" for the "Viewland Substation". Now they have over $10,000,000 in the bank and voted to take on debt to build this 230kv substation in Wendel. Why.......?

All LMUD Agendas show that "NO ACTION" was taken on this 241 acre purchase yet on November 1 LMUD recorded the purchase.......LMUD recently paid $250,000 for this land in Wendel, and has not provided one, NOT ONE, developer that is willing to pay for this boondoggle.

LMUD's new Viewland 230 kv substation in Wendel ?

 

Lassen Municipal Utility District negotiations for the original Viewland Substation [ATT property :APN 109 -010-04] first appeared on an LMUD Agenda on August 28, 2007. LMUD Frank Cady negotiated with Mickey Villella from ATT and Charles Wright from BLM.

 

The property was contaminated and sat on BLM property. BLM required the property to go through environmental studies before any development by LMUD.  LMUD allegedly paid various companies like Invenergy and Navigant and TANC to do studies for LMUD. Thousands of dollars were spent but NO STUDIES WERE RELEASED TO THE PUBLIC. LMUD allegedly purchased this land, in September/2011, for $2500 with the intention of building a 230kv substation.

There has never been any interest by Developers for the 230kv transmission line but LMUD pursued BLM for permits to build a substation. Permits that BLM was unwilling to issue according to the LMUD Minutes.

A substation that had no use......a substation that would just sit and do nothing.

The Public was dooped once again by LMUD

 

Lassen County Times misled the public again.

The LCT continues to be an enabler for corruption in this County

Public documents show that LMUD lied to the public about purchasing the ATT property/equipment. LMUD only contracted a lease with BLM for the "right of way" of the 40 acres.

Did LMUD attorney Eugene Chittock continue to broker this scam or was this Frank Cady and Bill Stewart's deal?  Regardless, the LMUD Board bought into it

There was no interest in the 230kv Line in 2004 when the concept was first marketed by Frank Cady and Bill Stewart and there is no market for it today.

In 2016, LMUD was unsuccessful in buying the BLM 40 acres that surrounded their contaminated ATT property. LMUD was not willing to clean the property up and lost interest in developing this substation on March 22, 2016.  Talk then began on investigating a new site.

According to LMUD April 26, 2016 Minutes, Director Bowden suggested that LMUD drop the 230kv project and "concentrate on just what we need right now"

There were no discussions on developing the original Viewland substation for three months and then suddenly LMUD purchases a 241.88 acre site in Wendel for $250,000. This 230kv project was resurrected now as "two" substations to connect to NV Energy.  NVEnergy will not be helping with the financing. LMUD has even paid for all of the alleged "studies".

The bloviating, blistering, bafoonery of Supervisor Chapman gets one last chance to attack the Critics. Todays Lassen County weekly/advertiser gave Chapman a half page to blast his critics.

CHAPMAN HAD THE COUNTY CLERK ERASE THE 11/15/16  PUBLIC CRITICISM , WHICH IS ILLEGAL TO TAMPER OR DESTROY PUBLIC RECORDS OR PROPERTY (California Penal Code 594)

County Clerk Julie Bustamante has made it a common practice to erase Chapman's irrational tirades

Chapman did, in fact, bully the other Supervisors into giving him this Palm Springs vacation(over $3,000) this week to get "Supervisors" training at the CSAC Palm Springs Annual meeting. 

Chapman retires in 32 days. 

The truth: Chapman wanted to make sure his replacement David Teeter was placed on the CSAC Board of Directors and he thought the public owed him one last free vacation (he was entitled)

This Board has never respected the Brown Act, Public Records Act or any other law that requires them to be honest.    

Kan We Help told Supervisor Hammond a dozen times that he could not vote on the sale of the Herlong property. He did it anyway and the FPPC fined him $2500.  Would he do it again.....? You betcha. He just hopes he won't get caught.

Kan We Help submitted a "Public Records Request" for a copy ($5.71) of the audio of the 11/15/16 Board of Supervisors meeting only to find that it had been altered. 

The CD clearly stops at the Supervisors 11:03 AM break.

According to the 11/15/16 Minutes the meeting continued at 11:08 AM. 

The Minutes also state this meeting adjourned at 12:46 PM, but the audio from 11:08 to 12:46 was deleted.

Supervisors claim they may send District 1 Supervisor-elect to this 1 1/2 day training for the 6 days (?) but the deadline for registration is November 15.  The Supervisors do not meet again until November 15 and if they vote to send the new District 1 Supervisor the registration cost will increase because of the Supervisors poor planning. Neither Supervisor will be a County employee until January 10, 2017 and only then are they eligible to use "public" money.      NICE WAY TO START A TERM OF OFFICE?

The Supervisors could have approved sending, at the 10/25/16 BOS meeting, the District 1-elect Supervisor on this vacation but DIDN'T..........

In addition, Supervisor Jim Chapman never mentioned this when he arranged for his replacement David Teeter to attend this six day vacation  back in September.

Very little of the CSAC Annual meeting, in  Palm Springs, relates to new training for a new County Supervisor.

Nagel was elected to replace a Recalled Ward 1 LMUD Director in 2002 and quickly took advantage of the corruption that existed in LMUD.

 

One of Fred Nagels abuses, as a LMUD Director, is gaming the system. Nagel doesn't report any legal activity on his monthly "STATEMENT OF MEETINGS" report but secretly takes trips.

All activity that LMUD pays the Directors must be reported on these monthly statements. Nagel knew this and disregarded the law.

ELECTED DURING LMUD RECALL IN 2002

 

 

De ja vu:   In 2001, the LMUD Board accumulated over $8,000,000 in unrestricted funds and then allegedly speculated in the Market and then claimed they lost $8.7 million dollars. This loss was never investigated.

To avoid bankruptcy the LMUD Board proposed a 162% rate increase.  This attempt to increase the rates failed so the LMUD Board with the help of their attorney, Frank Cady, came up with the fake Arrowrock hydro scam as a smoke screen.

Subsequently, four members of the LMUD Board were recalled in June of 2002.  Fred Nagel was elected to replace Ward 2 Director Giannotti. County Clerk Theresa Nagel refused to place LMUD Ward 3 Director Wayne Langston (the Nagels son-in-law) on the Recall ballot. Langston was never on any LMUD ballot and never received a single vote

On October 26, 2007, LMUD Directors Nancy Cardenas, George Sargent and Darrel Wood resigned amid the corruption, abuses and mis-conduct of Frank Cady. This left Fred  Nagel and his son-in-law Wayne Langston who supported Frank Cady's actions.

The remaining Directors wanted to appoint the three new LMUD Directors but the appointments were made by the Lassen County Supervisors.

In the past nine years Fred Nagel has led this Board in scams that have cost the LMUD ratepayers literally over a million dollars.

David Teeter does business with Lassen County.  The Supervisors will vote on  this Conflict of interest for Teeter at the October 25, 2016 meeting (Agenda H-2).

 

If this is not approved, Lassen County can no longer do business with Teeter's business. 

If approved, Teeter can continue to do business with the County and would be required to recuse himself on any vote that would effect him and his business. 

 

NOTE:  Supervisor Tom Hammond never disclosed his lucrative business with the County until Kan We Help exposed his conflict. The Supervisors then approved to continue doing business with Tom Hammonds businesses in Herlong.

CAO Egan recently asked for a one year extension to his five year contract that terminated in 2018. 

The Supervisors extended Egan's contract to 2019.

HSP Resources nor ANY PRIVATE CARRIER can ever use the Army's Amedee Airfield. Supervisor Tom Hammond must stop telling the public that they can.

CAO's usually do this when they threaten to quit or have been  threatened with termination.  This additional year would be a "buy out" of more than $200,000. Egan was there to watch a previous CAO accomplish this.

Three months after the Supervisors hired Egan they had to amend his contract. For reasons yet to be explained, Egan wanted the title of CEO (Chief Executive Officer) but Lassen County only could hire a Chief Administrative Officer.  Kan We Help filed many complaints, with Lassen County, that there was NO CHIEF EXECUTIVE OFFICER POSITION AND EGAN HAD TO STOP SIGNING OFFICIAL DOCUMENTS WITH THAT TITLE.  Thus the need to have the May 13, 2014 Amendment. 

CAO Egan's original contract expires on February 25, 2018 original contract.  Paragraph 2: Term states that Lassen County must notify Egan by February 25, 2017 if they did not intend to renew Egan's contract. 

 

 

If no notification was given by February 25, 2017,

Egan's contract is

automatically extended one year.

So why do they need this second amendment ?

 

Egan's salary is well above $170,000 now.

Supervisor Chapman managed to put $444,908 in Fund 127 for his elevator despite the County needing every penny left of the $4 million dollar loan to renovate the Riverside property.

Where did he get this $444, 908 ?

He moved it from the $10 million General Reserve Account because there will be no $$$ left from the LCPIC loan which has been grossly mis-managed LCPIC .

Richard Egan, as CAO, has authority to move money without permission from the Board or the Public. The Public will never see this money being moved into other accounts.

This $444,908 will silently & methodically find its way to Courthouse Construction (Fund 150/1501/3006119) for Chapman's elevator. 

On July 8, 2014, Lassen County Board flew $$$ TRG's Harry Munyon $$$ from Palm Desert, CA to present an "alleged" "NEEDS ASSESSMENT" study.  This Study was commissioned two years ago at a cost of $8,000.  Study  NEVER USED........

 

The County now wants to spend $250,000 (ADA Compliance Study) to tell the County what they already know but have been unwilling to FUND ANY ACTUAL ADA COMPLIANCE.

with the

Americans with Disability Act

....look at Fund 150 below...it already has $200,000 in it ?....

The 1973 law was intended to bring all businesses in compliance by 1981. However, the law kept being amended and made compliance impossible. Now public entities that receive Federal assistance must be in compliance before Grants are approved.

SZS Consulting Group will not bring Lassen County into compliance. For $250,000 it will identify Lassen County deficiencies (previous studies have never been utilized) and train County staff on current laws.  The contract includes $25,000 for "public hearings"

 

The majority of Lassen County owned buildings do not comply with the ADA law

As Lassen County repaired or remodeled a few buildings they included ADA compliance in all public contracts, however the majority of County buildings have been neglected. Supervisors have been allowed to look the other way in lieu of pursuing their personal projects.

CAO Richard Egan intentionally failed to identify the "Account" line items for moving the $250,000 transfers.  Where will this money really be spent?

Eugene Chittock filed a lawsuit on January 27, 2011 so that LMUD would not have to clean-up their Hayden Hill 69kv transmission lines they purchased from Kinross Gold on December 17, 2007

 

THE PROBLEM FOR CHITTOCK:

LMUD filed a Notice of Exemption, so they would not be required to do the clean-up on December 23, 2009

 

This cheap suit filed a Motion to declare KWH a vexatious litigant on August 12, 2010 so that Kan We Help could not intervene on his intention to bilk the LMUD ratepayers. Chittock was paid $12,472 for filing this Motion.

 

 

 

Most *S.L.A.P.P. Motions like this are denied

*strategic lawsuit against public participation

 

This motion did not rise to the level of a vexatious litigant (7 or more failed lawsuits. Kan We Help filed 1 Writ of Mandate against LMUD for the Arrowrock scam), but Judge Bradbury signed it never the less. Judge Bradbury did not disclose that he was in business

This December 23, 2009   Notice of Exemption states that LMUD is not liable for the removal  of transmission lines

at the Hayden Hill Gold Mine or the reclamation required by Lassen County.

So, the lawsuit Chittock filed on January 27, 2011 was not only frivolous but deceitful

Chittock filed a vexatious motion against KWH to prevent any intervention KWH response

Lassen County Planning Department is the Lead Agency for the Hayden Hill Reclamation Plan & was never informed about this alleged "Notice of Exemption".

 

 LMUD Directors posted a Bond & applied for a Use Permit with Lassen County to comply with the Reclamation Plan after purchasing the 13 miles of 69 kv transmission lines  on December 17,  2007  & now the public is supposed to believe that LMUD was justified in filing a lawsuit to avoid cleaning up the Hayden Hill lines  by claiming Frank Cady, LMUD's Attorney//General Manager didn't have the authority to buy it ?

Ten years later, after Kan We Help exposed this fraud in 2006, LMUD is still lying about Hayden Hill

The Lassen County Supervisors tried to move money and transfer property belonging to the Lassen County Community Development Commission,  WITHOUT CONVENING THIS COMMISSION.

A Commission they claimed, on March 31, 2016,  DID NOT EXIST.

After Kan We Help exposed that the "Community Development Commission" did exist, the County started moving backwards to correct this deliberate oversight.

Kan We Help exposed:

1. Supervisors approved placing $50,000 in a parking lot account (Fund 588) to repay the restricted USDA Grant,  hoping no one would notice. KAN WE HELP NOTICED.

2. Supervisors never intended to pay the the USDA Grant back. When Kan We Help asked for proof that this loan was re-paid the check was then written.  Public records indicate that the USDA check was written on June 8, 2016

The Westwood Warehouse, under the Grant, could not be used by the Sheriff's Department without re-paying the USDA Grant. Again, the Supervisors unilaterally took this action without convening the Lassen County Community Development Commission. The Supervisors hoped that no one would notice. KAN WE HELP NOTICED

3.  Supervisors moved the maintenance of the Westwood Warehouse property to Public Works due to the fact that the Sheriff's Department has no money to maintain a Sheriff Substation  at the Westwood Warehouse on Birch Street. 

 

4. On July 26, 2016, the Supervisors placed the Lassen County Community Development Commission on  the Agenda. But moved the meeting to Beiber (over one hour from Susanville).  Supervisor Chapman did not attend this meeting. Supervisor Albaugh Chaired the meeting. Supervisor Jim Chapman demands dishonesty

The Board of Supervisors Agenda includes a Consent Calendar which is intended for routine items.  Jim Chapman has abused this Agenda item more than any other Supervisor in the history of Lassen County.

 

On July 12, 2016, Jim Chapman placed two Agenda items Consent Agenda inappropriately in the Consent Calendar.

The long term policy of complying with the Brown Act allowed the public to pull items for discussion in the Consent Calendar because the Board attempts to approve these alleged "routine" issues with one vote.

NOW, THE CONSENT CALENDAR IS JUST BEING ABUSED WITH ISSUES THAT ARE NOT by any stretch of the imagination......routine. 

Agenda item G-5 was pulled by Supervisor Hammond. This issue was NOT A ROUTINE ITEM.  Agenda item G-7 was pulled by Supervisor Hemphill. Agenda item G-7 was certainly NOT A ROUTINE ITEM (a vote to spend $1,000,000). A separate vote the votewas taken on each Consent Agenda item (G-5 & G-7).

The Lassen County CAO recommended buying this overpriced falling apart building that was never maintained for $1,300,000.

 Now, the Supervisors have to repair this building that will end up costing over a $1,000,000. In the meantime it just sits there.......

Cindy Vonseca, from SEIU, Local 2015, is a member of a 300,000 member Union that represents long term health care workers. These workers help seniors and the disabled stay in their homes.

The Union wants a $.50 raise and Lassen County refuses to recognize the Union workers and will not bargain with their Union.

 

When Lassen County refused to give the Sheriff's Deputies a raise and pushed them almost to a Strike, Chapman never said a word when all of the Deputies came before the Board in "PUBLIC COMMENT" to protest

LMUD Director Fred Nagel & the LMUD Board, Frank Cady and Bill Stewart purchased the contaminated Hayden Hill Gold Mine. This land purchase was outside LMUD's Territory (Surprise Valley Electric territory). Nagel/Cady and Stewart then concocted this scam of selling power to area land owners for a fee of $30,000.

This person was found dead, from a gunshot,  in his home in Southern California

 

The owners, Kinross Gold, were required to remove their power lines and restore the land when the mine was closed, but sold this HUGE LIABILITY to the scam artists.  Surprise Valley Electric Cooperative, who supplied the power to the gold mine, told LMUD they would not be involved.

LMUD Attorney Eugene Chittock advised the LMUD Board to file a lawsuit against Kinross Gold to dump the property back to Kinross Gold.

The lawsuit failed and cost the LMUD ratepayers hundreds of thousands of dollars in legal fees and LMUD still owns this BOONDOGGLE.

The mandatory clean up alone will cost a fortune

In 2015, the Lassen County Supervisors approved a contract to Lionakis to do a "study" on installing an elevator at the old courthouse on Lassen Street for Supervisor Chapman's new Boardroom. 

Chapman pushed for his new Board room to be completed before he leaves office in December/2016.

Kan We Help reminded the Supervisors over and over that no money was budgeted for this and the Supervisors should concentrate on finishing the 20 year old recently acquired 2950 Riverside.

But the Supervisors approved  the Lionakis $133,000 contract anyway, but never paid Lionakis.

Public Records show that Lionakis was finally paid $62,682.50 on June 16, 2016.

 Wants the $80,000 Annual Payment

from Lassen County

for the

Community Pool by August

THE COUNTY DOES NOT HAVE IT

According to Lassen County CAO Richard Egan, the HLVRA has asked Lassen County to pay the annual payment early in August.

However, the original conditions have changed since the Lassen County Supervisors voted to take out a $4,080,000 loan  to build the new pool and purchase a building. 

The Supervisors grossly deceived the public about the use of the "loan"  and now have no money to pay the $80,000 this year or future years for annual maintenance support for Community pool (yet to be completed)

.....or remodel their new Riverside building..........

 

When Kan We Help asked what the annual payment would be, on the loan, the Supervisors refused to disclose the amount. This payment is due on June 4 of each year until 2035.

According to Lassen County CAO Richard Egan, the HLVRA has now asked, for the Supervisors, to pay the annual payment early in August of 2016.

The original conditions have changed since the Lassen County Supervisors voted to take out a $4,080,000 loan to build the new pool and purchase a building. The Supervisors can no longer use the Fund 169/Tobacco Settlement Fund to pay for the HLVRA annual payments.

 

THE FIRST PAYMENT WAS JUST MADE ON THIS LOAN

This annual $300,000 loan payment

all of the Tobacco Settlement Fund each year

 

The Supervisors told the public the County's annual HLVRA support payment would be paid from the Tobacco Settlement Fund.  There is no money left in this Fund

THIS $50,000 PLAN IS FOR "ONE" OWNER, STEVE PEZZULLO

Lassen County Planning Department Staff member Gaylon Norwood called the two Lassen County Supervisors on this Commission, District 1 Supervisor Bob Pyle and District 5 Supervisor Tom Hammond. Norwood was unable to reach Supervisor Pyle. When Supervisor Hammond was reached he claimed that he had forgotten about the meeting.

The "public comment" period for the Amedee Army Airport Land Use Plan ends on July 7, 2016.

 

NORWOOD CLAIMED THAT THIS PUBLIC MEETING

WAS NOT REQUIRED AND WOULD NOT BE RESCHEDULED

 Supervisor Hammond showed up at 2:15 PM and the meeting was convened.

Kan We Help Secretary Eileen Spencer asked the Commissioners to look at Section 2.2.2  This section would allow major land uses such as residential development (2.2.2 (g)) within the 2.8 mile Area of Influence of the Commission.

 

Any of the actions listed in Section 2.2.2 would need to be reviewed by the ALUC (Area Land Use Commission), however Supervisor Hammond asked that Section 2.3 be removed in its' entirety.

Sierra Army Depot representatives were present and told the Commissioners that they would be open to sharing the Army's airfield.

Of course, this was a

total lie

 and they both knew it.

The Lassen County Supervisors attempted to include the East end of the Army's Airfield in the RFP but the Supervisors were stopped when Kan We Help exposed this.

Lassen County was given the Army's Airfield and surrounding land (over 3,000 acres) in the 2002 Army Agreement with the stipulation that the Army would have a 50 year lease on the Airfield (with a 50 year additional option).

 The County had every intention to include the East end of the Airfield in the sale to Steve Pezzullo.

The County then intended to transfer the 50 year Lease to Pezzullo. It failed because it was discovered in time to create a new parcel number for the East End of the Airfield and exclude the Airfield from the final documents.  

 

 

 

NOTE:

 The two Sierra Army Depot representatives below met secretly with Steve Pezzullo and Supervisor Hammond during the "public bidding" process for the Amedee Parcels. 

This of course was unethical and should have excluded Pezzullo from bidding........

Steve Pezzullo included these meetings in his proposal to state that he was in negotiations with the Army and claimed he could use the Army's Airfield for any business that he would develop next to the airstrip. 

If adopted, this Land Use Plan would also allow

daily Army aircraft landings

from 2 to 20 in Herlong

Lassen County Pays Off  RBEG Grant

Lassen County Supervisors voted to close the "Business Parks" in Westwood and Bieber and transfer the maintenance of these buildings to Public Works.

The Lassen County Auditor announced that Fund 588 would be closed and the remaining balance of approximately $20,000 would be transferred to the "General Fund".  These funds are RESTRICTED and cannot be placed for general use, but they did it anyway?

In 2015 and again in March of 2016, Kan We Help challenged the $50,000 suddenly being placed in Fund 588. It appeared the Supervisors never intended to convene the Community Development Commission to legally take any action on the Westwood property. After Kan We Help challenged this action again, a check for $50,000 was sent to USDA to repay the Grant on June 9, 2016.

This warehouse, in Westwood, can now be used by Lassen County unrestricted.

Kan We Help suggests the remaining funds that were moved to the GENERAL FUND be used to move the Sheriff into this building............ASAP

Undersheriff John Mineau made the presentation for Sheriff Dean Growden who was not present.  Mineau made it perfectly clear the Department needs to change if they want to keep staff.  He stated that if a Deputy is promoted to Sergeant they would lose $100 in pay.

This new Ordinance goes into effect in 30 days and was enacted to allow Steve Pezzullo and friends (aka HSP Resources) to develop within the 2.8 miles of the Army's Herlong Airfield.

District 4 Supervisor Hammond continues to lie to his constituents that the Army's Airport in Herlong will be a "PUBLIC AIRPORT".  The Army has a 50 year lease with Lassen County with an option of an additional 50 years (the lease was a condition of the transfer of Army land to the County)

Steve Pezzullo & friends have done absolutely nothing for the town of Herlong that they bought for $31,500 (and is selling off parcel by parcel) from Lassen County and the 3,000 acres of contaminated public land for $25,000.

 

Pezzullo now only has to deal with securing "permits" from the Lassen County Planning Department and wait for the inevitable  approval of the poorly written "Amedee Army Airfield Land Use Compatibility Plan" that has no enforcement capability whatsoever.  

This so-called "Plan" does not address Federal Aviation restrictions for military airports but makes considerations as if it was a "public" airport

The public cannot expect the Supervisors to "police" themselves.

There is no incentive to do that. 

The Lassen County Board of Supervisors each trade votes to accomplish personal agendas. Overlooking abuses of other Supervisors so they will overlook their abuses.  A Quid Pro Quo, within the Board, has existed for a very long time. A practice that has become so accepted that new Supervisors coming in will believe that it is legal and moral to "help yourself".

 

Violations of ethics such as conflicts of interest, violating Board policies when it expedites a Supervisors effort to help a friend or just for personal gains is a standard on this Board, violating the Brown Act as though the law was non-existent and unenforceable.

Chapman's recent actions, as Chairperson of the Board of Supervisors, has become an accepted practice even though it is illegal and unethical. Some Chairpersons have chosen to go the straight an narrow and follow the law and practice honesty.

CHAPMAN HAS NOT

The Brown Act allows for the public to comment on "any" Agenda item. The Lassen County Supervsors have had a long standing policy, in compliance with the Brown Act,  to allow the public to pull "Consent Calendar" agenda items for discussion.  The Supervisors changed this so they can hide issues and act on them inappropriately and  illegally

 

 

March 22, 2016, Consent Calendar Agenda G-2

 

 

Chapman placed this item in the Consent Calendar so that the public could not comment. Fund 150-1501 did not have sufficient funds to pay for this work and would have required a 4/5 vote to increase this budget item.

If you place it in the Consent Calendar the public cannot comment that there isn't $189,792 in that Budget and that there is only $150,000 in the Susanville Memorial Building.

THE DECEPTION:

NO PUBLIC COMMENT WAS ALLOWED AND NO 4/5 VOTE LANGUAGE WAS INCLUDED IN THE "ACTION REQUESTED" DESCRIPTION. WHERE WILL THEY GET THE EXTRA $50,000 ?  

 

April 12, 2016, Closed Session abuse

County Counsel, Bob Burns,  placed a $2,233.09 Settlement check from an Illinois class action lawsuit (which Lassen County was not a party to but simply benefited from) in Closed Session. This issue did not remotely fall under the Brown Act requirements for a Closed Session issue.

 

 

THE DECEPTION:

This was not a closed session item, so what did the Supervisors discuss?  This was a regular agenda item. The public was not afforded the right to comment.

Bob Burns announced that the Board left it up to him whether to deposit the check or send it back?

Supervisor Chapman placed this item in the "Consent Calendar" to approve funding for the future 2016/2017 Budget ? This would have required a 4/5 vote by the Board and was not an item to  hide in the Consent Calendar.  Supervisor Hemphill did not recuse himself from this vote (Craig Hemphill receives this money).

THE DECEPTION:

THE PUBLIC WAS NOT ALLOWED TO PULL THIS ITEM AND NO SUPERVISORS PULLED IT FOR DISCUSSION. THIS WAS NOT AN ISSUE TO BE PLACED IN THE CONSENT CALENDAR.

 CRAIG HEMPHILL'S $79,117 2015/2016 CONTRACT EXPIRED ON JUNE 30, 2016 AND THIS ACTION EFFECTED THE 2016/2017 BUDGET.

Approving a future Budget item expense  not "ROUTINE IN NATURE". Bob Burns placed a 2016/2017 expenditure in the "Consent Calendar". This was not pulled by any Supervisor for discussion. The public was not afforded an opportunity to comment on Agenda item G-8

THE PUBLIC WAS NOT ALLOWED TO PULL THIS ITEM AND NO SUPERVISORS PULLED IT FOR DISCUSSION. THIS WAS NOT AN ISSUE TO BE PLACED IN THE CONSENT CALENDAR. THIS ACTION PROVOKES SECRECY AND ELIMINATES ANY SCRUTINY BY THE PUBLIC.

This Agenda items was one of those shady "land deals" Lassen County Supervisors are so famous for.

Previous Pezzullo deals resulted in giving him thousands of acres of public land for $56,500 and "Town Center" rezoning for property around Pezzullo's Herlong property and the One Stop building in Herlong which he gave back because he couldn't sell it 

This was not a "Consent Calendar" issue and was placed in the Consent Calendar to avoid public scrutiny.

The public was not allowed to comment on this and now we know why?

 

The Supervisors intentionally did not use the Valceschini/Cramer  name in the Agenda description. This was not a "ROUTINE IN NATURE" issue. The Valceschini/Cramer family  built a house on the 142 acres ten years ago and now, because of the restrictions on the 142 acre parcel, could not carve out another 5 acre "residential" parcel for ten (10) years.

  However,  the Cramer's are developing the "Cramer Ranch Estates" between these two parcels,  in which they plan to sell residential lots. What does Pezzullo or Larry Smith Realty have to do with this?   Steve Pezzullo attended this meeting and left after Supervisor Chapman refused any public comment on this "Consent Calendar" agenda item .

More public money for a study of Supervisor Chapman's "elevator" was placed in the Consent Calendar to avoid any public comment.

THE DECEPTION:

The Supervisors did not place any money, for any renovations to the Courthouse,  in the 2015/2016 Budget because they intended to purchase and remodel the building at  2950 Riverside in Susanville ($1.3million dollars for the old BLM building).

Lassen County CAO Richard Egan decided not to do an "inspection" prior to the purchase.  Did he know that if he disclosed the terrible condition of this building the Supervisors would not purchase it ?

When the Supervisors borrowed $4 million dollars they told the public that they were going to use the money for the Community pool, purchase the old BLM building and remodel the Courthouse and Administration buildings.

With only $1.273 million remaining of the loan and the Supervisors have no idea the costs of finishing their newly acquired 2950 Riverside building, why

*At the April 12, 2016 meeting, Chapman puts 18 of the 27 Agenda items in the Consent Calendar. 8 of the 18 were pulled for discussion by the other Supervisors. So much for routine. 

*The Consent Calendar issues are supposed to be "routine in nature", but that is the last thing these "untouchables" are. The Consent Calendar is approved with one sweeping vote and Chapman, unlike Supervisor Pyle, will not allow any item to be pulled for a separate vote and discussion by the public.

At the upcoming April 19, 2016 meeting, Supervisor Chapman has placed

8 of the 12 Agenda items in the "Consent Calendar".

County Counsel Bob Burns

Former Lassen County District Attorney and now County Counsel Bob Burns placed a California Settlement Case illegally in Closed Session.  Burns claimed that this case was an "existing" case but in fact it was a copy of a Final  "Settlement"  Notice. 

Lassen County was never a part of this lawsuit but benefited from this Class Action lawsuit.

Bob Burns didn't know the difference...........

This case does not remotely fall within Government Code Section 54956.9 of the Brown Act. This lawsuit simply reflected a "final decision" by an Illinois Court.

 

This was an issue that should have appeared on the Regular Agenda or they could have hidden it in the "Consent Agenda". 

Brown Act Section 54954.5 (a) allows for "existing" litigation to be placed in "CLOSED SESSION" if it would jeopardize service of process or settlement negotiations.

Burns took this issue into Closed Session for a $2,233.09 settlement check Lassen County received on a settlement received from the State of California. All that was required was for the Board of Supervisors to accept/reject this money. 

This was an Open Session issue and Burns did not know that ?

 

 

Settlement documents are discloseable and must be discussed in Open Session.  Burns did disclose the Settlement documents from his illegal Closed Session but violated the Brown Act by stupidly placing this in Closed Session. 

 

FYI: No excuses can be made that he no longer had an Assistant. [Attorney Stephanie Skeen is no longer in his Department. Ms. Skeen was moved to the District Attorney's office permanently.

A member of the SEIU (Service Employees International Union) asked the Board of Supervisors, in Public Comment,  what Budget their contract is paid from. Bob Burns interrupted and advised the Chairperson not to answer?

Chapman has spent thousands of taxpayers dollars on many studies over the years [over $200,000] to have a new Boardroom. Presently, the Board meets at 707 Nevada Street.

This location does not have an elevator. 

 Chapman needs an elevator.

So Chapman pressured the other four to spend $ 65,000 for another study on just the "elevator"...........

 

The study Chapman doesn't want to talk about was the study done in 2014. It put the cost of moving the Supervisors and staff to a new location (the old courthouse on Lassen Street in Susanville) from $862,500 to $1,425,000.

After 8 months, the Supervisors have  not remodeled the offices for the District Attorney, Public Defender, Child Support Services and Probation in the old BLM building on Riverside.

Keep in mind that the Supervisors are going to use the same pot-of-money.

More than $800,000 for the BLM building and more than a $1,000,000 for the Board's new digs

There is $1,273,496.65 left of the Certificate of Participation loan and the Supervisors still are not even close to moving the four County Departments into the $1,300,000 building .

  THE SUPERVISORS COULD MOVE THE AUDITOR TO THE EMPTY OFFICES BELOW IN THE ADMINISTRATION BUILDING AND REMODEL THE AUDITORS SPACE FOR THE NEW BOARDROOM, LEAVING STAFF WHERE THEY ARE.

 Pezzullo failed to get the Amedee Airfield when Kan We Help filed papers that stopped the Board of Supervisors from including the Army's airfield in the thousands of contaminated Amedee parcels of public property the Supervisors gave Pezzullo and his partners for $25,000.

County when he ran for Assessor.

DA Montgomery attempted to prosecute the Assessor from Pezzullo's complaint. Fortunately, the DA's case fell apart in court when the case Montgomery filed was dismissed.

The Consent Calendar Rule Section 5 E has been in effect for decades allowing full and direct comments by the public.

 

 

On September 8, 2015, former District Attorney and now Lassen County Counsel Bob Burns pushed Supervisors to change the rule to violate the Brown Act. The advantage for the Supervisors was to put the majority of agenda items in the Consent Agenda to eliminate any public comments.

Kan We Help filed a Brown Act Complaint, against LMUD after suddenly all Agenda items had  "INFORMATION ONLY" on Agenda items to eliminate any public comment.

 LMUD General Manager Frank Cady boasted that District Attorney Bob Burns said it was legal.

In 2007, LMUD Director Fred Nagel, Accountant Bill Stewart and General Manager Frank Cady wrote a check for $65,000 for a worthless piece of land. Frank Cady and Fred Nagel did not inform the LMUD Board that the land needed $300,000 worth of mandatory restoration from the gold mining and that Surprise Valley Electric had no intention of bringing power back down to the gold mine. 

 

 

 

LMUD Director Fred Nagel claimed that Frank Cady had no legal right to purchase this land even though the LMUD Board approved the purchase and  Fred Nagel  signed the check

 

Nagel 's remedy was to file a lawsuit on January 27, 2011,  to void the purchase.  After 5 years of shameful litigation and hundreds of thousands of dollars spent LMUD asks the Court to dismiss the lawsuit with prejudice. The Court vacated the April 11, 2016 trial and granted LMUD a "Motion to Dismiss".

NOW LMUD WANTS TO RAISE THE RATES (SERVICE CHARGE), ON MARCH 22,

TO WASTE MORE MONEY ON THE 230KV FOLLY THAT DOESN'T EXIST AND WILL NEVER EXIST.

LMUD has amassed millions for this fake project and now they want to raise more money that will sit in their bank accounts.

The Brown Act requires the Public Entity to respond to Complaints:

"Within 30 days of receipt of the demand, the legislative body, shall cure or correct the challenged action and inform the demanding party in writing of its action to cure or correct or inform the demanding party in writing of its decision not to cure or correct the challenged action

Lassen County CAo Richard Egan placed the majority of the Board of Supervisor's Agenda in the "Consent Calendar" (13 items).  CAo Richard Egan has abused the "Consent Calendar" more than anyone else in the history of Lassen County government.   He places Critical/Controversial issues in the Consent Calendar hoping no one will notice, including Supervisors. This Agenda category is voted on with one sweeping vote.

FUNDS WERE "NOT" AVAILABLE WITHIN THE SHERIFF'S DEPARTMENTS BUDGET

During the Budget process, Egan, Pyle and Chapman placed the $50,000 in PUBLIC WORKS  Fund 588/Budget 943/Account 3002800 (paving).

 

CAO Egan and Supervisor Chapman were quick, to deny,  that funds were being taken out of FUND 588 [PAVING], but Public Works Pete Heimbigner was quick to confirm the fact that the $50,000 is being taken out of "Paving" to pay back the USDA Grant.

 

 

The Sheriff's Department's budget is bare bones so $50,000 was placed in the the WESTWOOD PARKING LOT ACCOUNT, to pay back the USDA Grant, with the hopes that no one would notice

The Sheriff told Kan We Help that he has no idea how much money it will take to use and maintain the Westwood warehouse.

 

The Supervisors have a bigger problem:

Public Records indicate that the LCCDC never met to transfer ownership of this property

 

 

A similar stunt was performed when $142,000 was placed in the WESTWOOD LIBRARY FUND to replace the Library roof [ that was never done]. The Funds were used in Beiber

FIRST:

Lassen County CAo Richard Egan & County Counsel Bob Burns prepared the February 23, 2016 Lassen-Modoc County Flood District Agenda, placed the required Legal Notice in the Lassen County Times but told the Modoc CAO Chester Robertson that he did not need to take out a Legal Notice in the Modoc County Record (A weekly publication that is circulated on Thursdays)  Brown Act 54954.6.

THE BROWN ACT REQUIRES THAT MULTI-AGENCY PUBLIC ENTITIES MUST EACH POST LEGAL NOTICES FOR PUBLIC HEARINGS IN A NEWSPAPER OF GENERAL CIRCULATION WITHIN ITS JURISDICTION.

 

SECOND:

Lassen County Counsel attempted to run the meeting with numerous interruptions.  Bob Burns told Chairperson Wills that he could "recess" the Lassen-Modoc County Flood Control Board and open the "Special Joint Meeting of the Lassen County and Modoc County Board of Supervisors" meeting scheduled for 2:00 PM

The Agenda for the Flood District had been approved with no additions or deletions and there was nothing on this Agenda that would allow another meeting to take place during the Flood Districts meeting. The Flood District would have to adjourn and reconvene, but Burns new the restrictions on that route. He then suggested something that he knew to be "illegal".

Immediately after the Flood Districts "recess" Lassen County Supervisor Jim Chapman opened the "Special Joint Meeting".

 

While the Brown Act allows meetings/discussions between public agencies, it does not allow a public entity to take action/votes outside its jurisdiction. This meeting was held in Modoc County so the Lassen County Supervisors could only "discuss" issues during this "Special Joint Meeting". Brown Act Section 54954 (b)

After six months of studying "space needs" and $37,335 later, the County is no closer to moving four County departments into the old BLM building at 2950 Riverside, Susanville.

The Supervisors told the public that this building could be purchased and remodeled for  $1.7 million. However the County paid more than the property was worth [$1.3 million] and the improvements that need to be made have far exceeded the original estimates.

The County has $1.3 million left of the Certificate of Participation loan

MOST OF THE $1.3 MILLION WILL BE USED TO FIX THIS BUILDING........MAYBE ?

Lassen County CAO attempts to increase a budget line item that didn't exist

 

Kan We Help is watching the 2015/2016 Budget  very closely and told the Supervisors at the January 9, 2016 Board of Supervisors that Fund 100/Budget 0062/Account 3000131 did not exist

CAo Egan was quick to tell the Supervisors to ignore this comment because Fund 100/Budget 0062/Account 3000131 did exist.

WELL, IN FACT  THIS LINE ITEM DID NOT EXIST

 

It is disturbing that the CAO can move money from one account to the other without the Supervisors ever knowing. As CAO he has the legal right to do this, but there are rules on "HOW" he does it and "WHERE" he does it. 

The Westwood Library account is a good example.  $142,000 was moved into this account and spent (over a number of years) to re-roof the small library in Westwood, but the Westwood Library has never been re-roofed.

This is a $7,000 job.

The Parks Budgets have been mis-used also.

Public Works Director Larry Millar has NO EXCUSES WHY THIS ROOF HAS NOT BEEN REPLACED.

Supervisors Pay Records Altered

Kan We Help has been requesting the Supervisors pay records for several years and we were disappointed that

"someone" made a decision to alter the payroll records.

This is the document Kan We Help received, on August 31, 2015 last year. The pay record shows that Supervisor Chapman received a base salary of

$40,534.83. This equates to 80 hours a pay period (26 pay periods in a calendar year)

Without any pay increases during the fiscal year 2014/2015 Supervisor Chapman's total "gross" pay was $40,534.83

 

The Ordinance that regulated the Supervisors pay during the 2014/2015 fiscal year stated the Supervisors pay was $35,485

There is no provision for any other pay, including longevity "pay" ( a bonus that is included in the Budget each year)

 

Kan We Help requested the Supervisors Pay Records after the Supervisors gave themselves a raise. The request was delayed until February 10, 2016.

and now we know why

They altered the "Amount", in the pay records,

to equal the

"legal Ordinance pay" of $35,585 for Albaugh and Hammond, but in Chapman and Pyle's case it still came out to $39,033.54.

Chapman is obsessed about getting the new Board room while he is Chairperson

and has announced now that it would be done before  he leaves office in January/2017

 Dream for Susanville Ended

The Chamber of Commerce is a privately owned business that represents the philosophy of  Republicans (not that this is a bad thing to represent a political party, but just a fact).

The Chamber often comes to the Board of Supervisors asking for money. Money for a fake Christmas tree for the town of Susanville.  Most recently, the Supervisors gave this business $5,000 to enter a contest.

This contest ended and more than $50,000 was donated and spent for this contest.

What did the County get for $5,000 ?

NOTHING

The Lassen County Chamber of Commerce spent the $50,000 on CONCEPTS

 

MAYBE THE CHAMBER OF COMMERCE CAN SHARE

 So why did these three, Albaugh, Hammond, Hemphill,  discount the facts?  Just Consider the history of these three Supervisors. What did Hammond get? Hammond is a Supervisor for Sale.  Hemphill is just remarkably dumb. Albaugh, did this for Brian Dahle.

 Brian Dahle has publicly stated that he wants to be the first Governor of the new State of Jefferson.

Newly elected (January/2015) District 3 Supervisor Jeff Hemphill does not give Board Reports when asked ( A report of what he has done to earn a paycheck). Hemphill just Passes.

 He has had a month off and he reported NOTHING at the Board of Supervisors meeting on January 12, 2016 which is typical. Hemphill sits on this Board and waits for instructions from Pyle or Chapman. Chapman and Pyle control what Hemphill says and does. 

 

Hemphill has had 12 months to DO SOMETHING, ANYTHING and all he has added to the meetings are crude offensive remarks about Supervisor Albaugh's private parts, his political opinions on who should be President....all of which have no place at a Board meeting.

Hemphill makes Motions for Pyle and Chapman and when asked what the Motion means, he looks like a deer in the headlights. 

 .....What motion, did I make a motion. Chapman, hand me that motion again. Hey, I need a little help here !

We will not say he is the dumbest and laziest Supervisor who ever sat on the Board.

 

NO, WE WILL NOT SAY THAT.
