LMUD attorney lies about UAMPS contract

The UAMPS contract signed on November 13, 2008 stated that the original agreement with UAMPS (Utah Associated Municipal Power Systems) was February 17, 1999. NOT TRUE.

LMUD cannot produce any agreement with UAMPS earlier than  December 26, 2006.

This was typical dishonesty from the "Cady trained"  Jones and Langston.  There was no February 17, 1999 agreement with UAMPS as stated in  the "November 13, 2008 UAMPS contract" presented to the LMUD Board to approve.

 Also, Cady and Jones falsely represented LMUD's involvement on December 26, 2006. The LMUD Board, Cardenas, Sargent, Wood, Nagel and Langston passed a "First" and "Second" amendment to a NEW agreement so it appeared to be an OLD existing contract.......this is starting to look like the new "Arrowrock" scam

Cady's PDCA intentionally bypassed the CPUC requirement for "Public hearings" for LMUD rate increases.

In November 2005, the new LMUD General Manager, Frank Cady (former LMUD General Counsel ) and the corrupt LMUD Board (Cardenas, Sargent, Wood, Langston and Nagel) diverted attention from the "No public hearing PDCA" policy by placing the outrageous increase of the $3.50 service charge to $25.00 first. The public packed the LMUD meeting to object to this excessive increase. THE LMUD BOARD INCREASED THE MONTHLY SERVICE CHARGE TO $8.00 (This charge has now increased to $10.00 a month)

This was just a smoke screen.

Soon after the LMUD Board would quietly enact the PDCA policy that would eliminate the PUBLIC HEARINGS FOR RATE INCREASES........ that were REQUIRED and MANDATED BY THE CPUC.

KWH immediately submitted a substantial complaint to the LMUD Board objecting to the elimination of public hearings for rate increases. Jaimee Jones, Frank Cady and the LMUD Board totally ignored the complaint.

The bubble burst, in 2007, when Nancy Cardenas and George Sargent resigned from the LMUD Board. Shortly after that Darrell Wood resigned from the LMUD Board. The two worst Board members, Langston and Nagel didn't have enough honor to resign.

The Lassen County Board of Supervisors appointed three new LMUD Board members and their first order of business was to FIRE FRANK CADY.

However, these new Board members (Bowden, Lavacot and Dow) didn't finish the job. Jaimee Jones, Bill Stewart and Paul Glau were just as much responsible for this corruption.

THE ELECTRIC RATE WAS 11.5 CENTS PER kwh when Cady was hired as General Manager in 2005. THE RATE QUICKLY INCREASED TO 14 CENTS TO SUPPORT A "lifestyle". 

The LMUD ratepayers must decide where their tolerance level is. Presently, there is no justification for a rate of more than 11.5 cents per kwh. LMUD is stockpiling millions in the "Stabilization Fund".

 Bill Stewart has been giving the LMUD Board BAD NUMBERS for a very long time and needs to be replaced.

Jaimee Jones has been giving the LMUD Board BAD ADVICE for a very long time and needs to be replaced.

There is a very good reason why LMUD Boards spend $300,000 a year for their General Counsel.

It keeps them out of jail.

Kan We Help complained, at the LMUD meeting (in writing),  that Jay Dow and Matt Lavacot could not participate in any discussion of "special" reduced rates or "deals"  for the Ag community. General Counsel Jaimee Jones told the Board that they could but the Grand Jury said they can't.

Kan We Help complained, at the LMUD meeting, that the three newly appointed Board members, Bowden, Dow and Lavacot, could not approve six months of LMUD minutes (that Frank Cady & Jaimee Jones withheld) because they did not attend any of those meetings. General Counsel Jaimee Jones told the Board that they could approve the minutes.

Jones allowed hazardous waste to be moved with phony papers.

Jones allowed the illegal purchase of contaminated property.

Jones allowed Frank Cady to hide his expenses and the Board expenses.

Jones allows private use of public funds.

Jones allows the private use of LMUD employees.

Jones continues to allow Brown Act violations

Jones allowed Cady's "abusive  behavior" towards the employees for five years and did nothing

Jones refused to correct the LMUD Ward Map to exclude the PSREC district. Fred Nagel lives and votes within the PSREC District which disqualifies him to sit on the LMUD Board.

Jones padded her Arrowrock invoices with literally thousands of dollars of phony charges. ($800 for a one page document, non-existent Board meetings, overcharges for work that was never used.......)

Jones allowed "phony" projects to proceed, costing LMUD ratepayers hundreds of thousands of dollars.

..........so why do the ratepayers need to retain the $300,000 Jaimee Jones? 

Simple: TO KEEP THE LMUD  BOARD MEMBERS OUT OF JAIL.

This "joint" Arrowrock Feasibility Study was, in fact, completed in October of 2001. LMUD Ratepayers paid at least $150,000 for the completion of this report and Frank Cady went in to court and lied.

Worse:  Kan We Help collected evidence that indicated that the
Arrowrock Feasibility Study was completed and filed a Writ of Mandate, in December of 2002, to get a copy of the Arrowrock Feasibility Study. Nagel and Cady claimed it was  a "Draft" . Judge Lazard (since kicked off the bench) refused to even look at the Feasibility Study. KWH lost their attempt to obtain a copy of this study. This kept Cady and the LMUD Board out-of-jail.

LMUD and the Arrowrock Irrigators issued a Request For Proposal and used the "COMPLETED" Arrowrock feasibility study. Aqua Terra told KWH  that they invested over $200,000 in their bid for this project. Their bid relied upon a copy of the "completed" Arrowrock Feasibility Study dated October 2001.

The Susanville Social Security office, at 2603 Riverside, continues its attack on the disabled. This office has had a 100% turnover in the last 8 years. Leslie Rule is now the District Manager (five managers in the last 8 years) and continues to harass the disabled with threats to stop their entitlements.

 Now, she is actually doing it.

These may sound like harsh statements but the fact is that they are picking on the very people that cannot defend themselves.

The disabled are being sent letters that say "your disability has ended". This includes the physically and mentally disabled. This is occurring to American citizens that have qualified for social security benefits for 20 years or longer. Now, they are being thrown out in the street because these "trained monkeys" have made the determination that suddenly your poverty level earnings are "significant gainful activity".

Historic Uptown Susanville Association dissolved by Susanville City Council

HUSA was wrought with complaints of mismanagement and finally was dissolved by the Susanville City Council yesterday. Jack Helsel, the first President of the association, stated that HUSA no longer was serving the merchants. This 18 year old association was dissolved.

Uptown merchants were required to pay into this association. Earlier this year Supervisor Jim Chapman (who owns a business within HUSA jurisdiction) fought to be taken out of the HUSA district and was successful in his effort to withdraw from HUSA.

Dyer Mountain Associates LLC sold on steps of Lassen County Court house in foreclosure to Dyer Mountain Holding LLC.....(?) an offshore company.

Traditionally Judge Bradbury has appointed LMUD counsel and LMUD management to the Grand Jury, so LMUD complaints, in the past, have not been acted on but suppressed. Judge Bradbury was a partner with Frank Cady and Craig Kellison in a real estate company that was known as BKC.

LMUD President Bud Bowden gets OKAY, from District Attorney, to replace Jay Dow from the LMUD Invenergy Ad Hoc Committee.

LMUD President Bud Bowden appointed Jay Dow to the Invenergy Ad Hoc Committee and the Lassen County District Attorney says he has the authority to remove him and he did.

Jay Dow has demonstrated that he cannot be impartial and has voted, in the recent past, to give the Agriculture community kick backs on their electricity bills. Dow is also in the Cadyite group that wants to sign the agreement for wind mills in Lassen County. This will benefit the Darrell Woods' and Frank Cadys' of the community.

LMUD General Council, Jaimee Jones (Frank Cady's legal partner), objected to Bowden removing Jay Dow and replacing him with Matt Lavacot. Jones will most likely work now, towards President Bowdens removal.

Jones tenure under Frank Cady has always been tainted with cronyism and questionable actions. She has shown little competence in the last six years. She is owned lock stock and barrel by Frank Cady, Fred Nagel, Wayne Langston and Darrell Wood.

LMUD ATTORNEY JONES CLAIMS THAT LMUD BOUNDARIES ARE COUNTY WIDE and anyone living within Lassen County can run for the LMUD Board.....not true.

These five beautiful dogs will be destroyed if not adopted by August 21.

Former Susanville Police Chief Gallagher removed from his new Chief of Police position in Los Banos

Chris Gallagher sat at every LMUD meeting ready to throw the public out that dared to exercise their First Amendment rights.

Los Banos's official position (209-827-7070) is that Chief Gallagher will be gone an "indefinite time".

It appears that former Susanville Police Chief Chris Gallagher took his baggage steamer trunk with him to Los Banos. Gallagher was physically removed, 8/5/08, from a public meeting and has not been to work since that incident. Commander Dan Fitchie has been named Acting Police Chief.

Gallagher was physically removing citizens from public meetings while they were attempting to address issues during public comment. Sound familiar, Susanville.

LMUD attorney refuses to correct LMUD boundary map

Lassen County has four separate utility companies, PGE, PSREC, Surprise Valley and Lassen Municipal Utility District. Each of these utilities have their own "service" boundaries and each have their own Boards.

LMUD refuses to identify the PSREC territory in Lassen County on their Boundary Map.

LMUD annexed the Dyer Mountain Area and they will provide electrical service to this area. There has been no PSREC territory annexed by LMUD.

PSREC does not allow LMUD customers to serve on their Board.

However, when the PSREC Board approached LMUD to purchase the Herlong customers  the LMUD Board resisted and said NO. These customers were considered to be LMUD's most profitable income base.   PSREC then put two PSREC customers on the LMUD Board. Wayne Langston and Fred Nagel. The purchase was then approved but PSREC reneged on the payments to LMUD. When KWH inquired about the payments, LMUD refused to respond to requests for payment verification. PSREC was to pay LMUD $150,000 annually until 2010. ($1.2 million dollars ????)

Nagel and Langston approved thousands of dollars for bogus PSREC energy projects. LMUD money down the toilet.

Nagel and Langston approved every single rate increase to LMUD customers.

Langston finally moved into his LMUD Ward after the 2002 election. Nagel has always lived in the PSREC district.

Lassen County Clerk turns "Nagel" issue over to District Attorney

The District Attorney can't change the law but he can certainly ignore the law for his friends

The Lassen County Clerk, Julie Bustamante, has never approved Fred Nagel to be a candidate for the LMUD Board. Former Lassen County Clerk, Teresa Nagel, approved her husband to run for the two previous LMUD elections knowing that he did not live "within" any LMUD Ward.

Teresa Nagel then conspired with her husband to omit their PSREC district from the LMUD Ward Map.

The PSREC service area, where Fred and Teresa Nagel live, is exclusively a PSREC electric service area. The Nagels have never lived "within" any LMUD Ward.

The "special districts" boundary maps are based solely on a District's legal service territory.

LMUD cannot have customers in the PGE service area.

Surprise Valley Electric District cannot have customers in the LMUD service area.

Lassen Municipal Utility District has deliberately submitted a boundary map to the Lassen County Clerk and the Public that omits the PSREC service area in Lassen County.

Yet, Julie Bustamante has provided "this precinct map" that excludes some  of the PSREC boundaries. PGE has been defined (left) and Surprise Valley Electric (top) has been defined. Sierra Army Depot (right) has been defined but certain PSREC boundaries have not been defined...........Fred Nagels

 This issue has certainly been pointed out to Bustamante, but she continues to claim that this map is accurate. Bustamante's map and LMUD's map conveniently omit the PSREC  territory where Fred and Teresa Nagel live.

Rates were "consecutively" increased under the UNFAIR PDCA Rate Schedule for three quarters. Electric rates at Lassen Municipal Utility District were raised on 12/31/05,  3/31/06  and  6/30/06.

 In fact power costs had stabilized.

The gates open at 11:00 AM and close at 11:00 PM. Daily admission prices are $5.00 for adults, $3.00 for children 6 to 12, $3.00 for seniors  and children 5 and under are free. Sunday, July 20th, is free admissions day and the last day of the Fair.

LMUD attorney, Jaimee Jones, sends more than questionable invoices in response to a Public Records Request

Jones made up invoices for the Public Records Request. The invoices sent do not have LMUD's receiving stamp nor do they have any Bate stamps (pages numbered).

The biggest hint was that they do not match the amounts actually paid to her.

Jones invoicing is nothing short of screwy. This is supposed to confuse the Board members who are supposed to be approving this mess.

The Public Records Request was for Jones Nov/07-May/08 Retainer invoices and Extraordinary invoices. As you can see  she fell short of complying.

Just poor management allows this attorney to charge these amounts. If this little utility has to pay $20,000 a month for legal work, somebody is DOING SOMETHING VERY WRONG !!!!!!!

 These invoices that were provided by Jones appear to have been "created" for the PRA request. They are not stamped by LMUD nor do they have any numbers on the pages.

NOTE: The redacted portion, on this invoice, is Jones 457K retirement payment. LMUD takes $1,250 for her LMUD retirement each month.

Bill Stewart knew that LMUD could not make a one cent increase on July 1, but he recommended it because he thought he could get away with it. WELL, HE DIDN'T

The next quarter ends on June 30 and LMUD plans on hitting the ratepayers up for another half cent increase on September 1.

The PDCA should have been legally challanged. The California Public Utility Commission requires a HEARING BEFORE ANY RATE INCREASES.  Frank Cady, Wayne Langston, Fred Nagel (the only remaining LMUD Board members that didn't have enough integrity to resign) pulled off the infamous PDCA that eliminates a public hearing on rate increases and allows the General Manager to raise rates at will.

General Manager, Ray Luhring and LMUD Controller, Bill Stewart have intentionally misled the public on the alleged $800,000 cutbacks.

LMUD has never considered any Capital Improvement to be a priority. LMUD has historically rolled over the capital projects BUDGET from year to year. This $800,000 is budgeted but never spent on Capital Projects. This claim by LMUD management was an intentional deception. LMUD'S Capital Improvement Budget HAS BEEN nothing more than a SLUSH FUND.

There has been no accountability on the NET incomes reported each year and this amount is in the millions of dollars..............

To the average ratepayer this would mean that there was "left over" money. But with LMUD's voodoo budget, that money is spent, spent and spent. You only have to look at where the budget keeps increasing.......COST OF OPERATIONS.

There is no justification for any increases, including the Service Charge at this time. Any increase will only give the LMUD Board and LMUD management a LICENSE TO CONTINUE WITH THEIR HISTORICALLY AND MONUMENTALLY BAD MANAGEMENT.

LMUD Legal Fees Remain in the Stratosphere

Lassen Municipal Utility District paid $23,970.15 in legal fees to Jones, in the month of April.

This public board has no capability or inclination of bringing these expenses under control. They just pay these ridiculous invoices. They have retained an attorney that takes 10 times longer to accomplish a simple and redundant task than an experienced attorney.  LMUD has less than 10,000 customers.

This LMUD Board has no ability to change what Frank Cady set up in 2002. In 2002, he brought Jaimee Richey /Jones in to replace him in 2005 when he planned to take over LMUD.

The CPUC Division 6, which governs LMUD, requires an attorney to be practicing law for a minimum of 3 years to be hired as general counsel.

Keri Richards current job title is Office Manager. She uses her credit card to purchase office supplies, equipment, etc. However, you will find travel expenses for employees on this credit card. No Expense Reports are ever filed.

Ray Luhring is now charging his secretary's travel expenses to his LMUD credit card.

And why does his secretary NEED TO TRAVEL..............? It appears that Luhring is letting Karen Rollings do a little bit more than her job description....????

LMUD Elections on November Ballot

Ward 1, 2, 4 & 5 will be on the November Ballot

LMUD Ratepayers will have until August 8 to file for one of the four seats that will be on the November ballot.

According to the new County Clerk, only registered voters that live within the LMUD Wards will be allowed to file for these seats. LMUD is required, as all Special Districts, to submit a list of their ratepayers to the County Clerk in order to prepare the ballots.

 This process prevents a PSREC or PGE customer from running for the LMUD Board

FACT: Fred Nagel has always been registered to vote in the Plumas Sierra Rural Electric Cooperative District. He does not qualify to sit on the Lassen Municipal Utility District Board. Fred Nagel is only qualified to run for the PSREC Board, not LMUD.

FACT: Wayne Langston, the Nagels son-in-law, lived in the Plumas Sierra Rural Electric Cooperative when he was appointed and continued not to live within Ward 3 through the next LMUD election. Langston has NEVER been on a LMUD Ballot and has never received one single vote.....EVER.

LMUD calls special meeting, on May 14, for "Invenergy" after Lassen County Supervisors overturn the Planning Commission decision not to approve windmill test towers

Lassen Municipal Utility District wasted no time to bring *Invenergy back to the LMUD Board after four Board of Supervisors (Hanson abstained) overturned the Planning Commissions decision not to approve the wind test towers for Invenergy.

*Invenergy now has opened an office at 900 Main Street, Susanvillle.

Former General Manager, Frank Cady, just prior to being fired, sent all of the LMUD Board and the LMUD Management to Colorado for a vacation meeting with Invenergy. This expense was obscenely expensive and served NO BENEFIT TO THE LMUD RATEPAYERS. It did serve a purpose for LMUD Director Darrell Wood.

Now that Darrell Wood is no longer on the LMUD Board he can now push for windmills on his property in Lassen County. Wood does not live in Lassen County. (Frank Cady charged ratepayers to fly to Wood's home and bring him to LMUD meetings).

LMUD's Matt Lavacot's family members (the Swickards/Five Dot Ranch) have been very outspoken against windmills in Lassen County. Matt Lavacott is the Hay Production Manager on his uncle's ranch.

LMUD's Wayne Langston will continue to look after Darrell Wood's interests.

A private citizen, Carla Allen, paid $2,381 for a "USE PERMIT" for Invenergy,  for a test tower on 10/9/07 but withdrew the permit on 12/4/07.

Arrowrock Gang finally admits results of the LMUD Feasibility Study to FERC

This conclusion was based on the feasibility study completed by LMUD and the Boise Project Board of Controls in 2001.

This Bogus project is now 19 years old.

Even with their license terminated, the Idaho Irrigation Districts immediately took this FLIM FLAM project on the road. They hooked another small utility District in Oregon.

The Congressional extension ends on December 13, 2009, if construction has not started. Now they are telling FERC that construction will begin in the Fall of 2008, so WHY ARE THEY ASKING FOR AN EXTENSION.........because they have no intention of starting construction in the Fall or Winter, Spring or Summer.

The Irrigation Gang knows that construction is not going to start then or ever. They have a lucrative gig going on with the Oregon utility. The Oregon utility was hoodwinked into budgeting $500,000 a year to the Irrigation Gang. The BPBC will continue to victimize small utilities until the FERC license goes away for good.

Clatskanie People's Utility District Audit, issued on December 31, 2007, makes no mention of the Arrowrock Power Purchase Agreement. All other Power Purchase Agreements are listed under "Commitments" and explained. It appears that the CPUD Board has hidden the Arrowrock expense in their "Management Costs & Expenses". The Clatskanie ratepayers have no idea what is being spent on the bogus project. The LMUD ratepayers fell victim to the same scam.

The Federal Energy Regulatory Commission Releases New Arrowrock Environmental Assessment 5/9/08

"Effects of No-Action Alternative: Under the no-action alternative, the Commission would deny the licensee's application to amend the Arrowrock Dam Project license. As a result, the licensee would have to decide whether to pursue construction of the project as originally licensed, pursue a different amendment proposal, or not to construct the project and surrender the project license."

Frank Cady and Al Barker, both attorney's, were the only ones that have grossly profited from this scam. With the help of Frank Cady, Wayne Langston and Fred Nagel, Barker  kept this "Flim Flam" scam alive for five years at Lassen Municipal Utility District. Al Barker and the Irrigation Gang had no FERC License when they signed a contract with Clatskanie People's Utility District on February 28, 2006. Al Barker, however promised this little utility district that he could "persuade" unsuspecting, gullible, Congressmen and Senators to reinstate the license.

The Ckatskanie People's Utility District wrote into their contract, with the Irrigation Gang, that if an Amendment to the FERC License was not achieved by December 31, 2007, they could terminate this agreement.

"Section 2. Term of Contract: ".....Clatskanie may terminate this Contract upon a 60 days written notice if FERC terminates the License or the Irrigation Districts have not obtained a License extension on or before December 31, 2007. "

Needs a Fence

Lassen County will not allow volunteers to walk the dogs at the County Pound because they don't have a fenced area. Rolls of chain link fencing was donated years ago, but it still lays on the ground waiting to be installed.

The Lassen County Animal Control staff has to exercise the dogs in a narrow hallway. The dogs develop immediate " kennel stress". As, Pete Heimbigner, Supervisor of the County Pound, stated to the Board of Supervisors....."they don't present well". Then they are killed...........

Yet, mr. heimbigner has stated that this fence is not on his priority list ?

These stressed dogs face eminent death. They need to be walked.

LMUD RELEASES TOTALLY REDACTED PUBLIC RECORDS FOR PUBLIC  BENEFIT MONEY

On April 3, 2008, Kan We Help requested copies of any Public Benefits money given to Jay Dow, Five Dot Land & Cattle, Don Dow, Joe Bertotti, Richard Egan, Brian Dahle, Bob Pyle, Hagata Ranch, Turner Drilling, HL Power, and Corder Farms.

All of these individuals have also received Carl Moyer Grant money to convert diesel engines to electric engines.

LMUD ATTORNEY CLAIMS THAT NO CHECKS WERE ISSUED  TO THESE RECIPIENTS. WERE ALL THE CLAIMS DENIED...........? 

LMUD attorney Jaimee Jones ignored the Public Records Request so the LMUD staff faxed over the public documents to KWH. However, Jones redacted all information that would have identified the documents requested. This is nothing new. Jones did this with the LMUD Board salaries also.

This information is not exempt from disclosure. LMUD has released this information to the Lassen County Times in the past. This is not "public assistance or hardship" money but public money given as an incentive to reduce electric bills.

LMUD does not want the public to know that the new Board Members have applied for Public Benefits money. They are certainly entitled to apply, but it becomes public information available to the public.

In a desperate act to save himself, Frank Cady the Attorney hired this law firm to try and get his "friend", Steve Pezzullo, on the LMUD Board. Cady spent $4, 205.32, in phone calls, to have this law firm "study" any conflict of interest to put Steve Pezzullo on the LMUD Board. Steve Pezzullo applied for one of the LMUD vacancies created when three LMUD Board members resigned.

Please note that this law firm sent their invoice to the law firm, Cady, Pardee & Richey. Frank Cady and Jaimee Jones law firm.

It appears that Cady and Jones did this in order to hide it from the public.  Now, Jaimee Jones, Cady's law partner, Jaimee Jones, advices the LMUD Board to just pay this.

Can Frank Cady "THE ATTORNEY" order this legal work? No, but Cady's law partner, Jaimee Jones could have. Jones was under contract with LMUD as Legal Counsel.

DESPERATE ACT NO #2: December 27, 2007

Frank Cady was facing sexual harassment charges so Cady and Jones turned on the employees in an attempt to discredit them. Frank Cady hired his "friend" Steve Pezzullo to investigate employee misconduct. Pezzullo charged  LMUD  $8,487.50. The issue was "old news" but Cady and Jones proceeded relentlessly to discredit the LMUD employees.

Cady's charges were baseless and the issue was dropped last year.

Lassen Animal Rescue, based in Westwood, arrived at the Lassen County Animal Control this morning and took the 15 adoptable dogs to their Adoption Event at Susanville Market. NO DOGS WERE RETURNED TO THE COUNTY POUND.

Ye Old Arrowrock

This old Dam has been around a long long time. It has been a good friend to fisherman and the surrounding farms in Idaho since it was built in 1915 and was designed for hydro with 1915 technology. The reason it was never developed for hydro energy has never changed in 93 years. ENVIRONMENTAL AND ECONOMIC.

Lucky Peak Dam was built downstream from Arrowrock, in 1955. The backwater from Lucky Peak Dam reduces the effective net head and eliminates any reason for an Arrowrock power plant to be built on this site. Recreational pressures on Lucky Peak Reservoir dictate that this Dam be kept as full as possible and this forces the Arrowrock Dam to be drawn down first which further reduces any power plant options at Arrowrock. This information has always been available to LMUD and the general public.

In 1926 the Bureau of Reclamation turned the "operation" over to the newly formed Irrigation District, the Boise Project Board of Control. On March 27, 1989 the BPBC filed for and was granted a FERC license to build a hydroelectric plant at the Arrowrock Dam.

The BPBC never could find any interest, in this project, and the license was due to be terminated by FERC again. On December 18, 2000 Al Barker, attorney for the BPBC, desperately sent out letters to "small utility districts". The only one that responded was Lassen Municipal Utility District who was considering bankruptcy at this time.

LMUD minutes indicate that LMUD and Frank Cady were silent on this BIG HYDRO PROJECT for 4 months. It was slightly unveiled at the April 25, 2001 LMUD meeting. This meeting was like a dog and pony show. At 9:37 am, the LMUD minutes show that the Chairperson Templeton stepped down and handed the gavel to Darrell Wood.

 Five problems with this meeting:

1. There was never a vote ,on the motion, to spend money for this Arrowrock Study. As soon as KHW informed LMUD that no vote was taken, Cady had the Board change the minutes to reflect a vote. The ratepayers that attended this meeting were outraged.

2. Who was the Chairperson, Darrell Wood or Louie Templeton? The Chairperson cannot make or second a motion.

2. The referenced "packet" was never produced to the public.

3. The LMUD ratepayers were told that they were PAYING FOR THIS STUDY.

4. The project was deliberately misrepresented to the public.

5. The ratepayers were told that this Arrowrock Feasibility Study would be finished in June-2001...and it most likely was.

LMUD minutes versus FERC's record of this activity revealed that Frank Cady and the LMUD Board simply and deliberately lied about the Arrowrock progress. Kan We Help filed a Motion to Intervene with FERC, on April 5, 2003. which included a chronological accounting matching LMUD's statements to the public and what was actually occurring on this FERC license P-4656. LMUD's real involvement ended by December 2001, but continued to misinform the ratepayers for another four years. LMUD continued to pay Frank Cady and Jaimee Richey (aka Jaimee Jones) huge legal fees for a project that, in all practicality, did not exist. 

Frank Cady was brilliant in that he created different names for the Arrowrock Study to simply baffle and confuse the public. It was in fact just a Feasibility Study for a Flim Flam project.

The fact remains that the Arrowrock Study was completed in October 2001 and the cover page was submitted to FERC and represented as a completed study, the completed Arrowrock Study was given to RW Beck, an independent contractor to prepare for the RFP, then the BPBC subsequently released the RFP for the bidding process which was completed also using the completed Arrowrock Feasibility Study.

WHEN KAN WE HELP REQUESTED A COPY OF THIS STUDY, ON SEPTEMBER 11, 2002,  IT WAS "FINAL" AND "COMPLETE". THE RATEPAYERS CONTRIBUTED $150,000 TOWARDS THIS STUDY AND HAD PROPRIETARY RIGHTS TO THE STUDY...AND STILL DO.

RATEPAYERS WERE PROMISED THAT A COPY of the Arrowrock Feasibility Study would be released

FACT: RW Beck and Power Resource Managers were given the completed Arrowrock Feasibility Study.  The project, after all these shenanigans, could not be built. The fact that this project was not feasible was determined years before LMUD's involvement.

KAN WE HELP HAD A LEGITIMATE REASON TO ASSUME THIS STUDY, THE RATEPAYERS PAID FOR, WAS DISCLOSABLE ON 9/11/02.

The Third District Appellate Court's ruling was a sad distorted CARICATURE of Lazards ruling. KWH's attorney asked for the lower court to review "in camera" the evidence presented by Frank Cady and Jaimee Richey-Jones. This request was denied. Both courts refused to look at the evidence that would have vindicated KWH

LMUD Public Records Policy is Cash Cow for Jaimee Jones

Her Law Partner, Frank Cady, created a public records procedure and "policy" that has been obscenely profitable for both of them.

Jaimee Jones, LMUD attorney, gets paid by the hour, so if she doesn't comply with a public records request, she gets paid for these delays. She will send out five of the six pages, or delay the documents past the "due date", so that * "187" letters have to be written to find out why the documents haven't been sent. Jones knows how to work this "cash cow" and the LMUD Board lets her continue to do it.

*Cady made this exaggerated number up during the trial (no evidence to support 187 anything) and the Appellate Court blindly and with prejudice gave it validity in their ruling.

Prior to the formation of Kan We Help, Frank Cady basically bullied the public when they questioned Lassen Municipal Utility District. That's a known fact and the history of LMUD.

 The "Recalled" LMUD Board (Darrell Wood, Louie Templeton, Mario Giannotti, Richard Parker) took extravagant trips, flew in Lobster for their parties and when ANYONE DARED TO QUESTION THEIR ACTIVITIES, THEIR ATTORNEY, FRANK DECKER CADY TOOK CARE OF IT.

In 2002, when LMUD hit bottom and was considering bankruptcy, questions needed to be answered. Kan We Help, a local government watch dog group, began investigations into the "spending" of the newly elected LMUD Board members. It seemed that nothing was going to change.

In 2003, Frank Cady advised the LMUD Board to pass Resolution 2003-01. Cady would now make it so difficult to get LMUD's public documents that it discouraged the ratepayers from even asking. KWH's sole purpose was to make LMUD accountable through exposure.

Lassen County Superior Court and the Third District Appellate Court

Failed to look at the actual Arrowrock Feasibility Study and Cady,Pardee & Richey's actual invoices for their Arrowrock project work.

WHY?

 "Evidence" that would have revealed that KWH was entitled to these public documents. Ridgely denied KWH's motion to review the "in camera" documents.

Lassen County Superior Court and the Third District Appellate Court

allowed Frank Cady to introduce manufactured evidence, a "Bate stamped" spreadsheet with information that KWH requested but was never given.

Court transcripts state:

KWH was given a copy of this spreadsheet without a Bate stamp (page numbers). The spreadsheet KWH was given had no names or gross amounts of the LMUD Board members.

Cady was allowed to perjure himself with no consequences?  This is disbarment stuff.

The Court transcripts show Cady apologizing to the Court for this deception. Cady should have been, at least sanctioned, for his actions.

Will the people continue to allow the LMUD secrecy?

Will the people allow LMUD to continue this corruption?  

Will LMUD hire a real attorney that will obey the law?

LMUD continues to abuse the Public Records Act

The sad fact that LMUD continues to pay for an abusive and obscenely expensive public records request process is beyond belief.

The Lassen Municipal Utility District has absolutely no control over these abuses and sadly doesn't care.

Jaimee Jones is still allowed to send partial document requests and send them whenever she wants to.  Of course, she bills for her negligence, when the public has to write 187 letters in attempt to make her comply.....................

The lower Court Judge, Ridgely Lazard, refused to look at Frank Cady's LMUD invoices that were requested by KWH in the Writ of Mandate. Both Courts erred in not inspecting these invoices which Cady claimed that he was paid for Arrowrock work but didn't write anything down.......Right?

The Appellate Court had a judicial if not moral obligation, prior to issuing their ruling, to look at this evidence. They did not do this because they must have known that Cady had lied.

LASSEN SUPERIOR COURT ORDERED TO ACTUALLY "LOOK AT" FRANK CADY AND JAIMEE JONES LMUD INVOICES FOR THE ARROWROCK LAWSUIT BUT NOT THE ARROWROCK INVOICES THAT KWH REQUESTED. CADY BILLED LMUD, FOR THE BOGUS ARROWROCK SCAM,  FROM DECEMBER 1999 TO 2005 but claimed that LMUD didn't require him to itemize these hours for the invoices KWH requested. KWH has Cady invoices dating as far back as 1990, 1991 and the  billing formats have only changed slightly. 

The Appellate Court ordered (page 27) the lower court to actually look at Frank Cady and Jaimee Jones invoices they submitted, to LMUD, for the work they did on the Writ of Mandate KWH filed to obtain public documents.

"The plaintiff prepared an exhibit that made a painstaking comparison between the itemized statement and the actual invoices from March 10 to November 20, 2003. Although finding redactions in the September and November invoices too extensive to allow meaningful comparison, the trial court neither asked LMUD for unredacted copies to review in camera, nor expressly considered the apparent errors that the plaintiff identified in the invoices for March through August. As the plaintiff produced affirmative evidence of the unreliability of the itemized schedule at least in this regard, the trial court's course of action amounted to abuse of discretion. On remand, LMUD shall either produce the unredacted copies of the invoices for review in camera, or the trial court shall disallow any fees for the September-November 2003 period. The trial court shall also evaluate irregularities that the plaintiff identified for the March-August 2003 period."

This is the March/2003 invoice for Cady's  Writ of Mandate/Arrowrock work........and it appears that it was clearly identified by Cady. KWH compared Cady's "statement", submitted to the Court, with the "actual invoices."

Cady refused to release previous invoices to KWH because the public was told that the limit on the Arrowrock project would not exceed $150,000. Frank Cady and Jaimee Jones billed hundreds of thousands of dollars for the Arrowrock scam in addition to the $129,000 LMUD spent on the Arrowrock Feasibility Study. The public had a right to know how much money was wasted.

 Both courts thought otherwise.

Frank Cady's September 2003 invoice clearly shows the Arrowrock hours billed and the lower court chose to "believe" Frank Cady when he told the court that he previously sent a bill to LMUD for the unremarkable, unidentified work he did on Arrowrock for the billing period KWH requested....no chance....no way. 

The Appellate Court showed bias, prejudice and abuse of discretion in that they did not require LMUD to produce the records (Cady's invoices for Arrowrock work) that KWH had requested nor the copy of the  "alleged" DRAFT Arrowrock Feasibility Study.

This ruling had no similarity to either the court transcripts or the evidence provided by each party, why? The ruling by Judge Davis exhibited such animus one might believe he was related to either Lazard or Cady.

Ag Business is a $75 Million Dollar Industry in Lassen County

2006 production values reported by the Lassen County Agricultural Commission show that field crops make up 1/2 of the $75,000,000. Timber harvesting and livestock tie for second place at approximately $14,000,000 each.

The State of California provides different kinds of financial support for California ranchers and farmers. One program is the Carl Moyer Grant. The Carl Moyer Grant provides incentive ("free tax dollars") to farmers and ranchers to convert their "diesel " pumps to "electric" pumps.

NEED "FREE" MONEY TO BUY THOSE "ELECTRIC" PUMPS?

She has delayed one request by stating that she did not know what "applications" meant. Then she delayed another request by taking public documents to her office and insisted that the public inspection must take place at her office. Ms. Jones is more than aware of LMUD Resolution 2003-01.

Jones has done herself a disservice and certainly has done the ratepayers a disservice. Over $800,000 has disappeared, in the Public Benefits Fund, since Cady was hired as General Manager. This has nothing to do with the new Board members.....or does it?

LMUD DIRECTOR Wayne Langston tried to make a case, at the March 4, 2008 LMUD meeting, that Frank Cady (fired LMUD General Manager) was entitled to lifetime benefits.

Frank Cady knew very well that he had failed to include, in Section 11.2 of his contract, any "continued" benefits if he was fired "without cause", but he sent Langston to beg for this. Why didn't Cady appear himself to make his case.

LMUD Resolution 2003-05 states that only EMPLOYEES are entitled to benefits. The 2005 LMUD Board "vested" Cady in the employee benefit program when he was hired as General Manager. This just meant he would get benefits immediately. Cady was no longer an employee, CADY WAS FIRED. NO BENEFITS.

The public feels that Cady should have been fired WITH CAUSE and that the LMUD Board in closed session violated the Brown Act by not discussing Cady's contract in open session.

Cady was not entitled to a dime and should be in jail, with the rest of his gang.

Information on recipients of the Public Benefits Funds has been given to the Lassen County Times......and the Lassen County Times has printed stories on the projects. Susanville Market, Westwood High School.....are just a few. The money was intended to DO GOOD for the community.

LMUD HAS NOT STATED "PRIVILEGED INFORMATION" as a reason for refusing to disclose these records. Why, because they can't.

 Theresa Boucher has been told by Jaimee Jones that she cannot disclose these records to KWH because "it is privileged". Boucher has been responsible for the disbursement of this money. She will be the "fall" person at the end.

Over a million dollars has been "spent" or moved, in a very short time. A huge red flag went up when KWH asked for copies of Don Battles invoices. (Cady and Langston's friend). In January of 2006,  50% of Don Battles invoices suddenly were paid with Public Benefit dollars.

To do that she is giving the new Board members bad legal advice. FRANK CADY ACTUALLY HIRED A LAW FIRM TO FIND OUT WHETHER OR NOT STEVE PEZZULLO COULD SIT ON THE LMUD BOARD.....COST: $4,000. The Board labored on whether to pay this and asked Jaimee Jones to try and negotiate a lower amount. Surprisingly....not a soul knew anything about this.

LANGSTON AND NAGEL MUST RESIGN

Langston is big on wanting people arrested. In 2003, Langston constantly stopped LMUD meetings to call the police every time he didn't like what was being said.

Langston didn't fit in tonight, with the shining new faces on the Board. This Board expressed disgust and frustration for the mess Langston and the previous Board members left.

If Langston had any honor at all, he would leave. Fred Nagel, the other remaining Board Member from the Cady era, was asked to resign but did not attend this meeting.

The LMUD Board voted to amend Jaimee Jones contract to allow her to bill her first 40 hours at $145 per hour and $180 per hour after that. They did not even consider Langstons' agenda item to hire in-house counsel again. Jaimee seemed luke warm to the idea, since she can make three times that by billing LMUD by the hour.  It will be up to this new LMUD Board to control her work product.

LMUD Director Dow and Bowden did not understand the Agenda item that considered paying Frank Cady his final expenses. Someone (?) went to a lot of trouble to research items (back to 2005) that Cady bought but didn't return, to offset Cady's final Expense Reports.

There were additional items, such as a digital camera, a $300 3-hole punch, Aviation subscriptions, alcoholic beverages, more planners that Cady put on his LMUD credit card, in November of 2007..... the Dow and Bowden refused to consider adding these items to offset Cady's final Expense Report ($2,187.10).....Director Dow actually asked President Bowden to rule this comment OUT OF ORDER AND Dow actually thought it was a violation of the Brown Act.......??????? Go figure......... No one knows what they actually ended up paying Cady.

Also on the LMUD Agenda was an item to continue to pay Frank Cady his LMUD Benefits. When Cady wrote his own LMUD contract he failed to put language in Section 11.2 that would entitle him to continued benefits. Langston ranted about Cady suiing.......but LMUD Resolution 2003-05 states that only "employees" can receive benefits, and since he is no longer an employee....HE'S NOT ENTITLED TO CONTINUE TO RECEIVE LMUD BENEFITS. WOW....THAT WAS SIMPLE.

Langston, Nagel and Woods reported travel in their monthly "Board Member Statement of Meetings" but never included the expense of  hotels, airfare or food in their Expense Reports. The majority of the Board expenses were charged to Frank Cady's personal expenses.

Public Records disclose that two weeks before he was fired,December 21, 2007, Frank Cady purchased "Shred" and "Quick Wipe" on his LMUD credit card. This software has the capability to erase data from a computer or computers. Frank Cady was fired on January 4, 2008.

Why did Cady need software that would destroy data from a computer. What damage did he do?  What was he hiding?

Dr. "Death" Hemphill hangs up on Lassen Animal Rescue

Lassen County Animal Control kills twice a week, Wednesday and Friday. Lassen Animal Rescue (a no kill private rescue) found homes for two puppies that were to be killed on 2/27/08, Wednesday morning at 7:00 AM. The Lassen County Animal Shelter was closed and their answering machine was not taking messages.

Dr. Hemphill (257-2239) was then contacted to alert him that the puppies were not to be killed. Dr. Hemphill said that it was "none of his business". LAR asked if they could leave a message for Judy Walesch "not to kill these puppies" and Dr. Hemphill hangs up.

This was a "for profit' knee jerk reaction" from this Vet that Lassen County pays to kill thousands of adoptable animals a year.

When the "old" LMUD Board (Cardenas, Sargent, Wood, Nagel, Langston) needed to HIDE SUSPICIOUS OR ILLEGAL ACTIVITY they would have their attorney's (Jones and Cady) hide the evidence. That's Wrong.

More than a million dollars of "Public Benefits Fund" money has been disbursed in a very short time and Jaimee Jones is delaying, anyway she can, the public's right to "inspect" the records or obtain "copies".

 When it was discovered that Frank Cady started funneling "Public Benefits Fund" money to his friend Don Battles, it sent up RED FLAGS on where all of this money went to so quickly. Public Records disclose that Frank Cady began paying his friend Don Battles, up to 52% of his invoices, out of the Public Benefits Fund. This was approved by Bill Stewart and the LMUD Board in December of 2005.

Now, the new Board has to decide if it will continue the "unacceptable practices" of the past Board.

On November 7, 2005, the EPA fined LMUD $9,000 for falsifying an EPA identifcation number in order to move PCB's from 1605 Chestnut Avenue in Susanville, California to another LMUD property.

No mention of this EPA Enforcement Order was EVER "publicly" MENTIONED BY THE BOARD OR GENERAL MANAGER.

Paul Glau was LMUD's Hazardous Waste Manager at the time.

On November 9, 2005, Jaimee Richey/Jones began negotiations to purchase two parcels of land adjacent to LMUD's property from Jack Beterbide (one parcel Beterbide didn't even own). These negotiations were done by Jaimee Richey/Jones in  "closed" session without ANY  report, to the public, of the Boards actions. Paul Glau was brought into the "negotiations" prior to the sale.

On January 30, 2006, LMUD paid Jack Beterbide for 1545 & 1555 Chestnut  when they knew it was contaminated by LMUD's PCB's.

 Paying Beterbide $381, 232 was cheaper than a lawsuit.

Beterbide bought the adjacent property from  Robert & Gail Prosise the same day he sold it to LMUD.

Nancy Cardenas was LMUD's Board President and was not present, at this meeting on 11/9/05. Wayne Langston chaired this meeting.

Frank Cady then proceeds to promote Paul Glau, for his silence. Glau was LMUD's Hazardous Waste Manager, then Facilities Manager and finally Director of Engineering Operations, then back to Facilities Manager.

LMUD COUNSEL PROTECTS CADY AND DELAYS RELEASE OF PUBLIC BENEFITS RECORDS

Jaimee Jones wants KWH to define "Applications"

The State of California requires LMUD to set aside 2.85% of its gross revenue for a PUBLIC BENEFITS FUND.  [AB 1890 doesn't end until December 31, 2010].

KWH has requested copies of the "Applications" for this money from July/2005 to December/2007. That seems simple enough.

Recent activity indicates that over $700,000 is simply gone.

 Lassen Municipal Utility District provides an Application form for the public to apply for these funds.

Businesses can apply for this money or individuals can apply for this money. This is PUBLIC money that the PUBLIC can apply for.

The LMUD Board Secretary's daughter, Theresa Boucher, was hired to fill a "new" position at LMUD.....Public Benefits Director. The fund had close to a million dollars in it when she was hired.

Boucher's title was changed when the money disappeared and is now called "Energy Services/Compliance Specialist". She was unavailable for comment.

LMUD BOARD STALLS ON PUBLIC RECORDS REQUESTS

Kan We Help requested the LMUD Board's "Board Statement of Meeting" monthly reports and they indicate that Darrell Wood reported going to Colorado for wind generation (Invenergy), Fred Nagel and Wayne Langston went to Squaw Valley with Frank Cady (UAMMPS) in August-2007.

Kan We Help also requested their Expense Reports...and there were none.     WHO PAID FOR THESE TRIPS?

Also, Jaimee Jones claims that Frank Cady's October and November Expense Reports do not exist. Where was Frank for two months? He claimed he was out of town in October but there is no record of any expenses.........?

Next, KWH requested copies of LMUD's credit card statements. Jaimee Jones has ignored this request and is now in violation of the Public Records Act.

LMUD Board Members have, in the past,  hidden their travel expenses in the Cady/Jones legal invoices. Cady and Jones bill the Board expenses as "out-of-pocket" expenses. This is not privileged information and has been subject to disclosure. However Frank Cady and Jaimee Jones have refused now to disclose these documents. The public has a right to know where their money is being spent.

This property was worthless and LMUD paid $381,232 for it.

KWH called Kresge this morning and asked why six months of LMUD minutes were withheld from the public. Ms. Kresge responded that "there was special circumstances". It appears that six months of LMUD minutes may have been "sanitized".

Kan We Help submitted a public records request for Frank Cady's expense reports for June through November/ 2007. Cady claimed, in an interview on November 7, 2007, that he took some vacation time in October, but was out of town the rest of the time and Cady arrogantly stated that it was nobody's business where he was, not his staff or even the LMUD Board's business.

LMUD's attorney, Jaimee Jones (Cady's former law partner), has refused to release Cady's October and November expense reports to Kan We Help. After two follow-up letters,  she continues to ignore the public records request for Cady's October (Cady stated, to the Lassen County Times, that he worked "out-of-town" on October 1, 3, 22 & 24.) and November Expense Reports and has given no reason for withholding these two months of expense reports. 

Cady claims that he gave the Lassen County Times his schedule to squash the rumors that he had been placed on administrative leave for sexual harassment of employees.

Before the "Arrowrock scam"LMUD  public record requests were handled "in house" by the LMUD General Manager. It was a simple form and a simple procedure and the public's request was quickly handled.

Prior to LMUD's horrific energy "speculation" purchases, which led to the $8.1 million dollar loss and the talk of bankruptcy (2001), you could walk in to the LMUD office and wait for a copy of an agenda.

The Arrowrock hydro project was only a "distraction", a "smoke screen" for LMUD's financial disaster. The public records requested by KWH were given to Frank Cady and Jaimee Richey to process. The public documents requested that were given to "Cady, Pardee, Richey" (now a defunct law firm)to fill a PRA request, were not always released. Monies paid to Board members are disclosable, public contracts are disclosable, financial records (other than private info on personnel) in fact, most public documents are disclosable to the public..

Frank Cady and Jaimee Richey then created a cumbersome process that could only be handled by them. Under their new procedure, it NOW cost hundreds of dollars for these "attorney's" to handle PRA's (nothing self serving about this).  They even increased the cost and time to process public records requests when they hired an outside law firm to handle the public records request after they had processed the requests. 

THIS CREATED PUBLIC OUTRAGE AND MISTRUST and Kan We Help was born

KWH submitted this old form, for a document request, and it was refused by Jaimee Jones. The Public Records Act does not allow this type of abuse that causes unnecessary delays. LMUD's attorneys are allowed to do it anyway to dissuade the public from requesting public documents.

Beterbide, Fred Nagels friend, realized a very nice secret profit from the deal.

This was all done, with the advice and approval of Jaimee Richey/Jones

Jaimee Richey/Jones failed to file a judgment with the correct name and then filed a lien on property that had nothing to do with LMUD. The property owner sued LMUD for her mistake

LMUD MEETING BEST IN TEN YEARS

President Bowden opened the meeting up to the public. This is something that ratepayers haven't seen in a decade.

In a last ditch effort, Wayne Langston placed the "in house" Counsel issue on the Agenda and the Board not only decided that they weren't going down that road , but are going to review Jaimee Richey/Jones current contract. Fired General Manager Cady routinely approved Jaimee's legal invoices for 10, 20 or $30,000 a month and she banked it.

Director Jay Dow was right on the money (literally). He fielded specific concerns about the financial state of LMUD at Bill Stewart, LMUD's Controller.

Director Dow stated that LMUD's power purchases did not increase during the time that LMUD's revenue increased in 2006.

[LMUD realized over a million dollar increase, with the three rate increases Cady made in 2006.]

THE BIG QUESTION DOW PUT TO STEWART: WHERE'S THE MONEY.   Stewart could not or would not answer Dow's question. MONEY HAS SIMPLY DISAPPEARED.

Bill Stewart has never shown any competency at LMUD. This is a position the new Board needs to look very closely at.

Jaimee, as incompetent as ever:

President Dow asked Jaimee to respond to a question from the public and she sat quietly looking down at papers, completely oblivious to Dow's question. She apparently wasn't listening to the meeting.

The new Board members agreed that legal expenses were second only to the purchase of power ($800,000 annually, of which $300,000 was budgeted to Jaimee). New General Manager, Ray Luhring, told the Board that he has stopped any work that LMUD's law firms are working on for a savings of $200,000.

Jaimee Richey/Jones is responsible for LMUD's legal mess. She has no competency in utility law, open meeting law, parliamentary procedures, nada. NO VALUE WHAT SO EVER.

EXAMPLE: Tonight Jaimee actually advised the new Board members that they could approve six months worth of LMUD minutes for meetings they did not attend, we repeat "for meetings that they did not attend".

BOARD BAMBOOZLED BY BAD LEGAL ADVICE

There wasn't a person in the room that didn't know that the three NEW  Board members could not vote on approving minutes from meetings that they did not attend. They had to abstain from the vote which left only two members to vote on the issue. They needed three votes to approve the minutes.

Jaimee told them that they could approve six months of LMUD minutes.

LMUD Board Secretary, Jerri Kresge, was unwilling to answer the question, WHY  WAS THERE SIX MONTHS WORTH OF MINUTES THAT HAD NOT BEEN APPROVED.

WHERE THE HELL WAS JAIMEE? SHE APPROVES THE AGENDA'S EVERY SINGLE MONTH and did not include approving minutes?

 The Board and the public should have had  real concerns of "alterations" to these minutes.

ANYONE IN THE AUDIENCE TONIGHT NEW MORE ABOUT THE LAW THAN JAIMEE JONES DID

CADY AND THE OLD LMUD BOARD WERE NOTORIOUS FOR ALTERING MINUTES. JAIMEE SAT CLUELESS ON POLICY AND PROCEDURES, but this is nothing new.

She has never had any value at LMUD and if she is allowed to stay as legal counsel would continue to be a liability.

Jaimee Richey-Jones, Paul Glau

As the new LMUD General Manager, Frank Cady created a new LMUD position (Facilities Manager ?)for his friend Paul Glau and now Glau is one of the moles making frequent visits to Cady's house (in a LMUD truck, no less) to keep Cady informed on LMUD business. WHY?      

 DID CADY REALLY LEAVE.......or is this a ruse............?

Frank Cady brought Jaimee Richey to Susanville, in 2002, after she passed her California Bar. Cady "created" pointless and redundant work for her, at a huge cost to the LMUD ratepayers and then attempted to hire his former law partner as LMUD's "in house" counsel. The insurmountable problem with that is 1) she simply would continue to run LMUD for Cady. 2) The last thing LMUD needs is to add the prohibitive cost of a full time attorney when cost cutting is on the table.3) She has never proven that she has the skills or inclination to offer a honest days work.

The "new" LMUD Board members cancelled "ALL" consultants contracts and "ALL" legal contracts but have put hiring "in house" counsel back on the agenda. 

The worst message the LMUD Board could send the angry ratepayers now is that LMUD cannot clean up its act and needs an IN HOUSE COUNSEL to continue the dishonesty, secrecy and corruption of the past seven years. 

If this new and improved LMUD Board even considers bringing ANY ATTORNEY in as "in house" counsel (minimum cost to the ratepayers of $300,000 annually)  the roof then will come down on any "reelection" possibility for all five Board members. 

Each step to restore LMUD to an honest public entity will be monitored.

The NEW LMUD Board members have cut out the Cancer, but also must ensure that the remaining problems are addressed and are not allowed to continue to corrupt this public utility.

This "new"  LMUD Board members may bring this small utility back in line with some level of fiscal responsibility. Something Frank Cady stripped from previous LMUD Boards.

Jaimee Richey-Jones has no expertise, in the power industry, and was tutored by Cady on how to fleece LMUD.

Jaimee just did what Cady told her w/o "thinking" whether it was legal or ethical

Was  the cause, poor judgment or was it just greed?

All cases can be settled

1. Steve Trevino was terminated due to LMUD legal counsel failing to advise LMUD Board of the General Manager's inappropriate behavior. This was a wrongful termination and LMUD's attorney did not have the skills or inclination to find a solution before allowing Cady to fire Steve Trevino.

2. Cal Sierra Title is representing David Jenne because LMUD attorney, Jaimee Richey-Jones, wrongly attached a lien to his property. The lien had to be removed but David Jenne has been threatened by LMUD's attorney to continue to go after his property. Richey-Jones failed to record a judgment in the correct name and then claimed, years later, that Cal Sierra failed in it's title search to identify previous owners. David Jenne has and never has had anything to do with LMUD.

This was an absolutely baseless and stupid action by LMUD's attorney that led to an action being filed against LMUD.

3.Kan We Help submitted a public records request for the Arrowrock Feasibility Study (that Cady claimed the ratepayers paid for), Board members salaries and copies of legal expenses for Arrowrock paid to Jaimee Richey & Frank Cady. Frank Cady and Jaimee Richey-Jones refused to disclose these public documents.

KWH filed a Writ of Mandate to acquire these public documents but Judge Lazard ruled against KWH and stated that the KWH requests were frivolous. 

Lazard was not re-elected to Lassen Superior Court.

KWH filed an appeal in the 3rd District Appeals Court and is awaiting their decision.

These cases can and should be resolved by the new LMUD Board

Jaimee Richey-Jones, LMUD attorney, may have bypassed the law when she allowed Frank Cady and the old LMUD Board to enact PDCA

LMUD's attorney, Jaimee Richey-Jones (Cady's law partner) allowed Frank Cady to present the "Power Delivery Cost Adjustment" on the December 6, 2005 LMUD Agenda (Agenda item 5 B).

No Resolution was passed by this Board

KWH submitted a written protest, to LMUD, that this policy violated the law. This protest fell on deaf ears

Jones and Cady, both practicing attorneys, knew about Municipal Code 14401-14403.5, yet presented the LMUD Board with a "proposal" that would change the way the LMUD electric rates could be changed.

Jaimee Richey-Jones eliminated the public hearing required by law

 LMUD attorney Jones hid the last rate $ .05 increase in the November 27, 2007 Agenda

Jones placed Agenda item 4D on the 11/27/07 Agenda as an employee grievance but in fact it was another rate increase.

Her tenure, with LMUD, has been a total disregard for the interest of the ratepayers and the law. For this, the ratepayers have paid her close  to $300,000 a year in bloated legal invoices and expensive trips.

LMUD BOARD MUST REVERSE CADY'S RECENT RATE INCREASE BEFORE THE ELECTRIC BILLS GO OUT

Frank Cady, not the LMUD Board, as required by law, increased the electric rates five cents again. That's four rate increases in 10 months.

ALL FOUR RATE INCREASES NEED TO BE REMOVED. The LMUD ratepayers no longer have to support Cady and his friends expensive lifestyle.

CADY'S "PDCA" DOES NOT CONFORM TO THE LAW

New LMUD President Bud Bowden announced the firing of Frank Cady at their first meeting yesterday.

The new LMUD Board voted 4-1 to terminate Frank Cady's contract "without cause" immediately.

Wayne Langston voted no. Langston is the only seated member of this board that has never been on any LMUD ballot. Cady and then County Clerk Theresa Nagel placed Langston (a PSREC utility ratepayer at the time of his appointment and the County Clerk's son-in-law) on the LMUD Board when Michael Deal resigned. Langston only moved into a LMUD Ward after the next LMUD election. Langston did not appear on the next LMUD ballot. No LMUD ratepayer has ever cast a vote for Wayne Langston.

Cady threw a temper tantrum at the LMUD office (one employee left in fear) when the new LMUD Board posted their "1/4/08- 1:30" agenda. The new LMUD Board ignored the illegal Cady agenda for a 2:30 meeting.

Who collected Cady's LMUD keys, credit cards, lap top..................?

The Brown Act  states that the first agenda posted is the legal one.

Cady makes a huge statement to the new board members that he's running the show  not them.

Frank Cady's agenda includes slipping a $300,000 position in for his law partner, Jaimee Richey-Jones,  as "in-house" LMUD counsel . LMUD needs an "in-house" counsel as much as it needs more power outages.

Cady must get Jaimee on board in case he is fired today. If he is successful in pulling the wool over the new Board's eyes, he will continue his connection with LMUD through his law firm Cady, Pardee and Jones. 

"Slick" (the silver tongued con man) may pull this off yet. Cady has been practicing law from his LMUD office since July 2005 anyway according to the California State Bar Associations records.

Cady is also looking for vengeance and wants to fire LMUD linemen.

The new LMUD Board members will first evaluate Cady?

The new Board should not vacillate or "take time to understand the termination of Frank Cady. Cady's termination is simple, JUST DO IT. The problems, with Cady, have been transparent for years.
