LAFCO met on October 20, 2003. Supervisor Keefer and Hanson were no shows for the County.  Jim Chapman sat in for Supervisor Keefer.  The Commission had sufficient members to hold the meeting. 

LAFCO RECEIVES LETTER FROM 

FAIR POLITICAL PRACTICE COMMISSION

Executive Officer discloses letter from FPPC during the meeting, in regards to the Conflict of Interest with John S. Kenny.  A KWH member asked for a copy of this letter and Jim Chapman claimed that it was not disclosable because it was a letter to the Executive Officer. The KWH member told the LAFCO Board that a PRA request would be submitted for a copy of the letter.  Mary Fahlen objected to the letter being disclosed until the next LAFCO meeting. 

The letter was disclosed to the LAFCO Board at the same time its existence was disclosed to the public.   A PRA request will be submitted for the document.  The Executive Officer attempted to find a copy machine so that everyone could have a copy, but the County offices were closed.

Helene Williams addressed the LAFCO Board with concerns about full disclosure by each of the Board Members.  There was a debate over how much should be disclosed and Ms. Williams added that even the "perception of conflict" is not acceptable.  Ms. Williams compared to the "excellent disclosure" by Jim Chapman as an example of full disclosure. One member of LAFCO failed to disclose two appointments on other boards. 

The LAFCO Board again delayed payment of the $154.50 to John S. Kenny.

The LAFCO Board, for the third time, voted not to pay John Kenny for his involvement with Frank Cady.  The LAFCO Board is sending the issue to the Fair Political Practice Commission for an opinion on LMUD's attorney hiring LAFCo's attorney when there  was a LMUD Boundary issue before the LAFCO Board. 

Kenny did not inform LAFCO prior to being hired by LMUD's attorney,Frank Cady.  LMUD is within the jurisdiction of LAFCO.  This violates the Ethics Code of the California Bar Association. Frank Cady lists the Board of Supervisors as his client, so the Conflict of Issue has to be addressed by an "independent counsel".
