We gave her a phony name, phony "Winner Code" and "Reference number". She paused to verify it and then began to give instructions for the $120,000 prize.

She said that we were one out of 18 winners. The lotto was in Dublin, Ireland. She gave instructions to buy a Money Order for the $2,845 "clearance fees" and to call back with the Money Order number. Then, you are to mail the Money Order to

At the December 19, 2006 Lassen County Board of Supervisors meeting, the Board made a proclamation that Theresa Nagel will retire from Lassen County. 

No action taken, by Lassen County Board of Supervisors, in 2006, to take the "Clerk of the Board" position out of the County Clerk's duties.

Theresa Nagel asked the Lassen County Board of Supervisors for a job after she leaves office. County Clerk, Theresa Nagel, did not run for re-election. The job she seeks is part of the Lassen County Clerks duties.

THERESA NAGEL WAS MOST KNOWN FOR HER TEMPER TANTRUMS, HER MEAN SPIRITED PERSONALITY AND IRON HAND MANAGEMENT STYLE.

The former Susanville Police Chief, Chris Gallagher, fired Donna Hastings in June of 2005 so that he could make room for a friend of his on the Police Force.

Lassen County hired Donna Hastings as the second Animal Control Officer. She will start in January of 2007.

Susanville, presently, does not have an Animal Control Officer. Susanville Police Officers must respond to all dog issues within the city limits.

LMUD was to pay a total payment of $56,250 for Phase I. Will NCPA give all of that money back ?  Ratepayers will not see a penny of this money.

LMUD TO LOOK AT SIGNING CONTRACT FOR PROPOSED NEW POWER PLANT IN UTAH

There are presently two "operating" power plants at this site. UAMPS proposes to build an additional 990 MW power plant that will be open for large and small utilities to participate in.

There are no obligated upfront costs unless the participating utility opts to pay for the administrative costs on a pay-as-you-go basis.  Utilities will pay according to the percentage of power that they are contracted to buy. These costs begin after the plant is online. The cost of this third plant is estimated to be 1.8-2.1 BILLION DOLLARS and is scheduled to be on-line in 2012

If LMUD participates, the participation will be scaled based on the utility's financial ability and on a needs basis. Utilities as few as 300 meters have participated in UAMPS  projects in the past.

UAMPS has been in business for over 50 years

There is no "membership"  in UAMPS, just a "cafeteria" style participation. (pick and choose projects)

There is no urgency to enter into a power purchase agreement for UAMPS Unit 3 power plant

However, there is an Annual Meeting, in Utah, on December 19 & 20. LMUD cancelled their December 19, 2006 regular meeting and is holding a "special" meeting earlier at 3:00. This will allow for earlier flights to Salt Lake City's party.

Lassen College President Cissell has been one step ahead of another Grand Jury investigation and he wants to get embroiled with a "misuse of public funds" fight...this is worth monitoring VERY CLOSELY !!!

NOTE: Frank Cady was directly involved with LMUD's near bankruptcy in 2001. The small local utility lost $8.7 million dollars due to speculation in the energy market. This poor business decision has left years of devastation to recover from. Cady used the phony Arrowrock hydro project, in Idaho, to distract from the $8.7 million dollar loss. Hundreds of thousands of dollars were funneled through Frank Cady's law practice for the bogus hydro project. Kan We Help filed a Motion to Intervene to terminate the Arrowrock FERC license. The FERC license was terminated by the Federal Energy Regulatory Commission. Cady- bad for LMUD, bad for the City of Susanville, bad for Lassen County.

DAVID WILLIAMS, LOCAL SUSANVILLE ATTORNEY FORCED TO WITHDRAW FROM "PHONY" EVIDENCE CASE

David Williams submitted phony photographs to the court to defend his client Richard Brown and subsequently now has withdrawn as counsel for Brown. 

Williams client faces felony perjury charges but isn't it the responsibility of the defense's counsel to verify all evidence.

Lassen County Board of Supervisors approves funding for Family Resource Centers

Westwood, Herlong/Doyle, Surprise Valley

Standing room only as the Lassen Board of Supervisors listens to the logic of the public on continued funding

The Lassen County Board of Supervisors unanimously approved funding to continue the Family Resource Centers in Westwood, Herlong/Doyle and Surprise Valley. This funding will give each Center $75,000. The funding is given, annually, on an "as-needed" basis with any funds remaining to be put back into the "pot".

A vote on the "Volunteer"" program, for the Animal Control Shelter, postponed until 12/19/06

Peter Heimbigner, Animal Control Supervisor, stated that the Lassen Humane Society  (not affiliated with the National Humane Society) has withdrawn the offer to supply volunteers and are not interested in entering into a Memorandum of Understanding to help at the Animal Shelter in Susanville. 

Mr. Heimbigner also told the Supervisors that a new Animal Control Officer has been hired and the Data processing person should be in place soon.

Lassen Animal Rescue founder, Eileen Spencer, (who has been soliciting the Board for this Volunteer Program for over six months) told the Board of Supervisors that they are very interested in a MOU. She stated that their volunteers will be "fully trained" to assist staff at the Lassen Animal Shelter.

Spencer told the Board that Lassen Animal Rescue has a member, Suzanne Monroe, that is a "Noah's Wish" Volunteer and would act as the liaison with the Animal Control Staff. Noah's Wish is the international animal rescue group, based in California, that set up and mobilized the huge rescue effort in Slidell, Louisiana after Hurricane Katrina. They were able to save thousands of stranded animals.

The Lassen County Board of Supervisors has decided to place the animal shelter "volunteer" issue on their December 12, 2006 agenda.

It only took a week to reconsider and move forward on allowing volunteers to help the animals at the County Pound.

David Williams filed four frivolous lawsuits against Kan We Help and he lost all four. In an act of desperation, Williams and his client James Forbes (an expelled KWH member) filed the last of these lawsuits with phony evidence.

Williams submitted a check to the court, as evidence of a loss by his client, James Forbes. However, the check was written but never cashed. At the end when they cashed the check, it bounced.

Lassen County moves to shut down all animal "foster care" homes.

THIS IS AN OBSCENE ACT BY LASSEN COUNTY

Richard Simon, Lassen County Chief Planner (530-251-8269), sent out letters on November 30, 2006 that state that foster care of animals will not be allowed in private homes in Lassen County.

The NON PROFIT animal foster care programs are run by volunteers that give their time, homes and resources "free".

The November 21, 2006 LMUD meeting included considerations on continuing involvement in bogus, phony, scams. The Agenda issues were not even reported on, because the Lassen County Times "conveniently" reported on the "smoke screen" Cady and Langston threw up rather than the continued money thrown at these bogus projects. 

The LMUD employees are tired of Cady's antics. He runs his law firm, he runs his golf course and who knows what other enterprises he is in, out of LMUD. The LMUD Board....well they are being well taken care of by Cady & Company.

Don't look for anything to change except maybe more employees will quit because they are tired of working with Cady and this Board of thieves.

When there is unrest, Cady usually works a pay increase for them. If that doesn't work then Cady releases rumors of ......"theft and vandalism". Pleeeeeeese.........................

The Lassen County Clerk has evidently reluctantly added a "link" to the Board of Supervisors agendas and minutes.

The public can now access the Board of Supervisors agendas and meeting minutes. The County Clerk has included it now on the County's Home page but it has been placed at the bottom right hand corner. This is about as inconspicuous as she could've made it, but at least it is now accessible to the public.

The Public will still expect to find the Board of Supervisors Agendas in the "County Departments" under Clerk of the Board or County Clerk. Nagel easily could've added the Supervisors  agendas and minutes under "Clerk of the Board".

61 animals killed in one month at County Animal Shelter

Sixty one animals were euthanized at the Lassen County Animal Shelter between October 19, 2006 to November 19,2006.  Out of these 135 animals processed, at the Lassen County Animal Control Department, during this period only 18 were adopted. They need outside involvement !!!!!

15 were marked "adoptable"

10 cats (1 was adoptable) and four dogs (3 were adoptable) were killed on November 17, 2006.

It is against the law for any "shelter" to destroy adoptable animals

Linda Witry, Deputy County Counsel, prepared a volunteer form that first asks if you have ever been arrested. The majority of volunteers will be kids. Witry insists on background checks for walking dogs.

 This is not only an inappropriate requirement but "classless".  

Out of 23 rescue groups and humane society's we researched....NONE HAVE THIS REQUIREMENT !!!!!

Lassen County Counsel continues to stall "Volunteer Form" for the Lassen County Animal Shelter   11/14/06

The newly formed animal rescue group, Lassen Animal Rescue, was asked to return to the November 14, 2006 Board of Supervisors meeting.  The Board of Supervisors agreed to place the issue of "volunteers" for the County Pound on the agenda and instructed County Counsel to formulate a County release so that volunteer groups can help walk, clean and socialize the adoptable dogs. 

The group was promised a "release form" for volunteers but instead got a caricature and a mockery of this form. County Counsel, after placing the word "DRAFT  in 4" letters across the document asked the "non-legal" Board of Supervisors to approve the form.

No action was taken in allowing "volunteers" to help at the County Pound.

 We would hope that someone in the County Counsel's office  would have been capable of submitting a "final form" but that was an overestimation of their capabilities.

This form might as well have been stamped REJECTED in 4" letters.

County Counsel with the help of the County CAO have effectively and deliberately "KILLED" the Volunteer effort.

Lassen Animal Rescue submitted a volunteer form, to be reviewed and  approved by County Counsel,   at the October 24, 2006 meeting (after waiting six months for County Counsel to release a form for volunteers). Meanwhile volunteers are prohibited from helping the animals at the Lassen County Shelter. Adoptable animals are presently being killed

THE PROBLEM: The animals have no advocate at the County level

John Ketelson is the CAO of Lassen County and in charge of certain County Departments. He is responsible for the Lassen Animal Control Department. The Animal Control building was recently completed, with the help of VOLUNTEERS and is located off Highway 395 across from the County Education offices on Johnstonville Road

Problem: The County presently kills adoptable animals

This is not a new proposal. This proposal was made to the Humane Society at the beginning of the summer by former Humane Society member and now President of the Lassen Animal Rescue, Inc.

This proposal, with many other pro-active programs were rejected by Mary Morphis because they  involved "work", "effort" and "participation" in the welfare of Lassen County animals. Something that the present Humane Society Board is not interested in. Morphis claimed that no one had the time to organize a volunteer program. The Humane Society has a bloated bank account of $56,000 and will discontinue the spay/neuter program when their "Grant" money is gone ($1900 remaining as of Sept/06).

The Lassen Humane Society gives minimal support to the volunteer Foster Care Program and has lost almost all of the Foster Care Parents due to lack of commitment shown by the Humane Society Board. Foster Care Parents must pay for the veterinary bills and they must find homes for the animals they foster. Basically, they are on their own.

Mary Morphis, President of the Lassen Humane Society (this group is not affiliated with the National Humane Society) and Humane Society member, Mrs. Merkle (wife of retired warden at CCC) suddenly appears with a proposal to have the inmates do the volunteer work. Again, that relieves the Humane Society from actually participating.

Lassen County revamped their website on November 1, 2006, but Theresa Nagel, County Clerk has decided not to use it

A phone call was made to the County Clerk's office because the County Clerk's new County webpage is partially "unlinked"......all of the important "stuff". The public cannot access Supervisors Agendas and Meeting minutes on the new County website?  

Susan Osgood, Deputy Clerk, told the caller (Osgood repeating Nagel's response in the background) that  Nagel was going to have her (County Clerk) website separate from the County's because she wanted it accurate.   ACCURATE (?) BUT INACCESSIBLE

NAGEL LEAVES OFFICE IN JANUARY/2007  ???

Theresa Nagel chose not to run for office again after she was named in the Diebold Voter Fraud lawsuit.  

Nagel however, has asked the Board of Supervisors to hire her as the "Clerk of the Board".  The only problem......this is the COUNTY CLERK'S JOB and Nagel will no longer be County Clerk.

After many requests and no response from the County Clerk, THREE WEEKS LATER, County Counsel responded and said that Theresa Nagel does not receive a separate check for "Clerk of the Board" because it is part of her duties as Lassen County Clerk.

KWH requested it again and LMUD's attorney, Jaimee Richey states that because we previously had requested the Expense Report that we are not entitled to it. 

In March/2006, Cady attended a CMUA meeting, Wapa meeting, NCPA meeting and had a secret meeting with Board members in Reno......

LMUD Board Statements of Meetings indicate travel and attendance to out-of-the-area meetings, yet they do not file Expense Reports.

Frank Cady, has in the past, placed LMUD Board Expenses in his legal invoices (Cady, Pardee & Richey, LLP).   When Cady's phony Arrowrock Project was in it's heyday, Cady placed the Nagel and Langston's trip, (July 3, 2003) to the bogus Idaho project, in his legal invoices.

The LMUD Board is now just hiding their expenses.  Most likely in Richey's invoices that LMUD has refused to release.

The City Attorney, Kathleen Lazard,  warned the Council Members of certain sections of Cady's proposed golf contract and then a typical Frank Cady reaction....he starts degrading and insulting staff and the Council.

The 40 year Lease Agreement states that the City of Susanville waived Cady's lease payments, to the City, for the first ten years. This was a million dollar gift.....................

Frank Cady filled the Council Chambers with "alleged" supporters, but none stood up for him when he started threatening the Council Members and the City with lawsuits and called the City Attorney's presentation "Pollyannish".

Background

Frank Cady is an attorney and the Lassen Municipal Utility District new General Manager. Cady was LMUD's attorney for 16 years. Under Frank Cady's advisement and counsel he ran this small utility to the brink of bankruptcy with his bogus projects and lack of management skills. (Will the Cady's expect LMUD to bail them out? Cady has raised residential rates three times in the last 15 months)

The current LMUD Board has proved to be impotent, but they had better do a better job now, on watching the "books".  If you've ever attended a LMUD meeting.....well, "Cady fiefdom" is a common term used..........Cady is abusive, manipulative and uses his own version of the law, "Cady Law" (which, by the way, when he has been challenged, "his" stated law, never bares any resemblance or has little or no relationship to actual law). Maybe that's why his practice went to the dogs.

Frank Cady proudly introduced his teenage son (below) as "CEO of the SGA, Inc." (this must have been a recent appointment, Sue Cady claimed to be the CEO) and told the Council Members that his son was going to give a 2 1/2 minute presentation. Unfortunately, Cady Junior did not know how to operate the equipment. The public waited 20 minutes before Cady Senior came to his rescue.

The 2 1/2 minute Presentation was a slide show that included a graph showing that the golf course is a failing business. Great job...Cady Junior.

Mayor Lino Callegari stated that he lost a friend because his friend said that a golf course in Susanville was economically unfeasible. His friend was right..............

Councilmember Bonham was not happy with the threats by Mr. Cady and undressed Mr. Cady for going down that road. Bonham was also not impressed with Frank Cady's proposing an amendment to his contract that would sell off the golf course land to pay off his debt. (Clever concept) 

PLEASE REMEMBER THIS IS CITY OWNED PROPERTY.

All Board members made it very clear that the City can not make "Gifts of Public Funds". Mayor Callegari emphasized, to the Cady Clan, that this was a private enterprise that failed.

Since Sue Cady began managing SGA, Inc. it went quickly down hill. Frank and Sue painted a bleak future for the golf course no matter who was running it. The fact that none of the Cady's knew anything about running a golf course didn't help.

Sue Cady became "indignant and unladylike" when she lunged at a member of the public who stated she was happy that they had lost their "shirts".

The Mayor asked the SGA, Inc. owners if they had a certified golf pro and they answered no. Todd Sickles was a professional golfer and drew golfers in. He's not part of "Sickles Golf Association, Inc." any longer........Geeeee, can we guess why?

Outgoing County Clerk, Theresa Nagel failed to place the LMUD Directors on the November ballot (Sargent and Langston). Nagel's son-in-law, Wayne Langston, will not be on the ballot again. Langston has never received a single vote EVER to be on the LMUD Board.

LMUD Director George Sargent has done literally nothing, in the past four years, on the LMUD Board. George signs checks (which the Board voted to allow Cady and staff to sign) and attends monthly meetings.

LMUD Director Sargent acquired his position during the 2002 LMUD Recall Election. Sargent has done nothing to promote LMUD or keep the rates down.

For this he receives "FREE" electricity, $35,000 in benefits and $100 for each event he participates in .

Pretty good pay for a "LUMP ON A LOG"

Plumas Sierra Rural Electric Cooperative stopped making annual payments to LMUD, OR DID THEY ???

LMUD sold (or as it turned out, gave away) 10% of its' most profitable customers to PSREC in 2002 and PSREC agreed to pay LMUD $155,000 "stabilization" payments each year until the year 2010.

 KWH requested a copy of the 2006 PSREC payment to LMUD. LMUD claims that there was no payment. There was no 2005 payment either. What deal was made here?

FACT OR FICTION?

Superior Court Judge Stephen D. Bradbury appointed the new Grand Jury on July 19, 2006. It has been fairly easy to find the "Ringers". RINGERS: The jurors that can be persuaded to omit, delete or diminish politically sensitive complaints that would effect certain powerbrokers of this County.  

2006-2007 Grand Jury Members

Jamiee Richey   (LMUD'S General Counsel), Frank Cady's law partner,  has been placed on this Grand Jury.

LMUD has complaints filed against them every year. This  appointment was not an accident by Judge Bradbury and shows where Bradbury's loyalties lay

This was a political favor to LMUD for the recent property transaction Bradbury participated in, in January see below of this year, and the illegal Beterbide/LMUD transaction last year that this Grand Jury will hear. LMUD SECRETLY PURCHASES LAND for office 

A few might claim that this is a cynical point of view, most contend that this is just life in Lassen County.

One retiring member of the previous Grand Jury refused to sign the final recommendations of the final report.

Bradbury attempted to place LMUD's Electrical Superintendent, Steve Trevino, on the Grand Jury. Trevino stepped down after KWH complained that a Conflict of Interest would exist with LMUD complaints being filed annually.

Lassen County District Attorney Soft on
"White Collar Crime"

While the Attorney General may have called Dr. Homer Cissell's (President of Lassen Community College) highly questionable practices "unorthodox" that only means that he is kicking Lassen County's dirty laundry back to Lassen County and leaving it up to District Attorney Burns to clean it up.

There is no incentive for Lassen County District Attorney, Robert Burns to put his friends in jail.  Burns still believes that he actually received the votes from the public in the June election.

Cissell's actions probably are criminally actionable, but the District Attorney's typical stand is to wait for a "civil action" and if no one has the money to file a civil action, then Burns will just look the other way and do nothing.

The State Attorney General's office does not have the money to prosecute local crooks. They always defer action back to the local District Attorney's office and Burns will always do nothing.

NCPA/LMUD Green Power Agreement 

LMUD General Manager/General Counsel, Frank Cady, put the NCPartyA Green Power Agreement back on the September 19, 2006 Agenda, after the LMUD Board was told not to approve it on August 15, 2006.

NCPA is an organization that needs to keep "NCPA" employees occupied with pointless studies and questionable "services" to public utility companies. 

The "Agreement" actually allows NCPA to bill for "studies" again....and that's all LMUD ratepayers will get from this "unchanged" agreement or any agreement with NCPA. This contract is the worst agreement next to the bogus "Resource 500 Plant". CVP/NCPA "RESOURCE 500" PLANT SCAM

It was not right FOR LANGSTON AT THIS TIME.

Why,  because Wayne Langston was waiting to see if anyone was going to run against him in the November election. Cady wanted him to look "electible".

Wayne Langston will never be elected, for any position, in Lassen County. This is why, for the last six years, his mother-in-law, Theresa Nagel,  does not place him on a ballot.

Langston has been given his seat on the LMUD Board and has sat there for six years without ever being placed on a ballot.  This is how corruption, greed and nepotism works in Lassen County. Langston's Father-in-law, LMUD Director Fred Nagel, is registered to vote in the PSREC District and isn't even within the LMUD boundaries......and his wife allows him to sit on the LMUD Board.

CITY OF SUSANVILLE REFUSED TO SIGN THE MEMORANDUM OF UNDERSTANDING ON "DOG BITE" PROTOCOL

 The MOU was a document that strictly outlined the legal procedures that the public,  public agencies and the medical institutions must follow when a dog bite occurs.

Refusing to sign the MOU was typical for a City that refuses to face the out-of-control dog problems that currently exist in Susanville.

This is typical of a City that refused to give their new "Dog Box" for their new "Dog Catcher Truck" to the County.  This action was spiteful and contemptible.

The City hired a Parking Ticket Officer in lieu of an Animal Control Officer and this employee drives around in the Animal Control truck.

The Lassen County Board of Supervisors voted to add another Animal Control Officer and asked Luann Rainey, Susanville City Manager, to donate the City's new "Dog Box" (box to place animals in after seizure) to the County. Her answer was simply "NO".

This was an irresponsible and vindictive act by Ms. Rainey. The City of Susanville has shown no interest in protecting the children of Susanville.

The children are at risk, the elderly are at risk. The public is at risk.

Langston's mother-in-law, Theresa Nagel, has ignored the PUC code that requires the LMUD Director to be placed on the ballot. CPUC Codes Even the Election Codes state that if there exits a "Principal Act" (CPUC codes governing municipal utility districts) , that this principal act shall govern.

Why? Nagel has never placed her son-in-law on any ballot......because no one would vote for him.

Outgoing County Clerk, Theresa Nagel, has the option not to place a non-contested position on the ballot only if the "governing" charter, code or ordinance doesn't state that it is mandatory for the candidate to receive the "highest number of votes."  Public Utility Codes requires Directors to be placed on the ballot whether or not they are unopposed.

LMUD DIRECTOR GEORGE SARGENT RUNS UNOPPOSED

Voters will not see George Sargent's name on the November ballot.

The LMUD voters will not have the "legal" opportunity to "WRITE IN" a candidates name for any LMUD Director.

LMUD DIRECTOR FRED NAGEL HAS NEVER BEEN A RESIDENT WITHIN THE LMUD DISTRICT

There is no "political" device nor any inclination by the District Attorney or Board of Supervisors to make the County Clerk, Theresa Nagel, follow the law. Theresa Nagel has benefited from allowing her husband and son-in-law to stay on the LMUD Board.  Nagel represents corruption and greed in its finest hour

Lassen Municipal Utility District never asked LAFCO to make the Wards, county wide, therefore, the only citizens that can run for a LMUD seat are the residents of the district (LMUD ratepayers).

Fred Nagel is registered to vote in the Plumas Sierra electricity district and is not eligible to sit on the LMUD Board. That's just a fact !!!!   But there he sits and there's nothing ANYONE CAN DO ABOUT IT.

Four of  the Lassen County Supervisors agree that no communication with Plumas County is necessary on the Dyer Mtn. Resort EIR

September 19 meeting cancelled

Supervisor Chapman has been advocating a meeting between the two counties on the Dyer Mtn. Resort. This resort will have a huge impact on both counties. With Jim Chapman absent, at the 9/12/06 meeting, the remaining Lassen County Supervisors decide that they will not meet with the Plumas County Supervisors prior to their vote on the Dyer Mtn. Resort EIR.

Supervisor Pyle led the opposition, to not having this meeting, and took advantage of the fact that Supervisor Chapman was not in attendance. 

Dyer Mountain Associates have had six years to move forward on the concept of a four season mountain resort in Westwood. The project remains just a concept with the EIR's approval still pending.

Chris Gallagher Doesn't Stay Long  

What happened in Watsonville, Arcata, Susanville?

Chris Gallagher was a Lieutenant in the Watsonville Police Department in 1999. 

Watsonville Police Chief, on June 22, 1999,  put Chris Gallagher in charge of installing the "Santa Cruz Metro Records System". This system was a database linking Santa Cruz, Scotts Valley, Capitola and Watsonville police departments. 

""The flow of information between agencies is going to change dramatically", said Watsonville police Lt. Chris Gallagher, who will manage the system." 

*So what happened? 

*One year later, on July 28, 2000, the Watsonville Animal Shelter was put under the Watsonville Police Department. The officers were now  the dogcatchers. Sound vaguely familiar? 

He came to Susanville in mid 2002. 

We all know how Chris Gallagher feels about Animal Control.  Gallagher eliminated the Susanville Animal Control Program in June of 2005.

Is the Arcata Police Department somewhere in between Watsonville and Susanville? Yes. Not even two years as Police Chief in Arcata, Chris Gallagher quickly moved from the Arcata Police Department to the Susanville position and clearly this move was not to "RETURN TO HIS ROOTS".

This website is receiving many, many complaints about the current management of Lassen County Times. 

First  and  foremost,   you  should  be  sending  these  complaints  to  them  not  us. 

However we do understand and appreciate that they have been rude, callous and obdurate to your concerns.

We would like to share, with you, just this one exchange of correspondence between Chuck Garner and the Editor of the Times, Barbara France.

The actual LCT policy  seems to be drastically different than what the public is told

The controversy began when Mr. Garner started noticing major similarities between the writings of the pseudo author "Tucker Jones" and Chris Kozak.

Susanville Chief of Police Chris Gallagher's last day will be September 17

Gallagher will start his new job at the Los Banos Police Department on September 18. Their loss, our gain.

Barbara France's HUSBAND (?) jon states that Gallagher will only work in Los Banos long enough to get the city's  retirement package and plans to move back here in five years.  Los Banos probably does not know that Gallagher is intending to make this a "short" term move. But Susanville didn't know what they were getting either. 

Did anyone notice that the Lassen County Times has had a "NEWS BLACKOUT" on Gallagher leaving...why?  They didn't want anyone to contact Los Banos and tell them the truth about Gallagher's history.

NOTE: Don't worry Jon, everyone wanted him to leave. You only lost a golfing buddy, the City of Susanville lost a bully.

The unpopular Police Chief has been marketing himself to other cities since his legendary skunk incident. Gallagher's unpopularity began before the skunk shooting at the Fairgrounds. Gallagher's Bunker Mentality was a little too much for this small community.

Gallagher hired an attorney, in Chico, to threaten this website with a lawsuit. 

Since there was no libel published about the Chief the threats and the lawsuit went away. Now....the Chief will go away.

Gallagher's Last Ditch Effort to Stay

Quietly before a Council meeting, the Chief gave the City of Susanville (City Manager and three Council Members) an opportunity to keep him if they matched what he was offered in Los Banos. The City declined to entertain any offers to keep Gallagher. The offer, if accepted, would have made the Chief the highest paid employee in the City. 

City Manager, Luann Rainey receives $105,000 a year plus benefits. Many felt that Gallagher had been positioning himself for the City Manager job since he arrived.

Lassen County Times Editor, France, is running out of steam with her phony "Letters-to-the-Editor" responses

The letters are real, the authors are not. "Tucker Jones" has been identified as a staff writer for the LCT. 

The policy to use phony names, for these rebuttal articles, has run out of steam and novelty. The use of the phony authors was to literally bait the public into a "Debate".

The best letters receive their own dedicated authors, i.e.; James Ausmus gets "Brad Jenks", Chuck Garner gets "Tucker Jones" and Eileen Spencer was given three phony authors, "Liz Mahan, "Drant Wilson" and the infamous "Nikki Smith". The true identities, fortunately, have been identified. This is so pathetic it is unconscionable.

These phony rebuttals, however amusing and entertaining for the LCT staff, are misleading and unfair to the original writer.

PUBLIC BEWARE

If you are looking for a legitimate follow-up  or rebuttal to your "Letter-to-the-Editor" know before hand that it will most likely be written by a staff writer or an editor of the Lassen County Times. 

Libel has nothing to do with the blatant censorship of the Lassen County Times. It has everything to do with gross censorship and  partisanship. 

Shame on you Lassen County Times, shame on you.

Lassen County Animal Shelter Provides No Medical Care for Animals

The animals brought to the Lassen County Animal Shelter are not receiving any medical care. The only time the Lassen County Animal Shelter animals receive a visit from a Vet.....is the day they die.

Why did Judge Bradbury receive an undisclosed payment for "60 S. Lassen" ?

Web of Deceit ?

On June 28, 2005, 60 S. Lassen was owned jointly by Craig Kellsion, now a U.S. Magistrate and Frank Cady, now a Manager of a public utility in Lassen County. 

In a questionable sale, recorded on June 30, 2005, Frank Cady sold his half of 60 S. Lassen, to his law partner, Jaimee Richey, to make it appear that he had no interest in the property of  his Limited Liability Partnership with Richey (compliance with the FPPC rules of Conflict of Interest). Cady then hired his law partner, Richey, as his replacement at the same public utility. GRAND JURY COMPLAINT    COMPLAINT EXHIBITS   

Craig Kellison then sold and recorded his half to Frank Cady five days later (July 5, 2005), giving Frank his half ownership back.  

At this time, Judge Bradbury did not have any interest in 60 S. Lassen.

Jaimee Richey then made it appear that she sold 60 S. Lassen to the Methodist Church on January 31, 2006. 

Why is it, that at the same time Richey was selling this property, Judge Bradbury was suddenly in the picture with a payoff?

Lassen County Budget Talks Continue.....

Supervisor Chapman states that he will vote to approve the Budget if certain issues are met. Traditionally, Chapman has always voted no on the County's Budget. 

Chapman wants the 2006/2007 Budget to include the demolition of the jail facility next to the County Administration Building.

A $50,000 Facilities Planning Study has been ordered as to the outcome of the Court property. The State of California is planning on building a new facility for the Lassen Superior Courts. 

Supervisor Hanson  and Supervisor Chapman both wanted money earmarked to repair the County's cemeteries  The fence at the Cemetery adjacent to the Court House has been in disrepair for many years.

Caltrans has all summer to work on Hwy 139 and they pick the first day of school to work on a section in front of the entrance to the College.  

Staff and students were delayed more than a half hour all day. Fifty or sixty cars were backed up outside the campus waiting for the Caltrans "sign holder" to allow cars to enter the campus. This activity went on all day.

The Lassen County Board of Supervisors agree to add Second Animal Control Officer

and one part-time clerk

The Supervisors instructed staff to "fill-in" the numbers for the badly needed additional staff for the new Lassen County Shelter. 

After much animated discussion, the "dispatch" for all animal control calls will be through 911. The calls then will be routed to the Animal Control Officers. After hour calls and overflow calls will be handled by the Sheriff's Department. 

Animal Control will stay within the County Public Works Department.

 Supervisor Chapman was very upset with the way the West Nile Virus "alleged threat" was handled and he and Supervisor Dahle voted no on the spraying.  This photo was taken during the heated discussion in regards to whether Lassen County will spray for mosquito abatement. The motion passed to proceed with the spraying when Supervisors Pyle, Hanson and Keefer voted for spraying.  The County has received a grant of $100,000 to mitigate a threat of West Nile Virus should it be found in  Lassen County.

LMUD General Manager raises electric rates for residential customers again

LMUD's Frank Cady sleazed through a Resolution last year that allowed him to raise rates at will. The electric rates for residential customers was $11.5 per KWH when the Board hired him last July. He has raised rates twice in a year. The residential rates are now $12.5 per KWH.  

CADY will continue to raise our rates until we DO SOMETHING TO REMOVE HIM. 

This LMUD Board refused to reduce their wasteful and extravagant spending before raising rates last year. The ratepayers must continue to support an extravagant lifestyle for Frank Cady and his buddies....... 

Frank Cady's abuses are thrown in our faces everyday and will continue until he is removed from LMUD

The Lassen Humane Society brought Greta to the Lassen County Board of Supervisors meeting on  Tuesday, August 8.

Greta was picked up on July 6, 2006 by the Lassen County Animal Control Officer and was  scheduled to be euthanized on July 14, 2006. This is an "ADOPTABLE PET".  Greta is a 3 1/2 year old female spayed Standard bred German Shepard with current rabies shots and needs a permanent loving home.

Lassen County Supervisors to Consider Adding Second Animal Control Officer in Budget at August 8, 2006 Meeting

Lassen County Sheriff Warren tells County Supervisors that they need THREE ANIMAL CONTROL OFFICERS if they want the job done right. 

Sheriff Warren told the Supervisors that his Department receives on the average of 7-9 animal related calls a day. Warren also told the Supervisors that he doesn't plan on being in charge of "ANIMAL CONTROL now or ever".

Other issues brought to the Board of Supervisors was the issuance of citations, whether or not the animals at the shelter are getting veterinary care, are adoptable animals being killed, are animals that are repeat biters being handled correctly according to County Codes? 

This issue will be before the Supervisors again at the next Budget Meeting, August 15, 2006

NOTE: Jaimee Richey and Frank Cady made false statements to LMUD that they were registered as a Professional Corporation. The California State Bar imposes a fine for attorneys making such false statements. Richey did file a "Professional Corporation" after the KWH complaint was filed. Cady did not dissolve the LLP even though the Grand Jury stated that Cady and Richey were not partners.  As of July 13, 2005 Cady was a partner in Cady, Pardee, Richey LLP. 

NOTE: What relation, if any, is Grand Juror Teri Lynn Bejeck with LMUD's Keri "Bejeck" Richards? 

Judge Bradbury actually placed LMUD's Steve Trevino on the Grand Jury. KWH filed a complaint and Trevino resigned. 

Lassen County Grand Jury may well be simply a political tool for the "Powerbrokers". 

The fact that a Juror, with a conflict of interest in a matter before the jury, may decline to "vote" on any subject.....does not relieve the public from being  concerned with the fact that this juror remains on a Grand Jury and can influence this jury even without a vote on the final report.   

Property Sale Highly Suspect

Craig Kellison and Frank Cady owned equal shares in 60 S. Lassen. Cady sold his half to Jaimee Richey on 6/30/05 and then Kellison sold his half to Frank Cady five days later.

 On 7/5/05 Frank Cady still owned 1/2 interest in 60 S. Lassen. Cady lied to the LMUD Board when he stated that he had no interest in the property at 60 S. Lassen. Craig Kellison supported this deception by not selling to Richey directly, but waited until Cady's half of the property was recorded to Richey on 6/30/05 and then he sold his half back to Cady on 7/5/05.

With the help of the "Assessors Office", Frank Cady's 1/2 ownership disappears. 

When the Grand Jury begins their investigation suddenly Richey "allegedly" sells 60 S. Lassen to the Methodist Church next door........?

Lively Debate at Lassen County Board of Supervisors 7/25/06 Meeting

Lassen County Board of Supervisors were given the three volume Resource Management Plans and the Environmental Impact Statement from the Surprise, Eagle Lake and Alturas BLM (Department of the Interior, Bureau of Land Management) offices. 

Supervisor Jack Hanson makes "light" of the voluminous three volume report that the Supervisors were given just before the meeting and commented that he didn't have time to read it and would reserve his comments until he was able to read it. 

Board of Supervisors put Animal Control on the Agenda 7/25/06

The Board of Supervisors received complaints recently on dog problems in the County. Larry Millar heads the Animal Control Division in Lassen County and attempts to minimize and mislead the Supervisors on Lassen County's dog problems. Millar clearly does not have a clue what is actually happening in this department.  

A dog that was being quarantined (at the Animal Shelter) for its "FIFTH" bite had been released back to the owner, again. 

This dog was scheduled to be humanely euthanized (by the Shelter, on July 14) but the Animal Control Officer Judy Walesch released the dog back to the owner. This was a discretionary decision that was clearly wrong. 

The Lassen County Animal Control "stiffed" Dr. Bob Nelson for the euthanasia bill ($45.00). Larry Millar told the Board of Supervisors that Dr. Nelson called to cancel the appointment with the owner of the dangerous dog. This was a TOTAL LIE. Judy Walesch called Dr. Nelson to tell him that she could not be there on July 13. In the meantime, the dog was at-large. The dog was euthanized in "Chester" on July 14. Judy Walesch was not present. 

This dog has clearly been a danger to the public for three years.  

Division 14, Chapter 9, Article 1, 31602 "Potentially dangerous dog" means any of the following.

(b) Any dog which, when unprovoked, bites a person causing a less severe injury than as defined in Section 31604.

Division 14, Chapter 9, Article 31604 "Severe Injury" defined

"Severe injury" means any physical injury to a human being that results in muscle tears of disfiguring lacerations or requires multiple sutures or corrective or cosmetic surgery. 

Westwood resident, Judy Robinson, tells the Supervisors of the near fatal dog bite on her daughter 

Judy Robinson asked the Board of Supervisor to hire an additional Animal Control Officer. 

CAO Kettleson (seated at the table and apparently oblivious to Ms. Robinsons pleas) argued that the City of Susanville decided it didn't even need an animal control officer and that if the County hired six more officers it wouldn't stop the dog bites. 

Kettleson's cold and insensitive remarks were irresponsible 

The City of Susanville eliminated their Animal Control Officer, in June of 2005, so that the Chief of Police could hire his friend. The dogs are now running in packs in Susanville. The Chief's decision was irresponsible and has put the public at risk. Susanville has no current agreement with the County to provide animal control services. Animal Control is a state mandated program. 

NOTE: If the laws were enforced, it would take the "repeat biters" away from the owners

The Board of Supervisors directed staff to bring, to the next meeting, the current County regulations on animal control and that the issue of hiring an additional animal control person will be included with the budget discussions. No promises were made by the Supervisors but they appeared to be genuinely concerned. 

Supervisors Decide Not to Support A "November Initiative" That Would Have Created a Recreation District.

There has been an effort by a group of citizens to build a swimming pool, for the community, since the Susanville pool was closed a year and a half ago.

There has been only talk about forming a Joint Powers Agreement with Districts within the County to pay for a new pool. Budgets are tight, in every District, and the idea of spending part of these budgets for a "swimming pool" seems to have been the biggest hurdle to a JPA being formed.  

The Supervisors decided that this Initiative would be expensive and had little chance to pass since there was no entity in place to accept the taxes that it would generate. 

A County recreation area is a great idea.....but all of the ducks were not in a row to move forward with a November Initiative.

Frank Cady is approving "overpayments" to Board Members. Darrell Wood submitted a statement in May to be paid $200 for one days work Link.  The law allows for only $100 per day link. The Board's resolution  90-02 identifies qualified events. Cady has been paying Board Members for events that are not qualified. link

Nancy Cardenas was paid $200 for June 22, 2006. link  She is only entitled to $100 per day. Cardenas charged $100 for attending the Science Fair. Resolution 90-02 does not allow her to charge for this event.

Susanville Police Chief, Chris Gallagher, discharged his weapon many times for an animal control incident at a Rotary barbeque last week at the Fairgrounds.  

Since Chief Gallagher eliminated the Animal Control Officer, in lieu of hiring his friend, there was no one to call for an out-of- control, possibly rabid, possibly plague infested,............. but most likely just a public nuisance....... SKUNK

*LMUD is advertising for two new vehicles. Surprisingly, they are in LMUD's  2006/2007 Budget. LMUD purchased one Hybrid last year. The LMUD Budget provided for two Hybrids and one van. 

General Manager-General Counsel Frank Cady runs around in a new GMC Quad Cab Duramax 4x4 truck.   KWH is researching whether or not this is an LMUD truck. The "Bling" on the truck is increasing. Westwood's Dyer Mountain Mountain Resort EIR Meeting

The long anticipated mountain resort took another step closer to reality today

County Supervisor Bob Pyle chaired the meeting for a public review of the Re-circulated EIR Report

The second iteration of the Dyer Mountain Resort EIR was released to the public today. The public has 45 days to review and submit concerns (August 25, 2006 will be the final day to submit concerns).

A surprise program, by the Dyer Mtn. Associates,  to BUY OUT "wood burning" stoves in Westwood and Clear Creek, was announced. This gesture is an effort to address air quality issues in the area.

The mountain resort executives have been particularly sensitive and have paid a great deal of attention, to the cultural effect, the project will have on the area. 

Supervisor Chapman was concerned about the amount of time  the presentation spent on traffic issues in Chester. Chester is in Plumas County. Although Plumas County Officials were invited to the hearing, none were present.

Supervisor Chapman also criticized the Committee for issuing a report that had missing pages. The report only included pages that had been changed. Chapman claimed that the report was "useless" to the Board and to the public.

The City of Susanville will continue to collect the dues from the uptown merchants and keep 2% (??) of the annual assessments as an administrative fee. The City provides absolutely nothing for the 2%. ...and the City may well raise this percentage in the near future............  

SUGGESTION: 

Susanville merchants should collectively send out a "weekly" advertisement direct to the public. Direct Advertising is still the best  and most cost effective way to get and keep customers. 

Small ads in a weekly "throwaway" newspaper is a waste of advertising dollars and is the least effective way to advertise.

Susanville City Council members installed at "morning" meeting

At a  9:00 AM Special Meeting, Susanville City Clerk gives Oath of Office to Rocky Joy and Kurt Bonham, 

Ousted Mary Fahlen left the Council Chambers sobbing

After the Oaths of Office were given, Rod Daboar stated  that the appointment of a new Mayor would begin. DaBoar immediately nominated "Rocky Joy" and asked for a second..... There was total silence from Council Members Sayers and Bonham. 

Newly installed Council Member Kurt Bonham then nominated Lino Callegari. Bonham stated that Callegari was the "senior" member of the Council. This nomination was quickly seconded by Doug Sayers. Bonham stated that the recent activity of Rocky Joy was part of his nomination of Lino Callegari. 

Rocky Joy then argued that Lino Callegari was on vacation and Joy suggested that this issue be tabled until Lino Callegari was present. Appointing a new mayor was postponed until Council Member Callegari returned from vacation.

Don Battles isn't worth giving the time of day to, let alone paying him $100 per hour to do what 20 other law firms are doing and 18 other "clubs" (NCPA, CMUA, etc) are doing for LMUD. 

THIS IS SIMPLY A GRATUITY FROM ONE DRINKING BUDDY TO ANOTHER

 Don Battles was hired by Frank Cady to do redundant useless and questionable tasks for $85 per hour. Now, Frank increases this amount to $100 per hour.

The LMUD Board spends hundreds of thousands of dollars each year to monitor the energy industry. LMUD uses well established "energy" law firms and expensive memberships to "over cover" "double and triple cover" activity in the energy market.

 Even the law firms duplicate the work of each other, yet Frank Cady wants to continue to give his friend, Don Battles, huge amounts each month for absolutely unverified labor........

SUSANVILLE COUNCIL MEMBER ROCKY JOY LEAVES ROOM PRIOR TO VOTE ON A ZONE CHANGE

At the June 7, 2006 Susanville Council Meeting, Rocky Joy left the room before the remaining members (Callegari, DaBoar, Fahlen) voted to approve a change in zoning. (Agenda item 4B)

When there is a conflict of interest, on an issue before an elected board that an elected official has a financial interest in, that person should not participate in the vote. But how often does the public know when there is a conflict interest............?

However, the flaw in this law is that the elected official can influence the vote prior to it even appearing on any agenda. 

Agenda item 4B, on the June 7, 2006 Susanville Council Agenda, involved property that Rocky Joy had some connection with. The Council approved changing a commercial zone to a residential zone so that eight houses could be built. 

This property is across the street from Rocky Joys office on Main Street. 

The property just being across the street from Joy's office would not be a conflict of interest. 

If Joy owns or is in a partnership with the owners to build these eight houses.....then this is a conflict of interest. Joy did the right thing when he left the room. 

The Question: How much did Joy's interest in this property influence the City Council's vote?

Susanville Council Member and local Realtor, Rocky Joy purchased this property at 1900 Main Street in Susanville,  on November 15, 2005. 

Suddenly the City of Susanville is improving this short street adjacent to Joy's property. These improvements, at the taxpayers expense, will improve the value of Joy's property. 

A search of the of the Susanville Council's agendas revealed no "approved" street paving for McDow Street. 

NOTE TO LOCAL REALTORS: Wouldn't it be "wonderful" to have all the improvements to your listings be done at the expense of the City of Susanville taxpayers .....????  All you have to do is run for the City Council

FRANK CADY HAS FULL TIME JOBS OUTSIDE OF LMUD

Frank Cady has a contract with the Lassen Municipal Utility District that requires him to be a "full time" General Manager (paragraph 10 of Cady's contract), yet he spends all of his time on his "other" jobs  Cady's 2005 LMUD contract  . When do you ever see Frank Cady in his LMUD office doing "LMUD" work........????   NEVER

Frank Cady is a partner in the Sickles Golf Associates corporation. Cady runs the Susanville Golf Course............

How does he have time for his law practice too? 

ANSWER: The LMUD Board of Directors have looked the other way, with their blinders on, and have demonstrated no ability or interest to make Frank Cady accountable.....why make Frank accountable when they aren't even accountable.....? 

This Board has hidden their expenses in Frank's legal invoices for years....Frank now makes sure that the legal invoices redact the Board members "expenses".  

The ratepayers are paying Frank Cady over $130,000 a year in salary,  $35,000 in benefits for his family, $4,800 a year car allowance to drive a LMUD vehicle and $35,000 + in benefits and a 401K retirement package  for his law partner.

THAT REQUIRED YOU TO READ YOUR LASSEN COUNTY TIMES 6/13/06 ISSUE, SIDEWAYS......

Slanted news.....? So slanted that you had to read the LCT sideways.....But this newspaper made no effort to hide the fact that they  subliminally supported Steve Warren, Rocky Joy and Ridgely Lazard. 

May we suggest that you just give your candidates "free" advertising and be done with it. Giving them front row seating in your paper during the campaign is the same thing. 

Allowing the Rod DaBoar's of this County to write your editorials....well it was just a "NO CLASS" act.

Remember when the "Sheriff's Blotter" was just that, a blot in the newspaper. 

Then all of a sudden France, Managing Editor, started doing full page articles on simple Sheriff's arrests for the Sheriff's campaign. France failed to print the photo of the "mud" that stuck to Warren when he moved here. Warren's history hit him so hard during this campaign that the Lassen County Times worked overtime to suppress it. Warren knows the truth about Chico and he should step down......He doesn't have the guts to tell the truth!!!!! The public remains at risk.

Remember when former Judge Lazard was never mentioned in the newspaper, because he was always rejected by attorneys to hear most cases. Then all of a sudden he is in the paper every week. When Lazard was disqualified by a "Judge", for bias and prejudice, it was  impossible for him to overcome.  

Remember when Rocky Joy was the "Golden Boy". Well, you all know why the paper supported this Susanville Council member. They owned him, lock, stock and barrel.  SEE THE "FRONT PAGE".

Historic Uptown Susanville Association (HUSA) "Main Topic" at Susanville Council Meeting

The Susanville City Council's June 7, 206 meeting entertained a full house.

HUSA members and non-HUSA members attended the Susanville Council's June 7, 2006 meeting. The Council held a public hearing on fee assessments and parking issues in uptown Susanville.

The discussion was divided on whether HUSA should continue. Supporters of HUSA claimed that the Association is needed but needs direction. Non-supporters claimed that HUSA did not provide needed services for the huge mandatory assessments. HUSA members were divided on the "parking" problem in uptown Susanville.

Bill Noonberg stated that his wife's business is hurt by closing down the uptown area for events and that parking was no problem. 

Many HUSA members filed complaints with the City of Susanville, but failed to reach the 50% mark that would have taken the issue out of the Council's hands.  HUSA members asked that the Council continue the public hearing until all HUSA members could be contacted. The Council agreed to continue the hearing to June 21. 

 Susanville City Manager, Luann Rainey, makes some very smart changes.

KWH e-mails received blame Susanville Councilmember Mary Fahlen for the Taborski Deal.

Kan We Help has received hundreds of e-mails over the Susanville City Council race. The public seems to have blamed Mary Fahlen for the Taborski Fees/Land Deal. Mary Fahlen had previously been the City Clerk and knew that the transfer of property needed to be recorded.... but Rocky Joy is a Realtor and the only Council member to profit from the deal.

Barbara France's e-mail to KWH today states that the Deed won't be recorded today. That simply means a trip to the County Recorders office tomorrow. 

Lassen County Times, Shayla Ashmore, moves down the ladder swiftly

Inside information says that Shayla's downward spiral wasn't because she is going back to school. Ashmore broke one of Taborski's rules.  

Sam Williams took the same spiral when he wrote an "honest" report of the corruption in Lassen Municipal Utility District. The question now is, has Sam sold out his integrity to move back to his old job?

There is a reason that Taborski has a high turnover rate in employees. The honest people leave.

Suddenly Mike Taborski offers to turn the Deed over to the City of Susanville at the June 7 Susanville City Council meeting. 

Kan We Help exposed this "deal" in April of 2006. Kan We Help requested all documents regarding this "fees for land deal"  The City's attorney, Kathleen Lazard, claimed that there was no Deed to be recorded. 

According to the Agreement, the City of Susanville was to record a Deed no later than April 30, 2006. The Deed was never recorded. Taborski was going to get "free fees" and not have to give up his land. 

All Kan We Help asked the City of Susanville to do was to record the deed (39'x190.93') if the City  was going to waive a portion of Taborski's developer fees ($14,892) in exchange for a portion of his property at 100 Grand Avenue. 

THE CITY OF SUSANVILLE NEVER INTENDED TO RECORD THE DEED

Finally, the City's lights went on......the Deed for the Taborski land will be turned over ceremoniously to the City of Susanville, at their regular meeting at 7:00 PM tonight. 

KWH will continue to monitor this deal to insure that Mike Taborski pays the rest of the developer fees.....estimated $20,000 in additional fees.

"Fees for Land" Scam

City of Susanville Council Member Rocky Joy promoted and voted for the Taborski "Fee for Land" deal on December 7, 2005 when it was introduced and again on February 15, 2006. 

The City signed the Taborski "Fee for Land" deal on April 19, 2006. Rocky Joy NOW abstains from this vote.

Rocky Joy's Real Estate Company had been given the listing to sell Taborski's building on Main Street.

The City of Susanville was required to record the new property obtained through the Taborski Agreement  but, as of May 12, 2006, never recorded the property exchange. So will Mike Taborski (owner of the Lassen County Times) get his developer fees free? 

These are the typical public "deals" that need to be watched. 

If KWH had not investigated and researched this deal, the City of Susanville would have given away needed revenue, and still may if this is not monitored. 

What other deals has this City Council made?

Kathleen Lazard (Judge Ridgely Lazards wife), Susanville City Attorney took great exception to KWH exposing the "Fee for Land" deal and wrote KWH a rather odd letter demanding an apology.  KWH in turn, asked for her resignation. 

The City Clerk and Lazard failed to record the Taborski property exchange.

 The City of Susanville re-instated $24,000 in the 2006/2007 Budget for Animal Control and says that it is only for Dispatch ?

Peace Officer Personnel Records/Citizens Complaints

"California Penal Code Section 832.7 on its face appears to exempt from disclosure peace officers personnel records. As interpreted in Bradshaw v City of Los Angeles, 221 Cal. App.3d 908 (1990) however, the statute applies only to litigation and does not preclude law enforcement agencies from releasing information contained in peace officer's personnel file."

In Bradshaw, a Los Angeles police officer was accused of misconduct. The information was released to the public. Bradshaw sued the city of Los Angeles for releasing the personnel file and lost. The court found that the only information that the Police Departments cannot release is the address and home telephone number. 

Police officers personnel files can be released by filing a Public Records request. 

Vote on June 6 for competent, trustworthy candidates.

Westwood Candidates Night

On May 16, 2006, the Westwood Chamber of Commerce hosted a Candidates Night at the Westwood Community Center. Over 90 people attended this event. 

Candidates for Sheriff, Benny Wallace and Steve Warren attended and also the candidates, Don Sokol and Ridgely Lazard, for Lassen County's District 2 Superior Court Judge.

Mr. DeMartinpry, owner of Westwood's Ace hardware,  was the moderator. He explained that the candidates will have 7 minutes each for their opening statements and then 3 minutes each for rebuttal. The rules allowed for a five minute opportunity for the audience to ask questions.

SUPERIOR COURT JUDICIAL CANDIDATES

The candidates for Superior Court Judge spoke first. A coin was tossed and Don Sokol was the first to speak.

Don Sokol displayed the confidence and demeaner of a judge.

 Don Sokol spoke about the demonstrated bias and prejudice of Ridgely Lazard. 

Don Sokol has impeccable credentials. He is a graduate of Stanford University

THE BEST CANDIDATE FOR THIS POSITION

   Ridgely Lazard read from a paper and told the Moderator, Mr. DeMartinpry that he didn't care about the time limits. Ridgely Lazard acted like this was his court and he could bully people, and he did.  Lazard took 2 to 3 minutes over all of the other candidates. Ridgely then went into a Pillsbury Doughboy comedy routine.....inappropriate at best.

Audience Questions: 

        Don Sokol

Question: How would you sentence a child molester?  ANSWER: If convicted, I would give him the maximum the law allowed.  

        Ridgely Lazard

Question: Is it true that a State Judge disqualified you and that you are the most recused and rejected Judge in Lassen County? ANSWER: Judges are disqualified every day. I was never given a hearing. 

Question: Isn't it true that recusing a judge is totally different than a State Court disqualifying you from hearing  cases because you were found to be biased.  ANSWER: Non-responsive. Repeated the fact that Judges are disqualified every day and said that "I got rid of the Southern California liberal, Toni Healy". 

Lazard went on to complain that Healy wanted to change the way "we do things here". 

NOTE: Lazard's continued and obvious bias and prejudices came through load and clear

(Toni Healy is a well respected Public Defender that left because Lazard and the District Attorney began discriminating against Healy's husband) 

COUNTY SHERIFF CANDIDATES

Steve Warren spoke so fast that his message was lost and the audience let him know that they did not understand what he was saying. Intentional on Warrens part, probably. Warren claimed thinly veiled endorsements and questionable accomplishments. Warren left the audience with many doubts. 

Benny Wallace came prepared and made a presentation that was clear to the audience. Wallace reputed the questionable accomplishments of Warren since Warren was appointed by the Board of Supervisors in December of 2004. Wallace claimed that the required training of the deputies has been deficient under Warren. Wallace claimed that Warren does not have an open door policy and that deputies will continue to leave the Sheriff's Department. Wallace spoke of pay increases and the safety of the Deputies was paramount. WALLACE IS CLEARLY THE BEST CANDIDATE FOR THIS POSITION.

Question: Were you fired from the Chico Police Department?  ANSWER: Yes and no, but I fought it and eventually I just left. 

 Question: Has Benny Wallace ever approached you concerning any ethical issues? ANSWER: Non-responsive. Not in the last few months. Is there something that I am missing here? Could you be more specific. Non-responsive answer.

Benny Wallace:

Question: When you are Sheriff and you are given documents that a deputy had been fired from another agency that indicated that this deputy could not work in law enforcement again and this information was never provided on this deputy's employment application, would you fire this deputy? 

ANSWER: Absolutely, there is case law on this. 

Question: Have you ever been charged with an ethical violation? 

ANSWER: Never. 

The audience indicated that they were not given enough time to question the candidates. Mr. DeMartinpry asked the candidates if they would mind staying an additional half hour and they all agreed to stay.

Mr. DeMartinpry thanked the candidates and audience for their civility during the event. 

The event ended at 9:30 PM

Mike Taborski allegedly made a deal with the City of Susanville so that he would not have to pay over $40,000 in developer fees for his new office building.

Public documents show that the Agreement was to be closed no later than April 30, 2006. 

As of May 12, 2006 Taborski still owned  the entire lot at 100 Grand Avenue in Susanville and there are no plans, according to Kathleen Lazard (Susanville City Attorney), to record any documents to state otherwise. 

The Feather River Publishing Company NEVER OWNED 100 GRAND AVENUE IN SUSANVILLE.

INCREDIBLY UNTIMELY SCAM BY THE SUSANVILLE COUNCIL

No "transfer" of the portion of the property "sold" to the City of Susanville has been recorded. 

No application for a "line lot adjustment" has been filed by the City of Susanville or Mike Taborski. 

No justification of Taborski's property being de-valued by the Assessor from $140,000 to $91,800 after he bought it. Taborski bought this property on 5/12/05. Were deals being made with the City of Susanville and the County Assessors Office a year ago? 

The value of Taborski's lot was reduced by 35% to reduce his taxes

LASSEN COUNTY TIMES OWNER, MIKE TABORSKI TAKES OUT LOAN ON THE 100 GRAND AVENUE PROPERTY 

  According to public documents, this transaction was recorded on 4/11/06. Plumas Bank issued the loan on the property as it existed on December 27, 1978

Taborski allegedly offered the City of Susanville the "land for developer fees" deal on February 15, 2006.

The City Council waits until April 12, 2006 to approve the "deal", just one week after Taborski took out a loan for the "entire" lot that included the 39'x 193'portion of the February 15 Susanville deal.

James Forbes, of Susanville, claimed over and over that he was going to make millions from his lawsuits.....well, he hasn't won any and now faces malicious prosecution lawsuits for pursuing "meritless", "friviolous" cases and one case where they even invented the damages.

In 2004, James and Carol Forbes, of 1101 Modoc Street in Susanville, filed lawsuits against the City of Susanville, Susanville Police, Chief Gallagher, Officer Jordan, Bill Noonberg, Jack Helsel, Eileen Spencer, the Lassen County Times and the Lassen Municipal Utility District.

The Forbes have gotten Zero $$$

David Williams, the Forbes attorney, recently was handed his latest dismissal for his case against the City of Susanville. 

Spencer said, " The Forbes lost all of these lawsuits because their evidence became the figment of their imagination.  The Forbes filed three lawsuits against me that were malicious and based on pure fabricated declarations. Their attorney, David Williams and his Litigation Manager John Zenith,  pursued them anyway but the courts saw through the lies.  They lost all three. The last case cost Williams and Forbes $9,000 in court ordered sanctions. I'm pursuing a malicious prosecution case against them all (Williams, Zenith, Carol Forbes, Jim Forbes) and I hope that the City of Susanville and the Lassen County Times will do the same. "

Retired Marine Zetta Clark, (far right, pink vest) belonged to the only all Marine Women's Band

The Lassen County Veterans, ranging from World War II to the present asked the Board of Supervisors to augment existing services. Currently there is one VSO for Lassen County. 

The issue was not on the Agenda but the Supervisors hopefully will take a favorable action in the near future.

The Lassen County Times traded 39'x 193.93' of this lot at 101 Grand so that the City of Susanville would have access to the alley (the alley is owned by the City of Susanville)

The Lassen County Times has fenced off the portion of the lot that the City allegedly purchased and the alley that the City owns. 

IS THIS NOW A PUBLIC SAFETY ISSUE? 

There seems to be no access at all.......for the City. 

Susanville has now decided not to charge a fee for the return of political signs and has relaxed the sign enforcement codes. 

Mr. Nebecker & Chief Gallagher were  selectively enforcing the codes when they took just certain signs from homes and roadways. Rocky Joy's and Mary Fahlen's sign's were not taken......????????

Mr. Nebecker removed a sign from Supervisor Chapman's home. That was probably a big mistake.

City of Susanville's Bad Decisions Continue to Cause Lost Revenue

Did the City just buy good press?

On February 15, 2006, according to the Susanville City Council minutes, Mike Taborski (Lassen County Times, aka Feather River Publishing) presented his offer to sell Susanville a portion of his lot (100 Grand Avenue) he acquired a year ago (from Plumas Bank) not for cash.....but for a waiver of developer fees....$30,000 + in developer fees (Revenue the City desperately needs).

The City Manager ordered an appraisal on this property in December 2005

There is no record of the City Council voting on spending money on an appraisal....no mention at all in the meeting minutes.

On January 3, 2006, an appraisal was done for the City of Susanville for Mike Taborski's property. The appraisal  was done by John Bentley.

Mr. Nebecker told Rocky Joy that the size of the property in question was 39' x 150'.

The piece of property is actually 39'x 190.93'

Mr. Nebecker has a little trouble with math......this is approximately 1/6th of an acre. One Acre is 4840 sq. yards.

Let's do the math........39'x190' = 819 sq. yards

Mr. Nebecker told the City Council that "39'x150', or a little over an acre

Did Rocky Joy intentionally mislead the public and the other Council Members when he stated, "Mayor pro tem Joy stated that it was advantageous to own the property as it will permit City access all the way to the alley"

FACT: The City owns the alley. Joy's statement is superfluous  

This was the deal

There is no advantage at all for the City to acquire this portion of Mike Taborski's property.

Mike Taborski's property value was reduced after he purchased this property on May 12, 2005. This reduces his taxes.........which results in lost revenue for the City.......DEALS WERE MADE

So why did the City of Susanville pay $2.00 sq. ft.

7446 sq. ft @ $1.93 sq. ft.  = $14,370.78

It  was  just  probably  easier  to  round  it  up  to  an  even number.......

This was just another Dog & Pony show at the taxpayers expense. Shame on Taborski and shame on the City Council

Susanville Chief of Police remodeling Police Department

This was not the best time to spend money on a remodel when the City claims that they are in financial straits. The Police Department is remodeling.......where did they get the money?

38% of the City's budget is spent for the Police Department. Only 17% is spent for the Fire Department.

Susanville has a population of less than 7,000 people (10,000 are prisoners) and 38% of the budget is spent on police. That's over $2,000,000 annually for 7,000 people. 

The Fire Department should have the 38% and the Police Department should be 17% of the Budget. Susanville is a high desert partially forested area. The City should reconsider it's priorities. 

Feather River Publishing property not identified 

The City of Susanville agreed to exchange developer fees with the Lassen County Times for an unknown, unidentified piece of property. The City claims that their appraisal of this "unidentified" property is valued at $14,892. [KWH has requested a copy of the appraisal. ]

Mayor DeBoar clearly did not want to discuss any details of this transaction. Why?

Susanville City Council  places the purchase of property on the April 19, 2006 Agenda (in open session as required by law)54956.8- Negotiations for sale of public property

The Susanville City Council placed the issue of purchasing real property on their open session agenda as required by the Brown Act 

Public members attending the meeting requested that the items be pulled for discussion. One item on the Consent Calendar involved the "exchange of property" for development fees. The Feather River Publishing Co (Lassen County Times) negotiated with the City of Susanville to give the City a piece of land in exchange for the City waiving developers fees for their new office building on Grand Avenue.  

Mayor DeBoar was asked the value of the newspapers land and the value of the developer fees. He rudely and abruptly announced that this information is available through a public records request and refused to answer. 

The City Council decided not to act on the purchase of a $34,500 airport hanger claiming they had 0 budgeted. 

The City Council did approve an exchange of property at 700 Railroad for the cost of utility development on the property. The City did release the values on this exchange. The land was valued at $3,000 and the utility charges were $3,300. 

SELECTED SUSANVILLE BUSINESS'S WERE SENT LETTERS OF AUDIT 

In an effort to find "escaped revenue" the Susanville City Council has hired an Audit company. This company has sent letters to long-time local businesses which appears may be politically motivated.

Probably a little of both. 

Jaimee Richey could not practice law (a term that is loosely used) with anyone but Frank Cady. She has no talents or aptitude for the law nor any desire to develop any skills in that area. She just blindly follows her partner, Frank Cady.....who has developed "Cady Law" for her (make up laws to suit your scam and then make sure that the Susanville City Police, District Attorney and judges are on board)

1. COMPLAINT: Brown Act 54956.8 Failure to place the negotiations of real property in open session.54956.8- Negotiations for sale of public property

Richey's response:

"Please see attached agendas, dated 11/9/05, 11/22/05, and 1/17/06 in which all requirements of the Brown Act are met with regards to agendizing and identification of negotiators, persons, and properties."

FACT: The agendas do not reflect a single "open session" agenda item on real property. All discussions were done in closed session with no report of any action taken, ........ever....................

2. COMPLAINT: Lassen Municipal Utility District violated Brown Act 54952.6    54952.6.- Action taken defined

Richey's response:

"The purpose of Section 54952.6 is to define the phrase "action taken". It imposes no requirements nor contains any prohibitions whatsoever. It is impossible for a legislative body to violate a statute that contains only a definition, and therefore impossible for the Lassen Municipal Utility District to violate section 54952.6 as alleged."

FACT: No action was ever taken (open or closed) by the LMUD Board to purchase property. Approving a "payment of $381,000" falls slightly short of an open meeting vote and public discussion. LMUD purchased property secretly and illegally. 

3. COMPLAINT: Lassen Municipal Utility District violated CPUC Division 6, 11909    11909-Acts by Board, Motions, Resolutions, Ordinances

 Richey's response:

"You seem to assume here that the Board cannot move to act while in closed session. This is an erroneous assumption. FACT: All action taken must be reported. No LMUD minutes reflect any action taken by this Board prior to the purchase of this property, either in closed or open session. The property was secretly and illegally purchased. 

4. COMPLAINT: Lassen Municipal Utility District violated CPUC Division 6, 1189111891-Payment of demands

Richey's response:

"When the Board approved the LMUD management and staff to make an offer in the purchase of the subject parcels, they also authorized the payment of the purchase price, whether impliedly or directly, if the transaction were consummated. The payment was ratified at the regular meeting of the Lassen Municipal Utility District Board of Directors held on February 21, 2006."

FACT: The purchase of this property has never appeared on any agenda in open session and no approval was reported in closed session. The approval of the "payment for this property" falls short of a legal action. 

Note: Richey's rude, crude and unprofessional comments throughout her response were expected given her level of maturity. 

Richey now admits that Jack Beterbide was in escrow to buy the Prosise  property when LMUD purchased it from him the same day...????? On March 21, 2006 a lawsuit was filed in San Francisco that requests the court to rescind certification of the Diebold optical scan (Accuvote-OS) systems. If the court agrees, these machines will not be allowed to be used in the November 2006 election. 

Critics claim that when the election officials are allowed to "program" their own voting cards, there is an opportunity to program multiple cards. This would allow an election official to switch cards and essentially effect the outcome of the election. 

County Clerk, Theresa Nagel, has never allowed Poll Monitors to observe the election process. Nagel has never allowed Poll Monitors to observe the processing of Absentee Ballots....all allowed under the law............

On February 23, 2006, KWH requested copies of the LMUD Check Register because LMUD was deleting a portion of the checks.

LMUD requested an additional 14 days to respond. LMUD claims that they don't have to create records so the request was denied, however...

The Public Records Act 6253 states that  a "reasonably segregable portion " of  a record is available to the public and must be disclosed.      PUBLIC RECORDS ACT

The Public Records Act 6253 (c,4) allows a public entity to take an additional 14 days when there is a "need to compile data, to write programming or a computer program, or to construct a computer report to extract data"PUBLIC RECORDS ACT

Each time  LMUD releases the Check Register Report there are significant portions missing from this record.

THIS LMUD BOARD HAS A HISTORY OF HIDING CHECKS

LMUD has hidden payments in the past. They would hide Board expenses in legal invoices so that the public would not find out about trips and unexplained expenses.  These secret payments were discovered through the Public Records Act. 

The 2002 newly elected LMUD Board wrote  "manual" checks that were not listed on the Check Register Report released to the public.

This is now a fulltime problem that requires a fulltime solution

The Susanville Chief of Police fired the Animal Control Officer in June of 2005. The specially ordered truck and "dog box" has not been used since. Shortly after Gallagher fired the Animal Control Officer, he hired a friend and promoted this friend over other disserving officers.

When dogs are allowed to run loose, they eventually form packs. Unaltered dogs that run loose will eventually breed . If they breed with feral/wild dogs, it will take years for the City of Susanville to resolve the problem. In the meantime, the Lassen County Seat remains AT RISK. 

On February 13, 2006, this dog had been running loose at the Riverside Park for more than four hours. Families were stopping to enjoy the park but had to leave because of the nuisance and uncertainty of this loose dog. A Susanville police officer drove by when this dog was in the middle of Riverside Drive  and the officer did nothing but go around it.

Doug Ames, Lassen County Environmental Health Director, was asked to call a meeting by Kevin Mannel, after KWH brought concerns of  protocol not being met for submitting Dog Bite Reports throughout the County. 

Fifteen attended this meeting to re-enforce the process, including representatives from the Susanville Police, Lassen County Sheriff's Department, Michelle Joy (CEO of Banner Medical), Teena Carver (Banner Emergency), Dr. Holmes (Northeastern Health) and various staff  from the Health Department.

Frank Cady and Jaimee Richey are the registered "LLP" (Limited Liability Partners) 

No business license,  in the City of Susanville, for 2005-2006. 

The City of Susanville allows LMUD's attorney to falsely advertise, under a business name, that has no business license.

Arrowrock document proves the Arrowrock Feasibility Study was completed Arrowrock Scam

Frank Cady and the LMUD Board's lied about the Arrowrock Feasibility Study from day one. LMUD ratepayers were told, in December of 2001, that the Arrowrock Feasibility Study would be released once it was completed. 

KWH and the public need to see this Arrowrock Feasibility Study that they paid over $300,000. 

The Aqua-Terra company spent over $200,000 to bid on this project based on the October 2001 completed Arrowrock Feasibility Study. There were many, many losers from this scam. 

Frank Cady and Louis Templeton brought this "Un-named" project to the LMUD ratepayers...Cady began this scam as early as December 18, 2000. It was intended only to be a diversion.

LASSEN COUNTY TIMES REPORTS SUSANVILLE IS "FINANCIAL SOLVENT" (?)2/7/06

$1.5 million dollar shortfall

The Lassen County Times painted a pretty bleak financial picture for the City of Susanville. The article couldn't have come at a worst time for City officials that are trying to attract "NEW BUSINESSES". 

However, the City Officials continue to make Susanville "unattractive" to new business. Past decisions continue to effect City services. 

The Susanville City Council claims to have curtailed all recreation programs. This did not include eliminating the City sponsored Rodeo. It did include eliminating the animal control officer in order to hire friends of the Chief of Police. No money was saved by eliminating the Animal Control Officer.  To make matters worse, the Chief of Police then notified the Lassen County Animal Control Officer NOT TO PICK UP ANIMALS IN THE CITY LIMITS.

CITY WANTS A "PUBLIC SAFETY TAX"

The City of Susanville claims that "more than half of the city expenses goes to public safety". The Police Department has a budget of $2,324,786.

  The City of Susanville is the County Seat of Lassen County 

Lassen Municipal Utility District continues with plans for a 

"New Office Building"

The LMUD Board never included a "BUDGET ITEM" for any new office building for 2005/2006 fiscal year 2005/2006 LMUD BUDGET. The Board ignores the critical issue of a failing infrastructure and moves forward to spend the "capital improvement" money on their own comforts.....      Governing law on indebtedness

The LMUD Board has violated the Brown Act by moving forward with an "action" without any vote. 

 LMUD held a special meeting on February 7, 2006. The Agenda did not include consideration of a "new office building" for Frank Cady and the "elected" LMUD Board.

As usual, the LMUD Board fails to disclose intentions of constructing a new building when it decided to raise rates. LINK

These "negotiations" for the new building began on November 9, 2005, prior to any public disclosure.

This LMUD Board has violated the Brown Act by taking actions without a public vote. LMUD must place any purchase of land or capital improvement project on the Agenda. This issue has never been placed on any LMUD Agenda. "CADY LAW" does not require compliance with the Brown Act. 

BOTTOM LINE: No money has been approved for the purchase of land for a new LMUD OFFICE. No Budget for a new building
